Interim Measures of Fushun Municipality on Relatively Centralized Administrative Punishment Right in Urban Management

Chap I general provisions article 1 these measure are formulated in accordance with that administrative punishment Law of the people's republic of China and relevant laws and regulations, and in accordance with the reply of the legislative affair office of the State Council on carrying out the work of relatively centralized administrative punishment right in Fushun City, Liaoning province, in order to strengthen urban management and clarify the specific contents of the administrative punishment right in urban management. Article 2 These Measures shall apply to the urban management within the urban planning area of our city. ? Article 3 Fushun City Administration and Law Enforcement Bureau is the administrative organ directly under the municipal government, which exercises part of the power of administrative punishment in the field of urban management in our city and is responsible for the implementation of these measures. Its duties are:?

(a) centralized exercise of administrative punishment rights stipulated by laws, regulations and rules on city appearance and environmental sanitation, municipal facilities, urban greening and some urban planning, public security and transportation occupation, industry and commerce, environmental protection and management; ?

(two) to implement the laws and regulations on urban management, and draft the laws and regulations on the power of relatively centralized administrative punishment in urban management;

(three) to investigate, coordinate and manage the power of administrative punishment in the management of relatively concentrated cities in the city;

(four) to supervise and inspect the law enforcement activities of the power of administrative punishment in relatively concentrated cities in the city.

District Urban Management Comprehensive Law Enforcement Bureau is an independent administrative organ of the district government, exercising the power of administrative punishment as stipulated in these Measures. ?

The Municipal Urban Management Comprehensive Law Enforcement Bureau shall exercise business supervision and guidance to the District Urban Management Comprehensive Law Enforcement Bureau. ? Article 4 The relevant departments shall support and cooperate with the Urban Management Comprehensive Law Enforcement Bureau, which centrally exercises the power of administrative punishment, to perform its duties according to law. Chapter II City Appearance and Environmental Sanitation? Fifth in violation of the provisions of the construction of buildings and structures on both sides of urban roads, the District Urban Management Comprehensive Law Enforcement Bureau shall order it to stop the illegal act and dismantle it within a time limit. If it is not removed within the time limit, it shall be submitted to the Municipal People's Government for approval by the Municipal Urban Management Comprehensive Law Enforcement Bureau for compulsory removal. Unauthorized change, modification or failure to change or modify the external facade of the building according to the approval requirements shall be ordered by the District Comprehensive Law Enforcement Bureau to make corrections, and a fine shall be imposed on 500 yuan according to the area of the illegally changed or modified facade per square meter. ? Article 6 Any of the following acts shall be ordered by the District Urban Management Comprehensive Law Enforcement Bureau to make corrections within a time limit and be punished:

(a) set up temporary facilities and stacked items on both sides of urban roads and public places without authorization, and impose a fine on 200 yuan according to the area per square meter;

(two) street buildings and demolition sites without Dang Wei or not according to the provisions of Dang Wei, according to the length of Dang Wei should be set, each linear meter shall be fined in 20 yuan; Discharging muck, waste water and mud to the construction and demolition sites at will, and imposing a fine of more than 500 yuan 1000 yuan; Failing to dismantle temporary buildings and structures and level the site at the completion site, a fine of more than 5000 yuan 10000 yuan shall be imposed;

(3) If it occupies the market and fails to operate according to the approved location, scope and time, it shall impose a fine of 1 000 yuan on the start-up unit; If the business facilities are untidy, the start-up unit shall be fined more than 500 yuan 1000 yuan; ? (four) do not maintain and update all kinds of facilities set on the ground of the city, which will affect the city appearance, and impose a fine of more than 200 yuan and less than 500 yuan; ?

(five) to set up large-scale outdoor advertisements without authorization, and impose a fine on 200 yuan according to the area of advertising plaque per square meter; If the advertising plaque is damaged and not renovated in time, a fine of 50 yuan per square meter shall be imposed; ?

(six) failing to set up landscape lighting facilities according to the provisions of urban landscape lighting, and failing to set them within the specified time, and imposing a fine of +0000 in 500 yuan, and setting them within a time limit;

(seven) landscape lighting fails to turn on the lights according to the prescribed time, and shall be fined in 500 yuan, and shall be corrected within a prescribed time limit; ?

(eight) the landscape lighting facilities are damaged and not repaired within the specified time, and shall be fined in 500 yuan and repaired within a time limit; ?

(9) If lighting facilities are not installed in lighting advertisements, a fine of 1 000 yuan shall be imposed; If the damaged or lost lights are not repaired within the specified time, they shall be fined in 500 yuan, rectified within a time limit or forcibly removed; ?

(ten) failing to install landscape lighting facilities according to the specified location, form and design requirements, and imposing a fine on 500 yuan, and making corrections within a time limit; ?

(eleven) unauthorized change, relocation, demolition of landscape lighting facilities, punishable by a fine in 500 yuan, and the deadline for recovery;

(twelve) the destruction of urban landscape lighting facilities, affecting the normal operation of landscape lighting facilities, in addition to ordering it to compensate twice the original value, and impose a fine on 500 yuan; If the circumstances are serious enough to violate the criminal law, they shall be handed over to the judicial department for criminal responsibility. Seventh any of the following acts shall be ordered by the District Urban Management Comprehensive Law Enforcement Bureau to make corrections within a time limit and be punished:

(a) urban buildings, structures and urban sculptures are damaged, exposed and unclean, and the property owner fails to maintain, paint and clean them in time, and a fine of more than 500 yuan 1000 yuan shall be imposed; ?

(II) Stacking and hanging articles in front of buildings facing the street, windows, platforms, balconies and corridors, and hanging and drying articles on various facilities and trees shall be fined from 20 yuan to 50 yuan;

(three) the parking lot is not set with obvious boundaries and signs, and the vehicles are parked and placed indiscriminately, and the start-up unit shall be fined more than 50 yuan 100 yuan; ?

(four) approved to set up stalls in designated locations, unauthorized expansion of the area, punishable by a fine of more than 20 yuan and less than 50 yuan; ?

(five) set up open-air processing, maintenance and cleaning sites on both sides of urban roads, and impose a fine of more than 2,000 yuan from 500 yuan; Slaughter poultry in the open air, each one will be fined 10 yuan; Slaughtering livestock, each head (only) shall be fined 65438 yuan or more from 50 yuan; ?

(six) all kinds of vehicles driving on urban roads are obviously unclean, and each vehicle shall be fined in 20 yuan; ?

(seven) street commercial plaque, window, advertising column, newspaper column and other damage, impose a fine of more than 50 yuan 100 yuan; ?

(eight) outdoor advertisements, plaques, and all kinds of words used in public places are inaccurate, the content is unhealthy, and the writing is not standardized, and a fine of more than 50 yuan 100 yuan is imposed;

(nine) unauthorized installation of large-scale propaganda slogans and signs or overdue, damaged and not removed in time, punishable by a fine of more than 200 yuan 100 yuan;

(ten) graffiti in buildings, public facilities or trees, 50 yuan fine everywhere; Posting all kinds of publicity materials without authorization will be fined 10 yuan.
