Provisions of Lanzhou Municipality on the Safety Management of Fireworks and Firecrackers

Article 1 In order to strengthen the safety management of fireworks and firecrackers, ensure public safety and personal and property safety, and reduce urban environmental pollution, these Provisions are formulated in accordance with the provisions of the State Council's "Regulations on the Safety Management of Fireworks and Firecrackers" and other laws and regulations, combined with the actual situation of this Municipality. ? Article 2 These Provisions shall apply to the operation and discharge of fireworks and firecrackers within the administrative area of this Municipality. ?

Fireworks and firecrackers are restricted in Chengguan District, Qilihe District, Xigu District and Anning District of this city. ?

The restricted release areas in Honggu District, Yuzhong County, Yongdeng County and Gaolan County shall be determined by the district (county) people's government. ?

The term "fireworks" as mentioned in these Provisions refers to fireworks products and civil black powder, pyrotechnics, fuses and other items used for the production of fireworks. ? Article 3 Fireworks and firecrackers are allowed to be set off from the 23rd day of the twelfth lunar month to the 16th day of the first lunar month in this Municipality, and are prohibited at other times. ?

A permit system shall be implemented for holding fireworks parties and large-scale fireworks display activities. ? Article 4 The Municipal (District) People's Government shall be responsible for organizing the implementation of these Provisions. The Municipal People's Government shall strengthen the leadership over the safety management of fireworks and firecrackers, establish a coordination mechanism for the safety supervision and management of fireworks and firecrackers led by the public security department, with the participation of safety production supervision, industrial and commercial administration, urban management and law enforcement, environmental protection, quality and technical supervision, supply and marketing and other departments, and implement safety management measures. ?

The public security department is responsible for the safety management of fireworks and firecrackers; The safety production supervision and management department is responsible for the supervision and management of fireworks and firecrackers. ?

Industrial and commercial administration, quality and technical supervision, environmental protection, urban management and law enforcement departments shall, in accordance with their respective responsibilities, do a good job in the safety management of fireworks and firecrackers.

Supply and marketing cooperatives should strengthen the management of fireworks and firecrackers business activities of enterprises in this system. ? Article 5 People's governments, sub-district offices, communities, residents' committees, organs, organizations, armed forces, enterprises, institutions and other organizations in restricted areas are responsible for the safety management of fireworks and firecrackers in their own areas (units), extensively and thoroughly carry out publicity and education activities on the lawful, civilized and safe discharge of fireworks and firecrackers, and timely report the hidden dangers of fireworks and firecrackers to relevant departments. ?

Primary and secondary schools should educate students about civilized and safe fireworks and firecrackers. ?

Radio, television, newspapers and other news media should do a good job in the public welfare publicity and education of fireworks safety management. ?

The guardian has the responsibility to manage and educate the ward to abide by these regulations. ? Article 6 Any unit or individual has the right to stop the illegal production, storage, transportation, sale and discharge of fireworks and firecrackers, and may report to the public security department, the safety production supervision and management department and other relevant departments. ?

After receiving the report, the public security department, the supervision and administration of production safety and other relevant departments shall promptly investigate and deal with it. ? Seventh fireworks retail outlets should follow the principle of strict control and security. ?

The overall layout planning of fireworks retail outlets within the urban area of this Municipality shall be compiled by the municipal public security department in conjunction with the municipal safety production supervision and management department and the municipal supply and marketing cooperative. ?

The overall layout planning of fireworks retail outlets in Honggu District, Yuzhong County, Yongdeng County and Gaolan County shall be compiled by the district (county) public security department in conjunction with the safety production supervision and management departments at the same level and the supply and marketing cooperatives. ? Eighth engaged in fireworks wholesale and retail licensing system. ?

Fireworks and firecrackers wholesale enterprises shall purchase fireworks and firecrackers from production enterprises that have obtained safety production licenses for fireworks and firecrackers; Fireworks and firecrackers retail operators shall purchase fireworks and firecrackers from wholesale enterprises that have obtained fireworks and firecrackers business (wholesale) licenses. ? Article 9 Fireworks and firecrackers are strictly prohibited in the following places and areas of this Municipality:

(a) cultural relics protection units; ?

(2) Transportation hubs such as stations, docks and airports and railway line safety protection zones; ?

(3) No-fire areas such as gas stations, liquefied gas supply stations, oil depots, warehouses, oil (gas) pipelines or other places where inflammable and explosive dangerous goods are produced, managed and stored; ?

(4) Within the safety protection zone of power transmission and transformation facilities; ?

(5) Libraries, archives, hospitals, kindergartens, primary and secondary schools and nursing homes;

(six) parks, woodlands, green spaces, nurseries and other key fire areas; ?

(seven) in the green area of the North and South Mountains; ?

(eight) overpasses, overpasses, tunnels, underground pedestrian passages; ?

(nine) other areas where fireworks and firecrackers are prohibited as prescribed by the Municipal People's Government. ? Tenth in the restricted discharge area, it is forbidden to sell and discharge the following fireworks:

(1) Products that can spontaneously explode due to impact, extrusion and friction, such as gun pulling, gun throwing, gun smashing, gun wiping, starter paper (lighter paper), high-altitude fireworks, etc.; ?

(2) Dangerous goods such as voles with irregular flight paths, such as the second ring, the third ring, the moon; ?

(3) Inferior products with excessive chlorate content, great power, great danger and unqualified product quality. ?

(four) illegal production and operation of fireworks; ?

(five) other dangerous varieties identified by the safety production supervision, quality and technical supervision and management departments. ?
