Article 2 These regulations apply to the following areas:

Article 5: Municipal, district (city) people's governments and their relevant departments, street offices, and town people's governments should do a good job in publicity and education on the prohibition of burning and throwing funeral and memorial items.

News media such as radio, television, newspapers, and the Internet should carry out publicity and public opinion supervision on the prohibition of burning and throwing funeral and memorial items. Article 6 Funeral service units and their employees shall discourage the burning and throwing of funeral and memorial items when hosting funerals and memorial activities. The management units of funeral homes, cemeteries, memorial halls and other funeral venues should stop the burning and throwing of funeral and memorial items within their management scope. Article 8 It is prohibited to burn or scatter funeral and memorial items in public places.

Anyone who violates the regulations will be dealt with in accordance with the following regulations:

(1) Anyone who burns or scatters funeral and memorial items in forests or woodlands will be ordered by the gardening and forestry administrative department to stop the illegal behavior and fined not less than RMB 200 but not more than RMB 1,000. A fine of not more than RMB 10,000 shall be imposed; those who burn funeral and memorial items in forests or woodlands during the forest fire prevention period shall be punished by the gardening and forestry administrative departments in accordance with relevant laws and regulations on forest fire prevention; Anyone who burns or scatters funeral memorial items at a funeral venue shall be ordered by the civil affairs department to stop the illegal act and be fined not less than RMB 200 but not more than one thousand yuan; According to the provisions of centralized administrative penalty power, the urban management department shall order the cessation of illegal activities and impose a fine of not less than 200 yuan but not more than 1,000 yuan; if the circumstances are serious, a fine of not less than 2,000 yuan but not more than 10,000 yuan shall be imposed;

( 4) For those who burn funeral and memorial items in urban green spaces, in accordance with the provisions of relatively centralized administrative penalty powers, the urban management department shall impose a fine of not less than 1,000 yuan but not more than 5,000 yuan; if the circumstances are serious, a fine of not less than 10,000 yuan but not more than 50,000 yuan shall be imposed;

(5) Anyone who throws funeral and memorial items out of a moving motor vehicle shall be ordered by the traffic management department of the public security organ to stop the illegal act and be punished in accordance with road traffic safety laws and regulations;

(6) Anyone who burns or scatters funeral and memorial items on urban roads, squares, residential areas and other public places will be ordered by the city management department to stop the illegal behavior and fined not less than RMB 200 but not more than RMB 1,000. Article 9: Anyone who violates public security management regulations by burning or scattering funeral and memorial objects shall be subject to public security management penalties by the public security organs in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
