Article 1: In order to implement the ban on smoking at stations and passenger trains, strengthen management, and protect the health of passengers, according to the regulations issued by the National Patriotic Health Campaign Committee, the Ministry of Health, the Ministry of Railways, the Ministry of Transport, the Ministry of Construction, and the Civil Aviation Administration of China "Regulations on the Prohibition of Smoking in Public Transport Vehicles and Waiting Rooms" (Quanai Weifa [1997] No. 1, hereinafter referred to as the "Regulations"), formulates these implementation rules. Article 2 The patriotic health campaign committees at all levels of the railways are responsible for organizing and coordinating the work of relevant departments such as passenger transport, health, vehicles, and public security within the scope of their duties to ensure the implementation of the "Regulations."

(1) The passenger transport department is responsible for the management of no-smoking places in stations and passenger trains and the publicity of no-smoking.

(2) The health department shall conduct health supervision and provide guidance and assistance on the implementation of the "Regulations" at stations and passenger trains.

(3) The rolling stock department should set up warning signs on passenger trains in accordance with the "Regulations" and set up smoking utensils in designated areas.

(4) The public security department is responsible for handling those who refuse or obstruct staff from implementing the "Regulations" in accordance with relevant laws and regulations. Article 3 Railway staff (including passenger transport, public security, vehicles, sanitation, etc.) and passengers must abide by the "Regulations" and refrain from smoking in non-smoking areas at stations and passenger trains. Article 4 Determination of non-smoking places:

(1) In the area where passengers wait and pass by, all waiting rooms, ticket offices and stations in passenger stations, except designated smoking areas, serve passengers waiting for buses. The sales department and entertainment venues attached to the area are all non-smoking places.

Smoking areas should be set up at appropriate locations in first-class or above-scale stations or with large-scale construction. The smoking areas should be well ventilated or equipped with ventilation devices to reduce the harm of smoking.

(2) For air-conditioned passenger trains with a full running time of less than 4 hours, the entire train is a no-smoking area; for passenger trains with a running time of more than 4 hours, the connection between the two carriages is for passengers Smoking places; for passenger trains that run for more than 24 hours, in addition to specifying the connection between two carriages as a smoking place for passengers, the dining car can be temporarily designated as a smoking place with the approval of the railway branch (head office) or the Railway Bureau Patriotic Association , and post or hang signs to indicate this. Article 5 "No Smoking" warning signs should be posted or hung in no-smoking places. At stations, they should be posted or hung in a position where passengers can easily see them when waiting and passing; on passenger trains, they should be posted or hung above the doors at both ends of the carriage. "No Smoking" signs can be placed on the coffee table in the private room for soft sleepers and in the middle of the carriage.

Tobacco advertisements are not allowed in places where smoking is prohibited.

In places where smoking is allowed in stations and trains, "smoking area" signs should be set up and ashtrays should be provided. Article 6 Stations and passenger trains should regularly publicize health knowledge that “smoking is harmful to health” and the requirements of the “Regulations” through broadcasts, slogans, window promotions, light advertisements and other forms of publicity. Broadcast publicity must be at fixed points and at regular times, and broadcast plans must be made well.

All station and train staff are responsible for discouraging smokers in prohibited smoking areas. Article 7 The station and train health inspections by the Patriotic Health Associations at all levels, health authorities, and health and epidemic prevention stations shall implement health inspections in places where smoking is prohibited on stations and trains. Stations and passenger trains that violate the "Regulations" and fail to perform their management responsibilities will be ordered to do so depending on the severity of the case. If they make corrections, they will be given administrative penalties such as warnings, notifications of criticism, fines, or cancellation of honorary titles. Article 8 Stations and passenger trains must have health inspectors in no-smoking places. The responsibilities of health inspectors are:

(1) Responsible for the management of no-smoking in the place, including dissuasion;

(2) Carry out hygiene publicity and health education to passengers;

(3) Punish smokers who violate the "Regulations". Article 9 Health inspectors shall abide by disciplines and laws, have a decent style and have a strong sense of responsibility. Station health inspectors should be hired (part-time) from among the station staff for 2-3 people per waiting room; passenger train health inspectors should be hired (part-time) for 3-5 people per charter group.

Health inspectors are nominated by stations and passenger sections (trains and depots) respectively, and are reviewed by the railway branch (head office) or the Railway Bureau Patriotic Association. Health inspector certificates are issued and health inspector badges are issued; when they are transferred When working at work, stations and passenger transport sections (train and depot sections) should be responsible for collecting health inspector certificates and badges.

Health inspector certificates and badges are designed and produced by the Ministry of Railways. Article 10 Health inspectors must be trained and qualified before they can take up their posts. The training work is organized by the passenger transport section (train, depot section) and stations, and the health and epidemic prevention station is responsible for business guidance, and is conducted in accordance with the "Railway Station and Car Health Inspector Training Outline"; the health education department is responsible for the training and hygiene of station and car health inspectors. Provide guidance and assistance in publicity work. Article 11 When performing inspection work, health inspectors should wear a health inspector badge on their chest and carry their health inspector certificate with them; when discouraging smoking, they should be polite and impartial; when punishing according to the "Regulations", they should be punished The person shall issue a special bill for health fines uniformly supervised by the financial department. Article 12 If a station or passenger train violates Article 4 of the "Regulations", the health supervision department may impose the following administrative penalties according to the circumstances:

(1) Any violation of Article 4 of the "Regulations" Station trains within the limit will be given a warning and given a time limit to make corrections;

(2) Anyone who violates more than three items in Article 4 of the "Regulations" or fails to make corrections after receiving a warning may be fined 500-1,000 yuan. A fine and a notice of criticism will be imposed;

(3) Anyone who violates four or more items in Article 4 of the "Regulations" will be fined and a notice of criticism will be issued, and his/her relevant honorary title will be revoked.

When the health supervision department imposes administrative penalties on stations and passenger trains, they should carefully fill in the administrative penalty decision letter and impose penalties in accordance with relevant regulations and procedures.
