Chapter II Planning of Regulations on the Administration of Hangzhou West Lake Scenic Area

Scenic spot planning is the basis for the protection, construction, management and utilization of scenic spots.

scenic spot planning is divided into overall planning, detailed planning and regulatory detailed planning. The following principles should be followed in the planning of scenic spots:

(1) Compliance with relevant laws and regulations;

(2) conforming to the overall urban planning of Hangzhou, coordinating with the overall land use planning, and connecting with the national economic and social development plan of Hangzhou;

(3) maintain the original features of the natural landscape and the historical features of the humanistic landscape in the scenic spot, protect the natural ecological environment, improve the environmental quality, and coordinate various constructions with the scenic spot environment to prevent the urbanization, artificialization and commercialization of the scenic spot;

(4) coordinate and handle the relationship between protection and construction, short-term and long-term, and local and overall. Twelfth overall planning of scenic spots organized by the Municipal People's government, the Municipal People's Congress or its Standing Committee after deliberation and approval, according to the prescribed procedures reported to the State Council for approval. Detailed planning of scenic spots and controlled detailed planning of scenic spots shall be compiled by the scenic spot management committee in conjunction with the planning and other relevant departments according to the overall planning of scenic spots, approved by the Municipal People's Government and deliberated and adopted by the Standing Committee of the Municipal People's Congress, and submitted to the provincial construction administrative department for approval in accordance with regulations, and copied to the relevant administrative departments of the province. The planning of scenic spots shall be strictly implemented after approval, and no unit or individual may change it without authorization.

if it is really necessary to adjust or change the contents of scenic spot planning, it shall be re-submitted for approval according to the original examination and approval procedures. Rivers, lakes, springs, ponds, streams, streams, ponds and other water bodies, natural scenery such as bamboo, wood, flowers, wild animals, forest vegetation, rocky soil, karst caves, landforms and other cultural scenery and their environment in the scenic area belong to scenic resources and should be strictly protected.

the scenic area management Committee shall set up necessary institutions, equip with necessary personnel and equipment, establish and improve various systems, formulate protective measures and implement the responsibility system for protection. It is forbidden to set up various resorts, development zones and similar special areas in scenic spots.

it is forbidden to build or expand factories, hotels, guest houses, villas, resorts, training centers, large-scale cultural and entertainment facilities, hospitals, nursing homes, etc. in the scenic area. Those that have already been built shall not be expanded in scale, and conditions shall be actively created to move out.

it is forbidden to build engineering projects and facilities that endanger safety, destroy landscape and hinder sightseeing in scenic spots and their peripheral protection zones. Existing projects and facilities that do not meet the requirements shall be dismantled according to law.

It is forbidden to set up warehouses and yards for storing inflammable, explosive, toxic and harmful articles in scenic spots. The ancient and famous trees in the scenic area should be strictly protected, and it is forbidden to cut down, transplant or damage them, and it is forbidden to trim them without authorization.

No unit or individual is allowed to cut down, transplant or trim trees in the scenic area without authorization. If it is really necessary to cut down, transplant or prune trees due to necessary forest transformation, tending and renewal and scenic spot construction, it shall be approved by the scenic area management Committee. Strictly control the environmental pollution in the scenic spots, and the air quality and water environment quality in the scenic spots should gradually reach the national functional zone standards.

if the pollutant discharge of the existing pollution sources in the scenic area exceeds the prescribed discharge standards, it shall be treated within a time limit, and if the treatment is not completed within the time limit, it shall be ordered to close down or relocate according to law. Strictly protect the cultural relics in the scenic area.

buildings (structures) and relics (sites) that are not included in the cultural relics protection units (sites) in the scenic area but have certain historical, scientific and artistic values shall be listed by the scenic area management committee and strictly protected, and shall not be damaged or removed without authorization. The following acts are prohibited in the scenic area:

(1) occupying, enclosing, burying, intercepting and covering water bodies and water surfaces without authorization;

(2) cutting mountains, quarrying, dredging sand, taking soil, mining and dumping waste soil;

(3) climbing, scratching, nailing, shaking bamboo and wood, damaging green lawns, and picking flowers, bamboo shoots and fruits without authorization;

(4) Hunting wild animals or fishing aquatic animals and plants without authorization;

(5) scribbling, scribbling and posting on the scenery;

(6) damaging public facilities such as sightseeing and services and other facilities;

(7) burning mountains, having picnics and other wild fires in the forest, discarding kindling, setting off fireworks, piling up inflammable and explosive dangerous goods, etc.;

(8) Smoking or throwing cigarette butts anywhere in the forest fire-forbidden area or during the forest fire prevention period, which is beyond the prescribed range?

(9) Dumping garbage, waste residue, waste water and other pollutants at will, burning garbage, litter and other wastes or accumulating burnt sludge;

(1) Raising poultry and livestock;

(11) setting up tents, tables and chairs beyond the prescribed area;

(12) other acts that destroy scenic resources, hinder landscapes, hinder sightseeing, and violate public order. All construction projects in the scenic area should be related to scenic spots, and the construction should be carried out in strict accordance with the requirements of scenic area planning and approval.

existing buildings (structures) and other facilities that do not conform to the planning of scenic spots should be moved out gradually. The site selection, layout, height, volume, shape, style and color of the construction projects in the scenic area should be in harmony with the surrounding landscape and environment.

the construction in the protection zone outside the scenic spot should be consistent with the requirements of the scenic spot landscape, and the natural scenery of the scenic spot should not be damaged. The existing projects and facilities that damage the landscape shall be rectified or dismantled by the local district people's government after soliciting the opinions of the scenic area management Committee. In line with the requirements of scenic spot planning, major construction projects with an area of over 3, square meters or a building area, the site selection shall be put forward by the scenic spot management committee in conjunction with the planning administrative department, approved by the Municipal People's Government, publicized to the public, deliberated and adopted by the Standing Committee of the Municipal People's Congress, and submitted for approval according to the prescribed procedures before going through the relevant procedures for project establishment.

the site selection of other construction projects that meet the requirements of scenic spot planning shall be put forward by the scenic spot management committee in conjunction with the planning administrative department, approved by the Municipal People's Government, publicized to the public, and submitted for approval according to the prescribed procedures before going through the relevant procedures such as project establishment. It is forbidden to build, rebuild or expand houses in scenic spots. The existing houses of all units in the scenic area should be gradually relocated.

dangerous houses in the scenic area and houses on collective land that need to be demolished for improving the environment and infrastructure construction in the scenic area shall be uniformly purchased by the scenic area management Committee. The specific measures for the placement of the owner shall be formulated separately by the Municipal People's Government. Those who engage in the following construction or installation of facilities in the scenic area shall report to the scenic area management committee for approval before going through the relevant formalities:

(1) Setting up sculptures or shaping statues;

(2) restore or add cliff stone carvings and tablets;

(3) building fences, guardrails, bridges, iron towers and other structures and temporary buildings such as sheds;

(4) set up outdoor facilities such as advertisements, publicity and indication signs. Illegal buildings (structures) in the scenic area shall be demolished.

the buildings (structures) temporarily reserved in the scenic area shall not be expanded, rebuilt or renovated. When the construction of scenic spots needs to be dismantled, it should be dismantled unconditionally.
