Regulations on the Protection of Dong Cultural Villages in Tongdao Dong Autonomous County (Draft)

Article 1 In order to strengthen the protection of Dong cultural villages, these regulations are formulated in accordance with the Law of the People's Republic of China on Regional National Autonomy and other relevant laws and regulations, and in combination with the actual situation of Tongdao Dong Autonomous County (hereinafter referred to as Autonomous County).

Article 2 These Regulations shall apply to the planning, protection, management and utilization of Dong cultural villages within the administrative area of Autonomous County.

The Dong cultural villages mentioned in these Regulations refer to residential settlements with rich Dong history and culture, relatively complete Dong traditional architectural style and pattern, good ecological environment and certain protection value within the administrative area of Autonomous County.

Article 3 The protection of Dong cultural villages should adhere to the principles of overall protection, live transmission, rational utilization, government guidance, social participation and villagers' autonomy.

Article 4 Autonomous County People's Government shall be fully responsible for the protection of Dong cultural villages.

the cultural administrative department of the autonomous county is responsible for the protection of Dong cultural villages; The management office of Dongzhai Scenic Area in Wanfoshan, Hunan Province cooperates with the related management of Dongzhai cultural villages in the scenic area; The administrative department of construction and planning is responsible for the supervision and management of the planning and construction of Dong cultural villages; Other relevant departments shall do a good job in the protection and management of Dong cultural villages according to their respective responsibilities.

the township (town) people's government is responsible for the protection and management of the Dong cultural villages within its jurisdiction.

Article 5 Autonomous County People's Government shall incorporate the protection of Dong cultural villages into the national economic and social development plan, and set up special funds for the protection and development of Dong cultural villages.

Autonomous County People's Government encourages social organizations and individuals to participate in the protection and utilization of Dong cultural villages through donations and investments.

the autonomous county people's government shall commend and reward the units or individuals that have made outstanding contributions to the protection of Dong cultural villages.

Article 6 Village (neighborhood) committees shall do a good job in publicity and education of Dong cultural villages, organize the formulation of village rules and regulations for the protection of Dong cultural villages, urge residents to do a good job in environmental sanitation in the villages, implement fire control responsibilities and measures, and effectively protect and rationally use various facilities; Discourage and stop the destruction of Dong cultural villages.

article 7 the people's government of an autonomous county shall establish a protection list of Dong cultural villages and make it public.

Dong cultural villages listed in the protection list of autonomous counties should meet the following conditions:

(1) The proportion of Dong population is not less than 7%, and the total number of households is not less than 5;

(2) Traditional Dong buildings such as Diaojiaolou, Fengyu Bridge, Zhaimen and Drum Tower in the village are relatively intact, and the street space, river system, topography, farmland and forests are basically intact;

(3) The traditional culture and customs of the Dong nationality are well preserved and the intangible cultural heritage resources are rich.

Article 8 The identification of Dong cultural villages shall be jointly examined by the cultural administrative department of the autonomous county in conjunction with the relevant departments of construction, planning and ethnic affairs, and submitted to the people's government of the autonomous county for approval.

To declare a Dong cultural village, it must be discussed and agreed by the village (neighborhood) people's meeting or the villagers' representative meeting, and the township (town) people's government shall apply to the cultural administrative department of the autonomous county, and provide the following materials:

(1) A description of the historical evolution, local characteristics and historical and cultural value of the village;

(2) a description of the present situation of the traditional pattern and historical features;

(3) List of cultural relics and historic sites;

(4) description of intangible cultural heritage resources;

(5) the protection measures taken and the scope to be protected.

villages listed as national key cultural relics protection units, famous Chinese historical and cultural villages, traditional villages in China and villages with ethnic characteristics in China are naturally listed in the protection list of Dong cultural villages, and their protection shall be implemented in accordance with the provisions of relevant national laws and regulations, as well as these regulations.

article 9 the people's governments of autonomous counties shall implement classified protection for dong cultural villages.

The villages with concentrated Dong cultural representative projects, distinctive features and intact forms and connotations, such as taro, Hengling, Pingtan, Yanglan and Gaobu, are the key protection villages of Dong culture; Other villages in the protection list are generally protected Dong cultural villages.

article 1 the people's government of an autonomous county shall organize the preparation of the protection plan for Dong cultural villages, and shall solicit the opinions of the village (neighborhood) people's meeting or the villagers' representative meeting when preparing the protection plan, and make it public.

The protection planning of Dong cultural villages should be linked with the overall land use planning, the overall town planning, the village planning and other special planning.

Article 11 The protection planning of Dong cultural villages shall include the following contents:

(1) Protection principles and contents;

(2) delineation of protection scope, core protection scope and construction control zone;

(3) protection measures, development intensity and construction control requirements;

(4) requirements for the protection of traditional patterns and village features;

(5) phased implementation plan for protection planning;

(6) special plans such as intangible cultural heritage protection and economic development guidance.

Article 12 Dong cultural villages should be protected as a whole, maintain and continue their traditional pattern and historical features, respect local folk customs, and not arbitrarily change their interdependent natural ecological and humanistic environment.

the people's government of the autonomous county shall, according to the local economic and social development level and the protection plan of the Dong cultural village, improve the infrastructure and public service facilities of the Dong cultural village, and improve the living environment and production and living conditions.

Article 13 Autonomous County People's Government shall set up boundary markers in the protection scope and core protection scope of Dong cultural villages, and set up signs at the main entrances and exits of the core protection scope.

Article 14 No one shall engage in the following acts within the protection scope of Dong cultural villages:

(1) build factories and warehouses for storing explosive, flammable, radioactive, toxic and corrosive articles, and store flammable, explosive and other dangerous goods in residential houses and public places;

(2) electric fish, poisonous fish and fried fish;

(3) cutting trees and digging damaged flowers and trees without authorization;

(4) cutting mountains, mining, quarrying, dredging, taking soil and repairing graves without authorization;

(5) Dumping, piling, littering and discharging sewage at will in non-designated areas;

(6) posting advertisements and slogans at will, stacking and hanging related items that hinder the appearance of the village;

(7) scribbling, smearing, damaging buildings, cultural relics and public facilities, and moving or damaging cultural relics protection facilities;

(8) occupying garden green spaces, streams and rivers, roads, public places, etc.;

(9) other acts in violation of laws and regulations.

article 15 the people's government of the autonomous county shall protect and repair the buildings and facilities such as diaojiao building, drum tower, zhaimen, stage, wind and rain bridge, kuanping, satan, ancient well, stone tablet, etc. within the protection scope of Dong cultural villages, and keep them intact.

if it is necessary to build, rebuild, expand, maintain buildings (structures), roads, pipelines and carry out other engineering construction within the protection scope of Dong cultural villages, it shall conform to the requirements of the protection planning of Dong cultural villages and go through the relevant examination and approval procedures according to law. Construction units or individuals shall take measures to protect the cultural landscape and the surrounding vegetation, water bodies and landforms, and shall not cause pollution and destruction; Clean up the construction site in time after completion and restore it to its original state.

Article 16 Within the core protection scope of key protected Dong cultural villages, no other new construction or expansion activities are allowed except the necessary infrastructure and public service facilities. Demolition of buildings, structures or other facilities shall be approved by the competent department of urban and rural planning of Autonomous County in conjunction with the competent department of cultural relics.

for repairing buildings, structures or other facilities, individuals or units shall apply, and the relevant departments of the Autonomous County People's Government shall guide and standardize them.

article 17 if the existing buildings and structures within the protection scope of the dong cultural village are not in harmony with the architectural style of the dong cultural village, they should be demolished and rebuilt step by step according to the planning requirements, and the people's government of the autonomous county should give appropriate subsidies or compensate according to law.

the people's government of the autonomous county shall set up a new residential village in accordance with the protection plan of the Dong cultural village, and be responsible for site arrangement and infrastructure construction such as water, electricity, roads and communications, and provide homestead for residents in the village by means of replacement and cost transfer, and give appropriate subsidies to those who carry out construction in accordance with the planning requirements.

the people's government of the eighteenth autonomous county shall strengthen the publicity and education on fire safety in Dong cultural villages, set up and improve fire control facilities, and do a good job in preventing and eliminating fire hazards. If the Dong cultural village needs to be rebuilt due to fire safety, it should, as far as possible, set up a reasonable fire escape and be equipped with fire control facilities on the basis of not destroying the original appearance of the village.

no unit or individual is allowed to occupy, block or close the fire escape, or damage, misappropriate or dismantle or stop the fire control facilities and equipment without authorization.

Article 19 The people's government of an autonomous county shall allocate sewage treatment facilities in Dong cultural villages and gradually improve the sewage system; Promote the classified collection of garbage and implement unified and centralized garbage treatment.

the cultural administrative department of the twentieth autonomous county shall regularly conduct a general survey, identification, excavation, collection, collation and filing of the cultural heritage in the Dong cultural village, and protect it according to law.

the people's government of the autonomous county supports the representative inheritors, folk artists and folk craftsmen of intangible cultural heritage projects to carry out skill competitions and take various forms to carry out activities such as training, inheritance, research and exchange; Support the holding of Dong traditional festivals, celebrations and sacrificial activities; Respect Dong people's language and dress habits.

the people's government of the autonomous county should strengthen the protection and inheritance of costumes, silverware, buildings, utensils and other production techniques with the characteristics of traditional Dong folk culture, and support the establishment of protective production bases such as Dong brocade weaving techniques and Lusheng production techniques.

Article 21 Autonomous County People's Government encourages units and individuals to make rational use of natural resources and cultural heritage in Dong cultural villages and develop ethnic cultural industries, characteristic ecological industries and leisure tourism industries on the premise of effectively protecting Dong cultural villages.

article 22 whoever violates the provisions of these regulations and should be punished according to relevant laws and regulations shall be punished by the relevant departments of the people's government of the autonomous county according to the provisions of laws and regulations.

Article 23 If any functionary of a state organ abuses his power, neglects his duty or engages in malpractices for personal gain in the protection of ethnic cultural villages, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

other ethnic and cultural villages within the administrative area of the twenty-fourth autonomous county shall be implemented with reference to these regulations after being recognized by the people's government of the autonomous county.

Article 25 These Regulations shall be promulgated and implemented by the Standing Committee of Tongdao Dong Autonomous County People's Congress after being approved by the Standing Committee of Hunan Provincial People's Congress.
