Qingdao City Regulations Prohibiting Burning and Throwing of Funeral and Memorial Objects (Revised in 2020)

Article 1: In order to strengthen urban management, prevent fires and environmental pollution, promote the change of funeral customs, and promote the construction of spiritual civilization and ecological civilization, these regulations are formulated in light of the actual situation of this city. Article 2 These regulations apply to the following areas:

(1) Shinan District, Shibei District, and Licang District;

(2) Laoshan District, Huangdao District, and Chengdu District The built-up areas of Yang District, Jimo District, Jiaozhou City, Pingdu City, and Laixi City; the scope of the built-up areas shall be delineated by the people's government of the district (city) where they are located and announced to the public;

(3) This Municipality Forests and woodlands within administrative areas;

(4) Other areas delineated and announced by the district (city) people's government listed in item 2 within the jurisdiction where burning and throwing funeral and memorial items are prohibited. Article 3 The municipal and district (municipal) people's governments shall strengthen leadership over the prohibition of burning and scattering of funeral and memorial objects, and coordinate the work of prohibiting the burning and scattering of funeral and memorial objects.

Civil affairs, public security, urban management, gardening and forestry, market supervision and other departments should, in accordance with their respective responsibilities and these regulations, do a good job in prohibiting the burning and throwing of funeral and memorial items. The district (municipal) people's government may determine the supervision and management department in accordance with the law to assume the responsibilities of the urban management department, gardening and forestry departments stipulated in these regulations.

Subdistrict offices and town people’s governments shall, in accordance with these regulations and the regulations of the district (municipal) people’s government, do a good job in prohibiting the burning and scattering of funeral and memorial items within their jurisdiction.

Resident committees and villagers committees should assist relevant departments in prohibiting the burning and throwing of funeral and memorial items, and strengthen publicity, education and guidance to residents and villagers. Support the establishment of grassroots social organizations that change funeral customs and carry out activities in accordance with the law, and support the inclusion of prohibitions on burning and throwing funeral and memorial objects into residents' covenants and village regulations. Article 4: Encourage and advocate civilized and green memorial services.

Municipal and district (city) people's governments should take measures to encourage and support the construction of land-saving ecological burials such as sea burials and tree burials, as well as related memorial facilities, and actively promote the change of funeral customs.

The civil affairs department should organize and promote online memorial services, flower memorial services, tree planting in memory, community memorial services, family memorial services and other memorial methods and activities, and cultivate and guide civilized memorial etiquette.

The management units of funeral homes, cemeteries, memorial halls and other funeral venues should provide conveniences and conditions for civilized memorial services and encourage them to provide free environmentally friendly memorial items. Article 5: Municipal, district (city) people's governments and their relevant departments, street offices, and town people's governments should do a good job in publicity and education on the prohibition of burning and throwing funeral and memorial items.

News media such as radio, television, newspapers, and the Internet should carry out publicity and public opinion supervision on the prohibition of burning and throwing funeral and memorial items. Article 6 Funeral service units and their employees shall discourage the burning and throwing of funeral and memorial items when hosting funerals and memorial activities. The management units of funeral homes, cemeteries, memorial halls and other funeral venues should stop the burning and throwing of funeral and memorial items within their management scope. If dissuasion or restraint is ineffective, a report should be made to the relevant competent authorities. Article 7 It is prohibited to sell feudal superstitious funeral and memorial items. Anyone who violates the regulations will be ordered to make corrections by the market supervision department, and the feudal superstitious funeral and memorial items will be confiscated, and a fine of not less than one time but not more than three times the sales amount may be imposed.

The feudal superstitious funeral and memorial items stipulated in the preceding paragraph refer to ghost paper, ghost coins, gold and silver ingots, animals, home appliances, furniture and other physical objects imitated with paper, silk and other materials used for funeral and memorial activities. . Article 8 It is prohibited to burn or scatter funeral and memorial items in public places.

Anyone who violates the regulations will be dealt with in accordance with the following regulations:

(1) Anyone who burns or scatters funeral and memorial items in forests or woodlands will be ordered by the gardening and forestry administrative department to stop the illegal behavior and fined not less than RMB 200 but not more than RMB 1,000. A fine of not more than RMB 10,000 shall be imposed; those who burn funeral and memorial items in forests or woodlands during the forest fire prevention period shall be punished by the gardening and forestry administrative departments in accordance with relevant laws and regulations on forest fire prevention; Anyone who burns or scatters funeral memorial items at a funeral venue shall be ordered by the civil affairs department to stop the illegal act and be fined not less than RMB 200 but not more than one thousand yuan; According to the provisions of centralized administrative penalty power, the urban management department shall order the cessation of illegal activities and impose a fine of not less than 200 yuan but not more than 1,000 yuan; if the circumstances are serious, a fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed;

( 4) For those who burn funeral and memorial items in urban green spaces, in accordance with the provisions of relatively centralized administrative penalty powers, the urban management department shall impose a fine of not less than 1,000 yuan but not more than 5,000 yuan; if the circumstances are serious, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed;

(5) Anyone who throws funeral and memorial items out of a moving motor vehicle shall be ordered by the traffic management department of the public security organ to stop the illegal act and be punished in accordance with road traffic safety laws and regulations;

(6) Anyone who burns or scatters funeral and memorial items on urban roads, squares, residential areas and other public places will be ordered by the city management department to stop the illegal behavior and fined not less than RMB 200 but not more than RMB 1,000. Article 9: Anyone who violates public security management regulations by burning or scattering funeral and memorial objects shall be subject to public security management penalties by the public security organs in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
