Regulations of Huaian Municipality on the Administration of Underground Pipelines

Chapter I General Provisions Article 1 In order to standardize the management of urban and rural underground pipelines and make rational use of underground space resources, these Regulations are formulated in accordance with the Urban and Rural Planning Law of People's Republic of China (PRC), the Construction Law of People's Republic of China (PRC) and the Regulations on Urban and Rural Planning of Jiangsu Province, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the planning, construction, maintenance and information management activities of underground pipelines in the planning areas of cities, towns and townships in this Municipality.

The underground pipelines mentioned in these Regulations refer to underground pipelines, cables and ancillary facilities such as water supply, drainage, gas, heat, electric power, communication, radio and television, traffic signals, public video surveillance, brine transportation, oil transportation, etc., including common trenches for centralized laying of underground pipelines. Article 3 The management of underground pipelines shall follow the principles of planning and guidance, comprehensive coordination, overall planning and construction, information sharing and safe operation. Article 4 The people's governments of cities and counties (districts) shall be responsible for the comprehensive management of underground pipelines and establish a comprehensive coordination mechanism for underground pipelines.

The competent department of urban and rural planning is the comprehensive coordination department of underground pipelines, responsible for the planning management, information management and comprehensive coordination of underground pipelines.

The administrative departments in charge of development and reform, economy and informatization, public security, land and resources, environmental protection, housing and urban and rural construction, urban management, transportation, water conservancy, quality and technical supervision, production safety supervision and civil air defense shall be responsible for the relevant management of underground pipelines according to their respective functions and duties.

All kinds of park management committees should do a good job in the management of underground pipelines in the park.

The township (town) people's government shall perform the duties of underground pipeline management within its administrative area according to law. Fifth city and county (District) people's governments shall strengthen the supervision and management of underground pipeline safety, and organize relevant departments and units to formulate underground pipeline safety management systems and emergency plans. Article 6 Encourage and support scientific and technological research and innovation of underground pipelines, popularize and apply new technologies, new materials and new processes, and improve the planning, construction and management level of underground pipelines. Seventh key areas such as new urban areas, old city reconstruction areas, new roads and pipeline-intensive areas should be planned simultaneously and underground common ditches should be built according to the actual planning. Article 8 Any unit or individual has the right to dissuade and report acts of embezzlement, damage and theft of underground pipelines.

The administrative department in charge of underground pipelines shall establish a reporting system, and investigate and handle reports in a timely manner. Chapter II Planning Management Article 9 The administrative departments in charge of underground pipelines such as development and reform, economy and informatization, housing and urban and rural construction, culture, radio, film and television, press and publication. Should be in conjunction with the underground pipeline construction unit (that is, the underground pipeline owner, the same below), according to the overall planning of cities, towns and townships, organize the preparation of special plans for underground pipelines in cities, towns and townships.

The special planning of underground pipelines shall include the line, capacity, pipe diameter, number of holes, voltage (pressure) grade, etc.

The special planning of underground pipelines shall be reviewed by the competent department of urban and rural planning and reported to the municipal and county people's governments for approval. Tenth urban and rural planning departments and township (town) people's governments shall, jointly with the administrative departments of underground pipelines and underground pipeline construction units, organize the preparation of comprehensive underground pipeline planning.

The comprehensive planning of underground pipelines should be connected with the special planning of underground space, road traffic, waterway and port, rail transit and civil air defense projects.

The comprehensive planning of underground pipelines shall include the plane position, vertical position, safety measures, scope of protection, construction area, layout of common ditches, and the scope of land for ancillary facilities.

After the comprehensive planning of underground pipelines is approved by the municipal and county people's governments, the competent department of urban and rural planning and the township (town) people's government shall incorporate the planning results into the detailed planning of cities, towns and townships. Eleventh the construction of underground pipeline projects, underground pipeline construction units shall apply to the competent department of urban and rural planning for planning permission procedures.

Underground pipelines constructed simultaneously with road projects, underground pipeline construction units can apply for planning permission procedures together with road projects.

For underground pipeline projects supporting the construction of residential areas, squares and other projects, the project construction unit shall prepare a comprehensive design scheme for underground pipelines and report it to the competent department of urban and rural planning for approval.

Underground pipeline projects involving roads, railways, rail transit facilities, waterways and ports, rivers, water conservancy facilities, green spaces, cultural relics protection areas, civil air defense and military facilities, as well as safety in production and environmental protection, underground pipeline construction units shall solicit the opinions of relevant administrative departments and units; Where administrative licensing matters are involved, relevant licensing procedures shall be obtained according to law. Twelfth in the planning permission procedures, the competent department of urban and rural planning shall provide the construction unit with the existing underground pipeline surveying and mapping data of the construction site and its adjacent areas. Thirteenth before the start of the underground pipeline project, the underground pipeline construction unit shall entrust the unit that has obtained the corresponding surveying and mapping qualification certificate according to law to pay off the line, and apply to the competent department of urban and rural planning for line inspection, and the construction can only start after the line inspection is qualified.

The underground pipeline construction unit shall entrust the unit that has obtained the corresponding surveying and mapping qualification certificate according to law to track and measure the underground pipeline construction. Fourteenth after the completion of underground pipeline project, the underground pipeline construction unit shall apply to the competent department of urban and rural planning for planning verification. Without verification or verification does not meet the requirements, the completion acceptance shall not be organized.
