Nanchang City Outdoor Advertising Settings Management Measures (2012 revision)
Article 1. In order to strengthen the management of outdoor advertising installations and beautify the city environment, in accordance with the Advertising Law of the People's Republic of China, Jiangxi Province Outdoor Advertising Management Regulations, Nanchang Urban City Appearance and Environment These measures are formulated in accordance with the provisions of laws and regulations such as the Health Management Regulations and in combination with the actual situation of this city. Article 2 These Measures shall apply to the installation and supervision of outdoor advertisements within municipal urban planning areas.
The registration, content review and supervision and management of outdoor advertising shall be carried out in accordance with the Advertising Law of the People's Republic of China and relevant laws and regulations. Article 3 The term “outdoor advertising” as mentioned in these Measures refers to the following outdoor commercial advertisements in which commodity manufacturers or service providers bear the expense and directly or indirectly introduce the goods they promote or the services they provide through certain media and forms:
(1) Advertisements published using outdoor advertising facilities;
(2) Advertisements published outdoors using colorful flags and banners;
(3) Advertisements published using walls ;
(4) Advertisements published using vehicles, boats and other means of transportation;
(5) Advertisements published using airships, balloons and other aerial vehicles;
(6) Other advertisements published outdoors.
The term "outdoor advertising facilities" as mentioned in these Measures refers to material carriers such as light boxes, neon lights, electronic display screens (signs), electronic reproduction devices, showcases, advertising racks, etc. specially set up outdoors for the purpose of publishing advertisements. Article 4 The municipal urban management department shall be responsible for the city appearance supervision, management and comprehensive coordination of outdoor advertising installations in the city; the district urban management department shall be responsible for the city appearance supervision and management of outdoor advertising installations within its jurisdiction in accordance with its management authority.
The competent departments of urban and rural planning are responsible for the planning supervision and management of outdoor advertising settings.
Relevant departments such as industry and commerce shall be responsible for the supervision and management of outdoor advertising settings in accordance with their respective responsibilities. Article 5 The installation of outdoor advertisements shall follow the principles of unified planning, reasonable layout, beautiful appearance, solidity and safety. Article 6 The municipal urban management department shall, in conjunction with the municipal urban and rural planning, industry and commerce, landscaping, housing management, environmental protection, public security, transportation and other relevant departments, formulate a plan for the installation of outdoor advertising facilities in this city, and submit it to the Municipal People's Government for approval before promulgating and implementing it.
The planning for the establishment of outdoor advertising facilities shall include the conditions, location, type, scale, specifications, validity period and other main contents of the establishment of outdoor advertising facilities.
The municipal urban management department shall prepare technical specifications for the installation of outdoor advertising facilities based on the outdoor advertising facility installation plan and urban appearance standards.
Any unit or individual should comply with the planning and technical specifications for the installation of outdoor advertising facilities. Article 7 The municipal urban management department shall listen to opinions extensively when formulating plans and technical specifications for the installation of outdoor advertising facilities. Article 8 The installation of outdoor advertisements shall comply with the planning and technical specifications for the installation of outdoor advertising facilities.
Outdoor advertisements are not allowed under any of the following circumstances:
(1) Using traffic safety facilities, traffic signs, or residential buildings;
( 2) Affecting the use of municipal public facilities, traffic safety facilities, and traffic signs;
(3) Impeding production or life, and damaging the appearance of the city;
(4) Construction control zones of state agencies, cultural relics protection units and scenic spots;
(5) Areas where the Municipal People’s Government prohibits outdoor advertising. Article 9 The right to use the site or facility where outdoor advertising facilities are set up can be obtained through public bidding, auction, agreement, etc. Among them, the right to use public venues and public facilities with outdoor advertising facilities shall be obtained through bidding, auction or other open competition methods. The scope of public venues and public facilities and the specific methods for bidding and auctioning shall be formulated separately by the Municipal People's Government. Article 10 If the establishment of outdoor advertising facilities requires planning and other relevant approval procedures in accordance with the law, it shall be handled in accordance with the law.
Anyone who obtains the right to use public venues and public facilities in accordance with Article 9 of these Measures shall be deemed to have gone through planning and other relevant approval procedures.
Article 11 The use period of outdoor advertising facilities installed on public venues or public facilities shall not exceed 5 years. If the establishment period needs to be extended upon expiration, the installer shall go through the extension procedures with the original approval authority 30 days before the expiration of the establishment period.
Temporary outdoor advertising facilities set up for holding large-scale cultural, sports, public welfare activities or organizing various trade fairs, exhibitions and other activities shall be dismantled by the installer within two days after the event. Article 12 To set up large-scale outdoor advertisements, the installer shall apply to the municipal urban management department and submit the following materials:
(1) Application form;
(2) Outdoor Documents proving the right to use the advertising location;
(3) Outdoor advertising location diagrams and renderings;
(4) Structural design drawings issued by a professional design agency with corresponding qualifications, Construction instructions and construction structural drawings;
(5) Other materials specified by laws, regulations and rules.
The municipal urban management department shall make a written decision on whether to grant permission or not within 3 working days from the date of acceptance. If permission is granted, an outdoor advertising installation license shall be issued; if permission is not granted, an outdoor advertising installation license shall be issued. Give reasons in writing. Among them, if large-scale outdoor advertisements are set up in important places or on both sides of major roads, the municipal urban management department shall make a decision after obtaining the consent of the Municipal People's Government. No unit or individual may forge, alter, rent, lend, resell or otherwise illegally transfer outdoor advertising installation licenses.
The standards for large-scale outdoor advertising are determined by the municipal urban management department and announced to the public.
