Chapter 1 General Provisions Article 1 In order to strengthen the supervision and management of production safety, prevent and reduce production safety accidents, ensure the safety of people's lives and property, and promote economic development and social stability, according to the "People's Congress of the People's Republic of China" The National Work Safety Law and other relevant laws and regulations are formulated in conjunction with the actual conditions of this province. Article 2 These regulations shall apply to the production safety and supervision and management activities of production safety of units engaged in production and business activities within the administrative region of this province.

If relevant laws and administrative regulations have other provisions on fire safety, road traffic safety, railway traffic safety, water traffic safety, civil aviation safety, etc., those provisions shall prevail. Article 3: Safety production management adheres to the policy of “safety first, prevention first, comprehensive management”. Establish and improve the working mechanism of "government leadership, department supervision, corporate responsibility, mass participation, and social support". Article 4 The production and business unit is the main body responsible for safety production, and its main person in charge is the first person responsible for safety production in the unit and is fully responsible for safety production work; safety production management personnel shall bear corresponding responsibilities for safety production work within the scope of their duties. responsibility.

Employers shall abide by laws, regulations and operating procedures on production safety, and have the right to obtain production safety guarantees in accordance with the law. Article 5 People's governments at or above the county level shall strengthen leadership over production safety, incorporate production safety into national economic and social development plans, and incorporate production safety supervision and management funds into the fiscal budget at the same level.

The principal person in charge of the people's government at or above the county level is the first person responsible for production safety in the administrative region and has overall leadership responsibility for production safety; the person in charge of production safety has the responsibility for leadership. . Article 6 The production safety supervision and management departments of the people's governments at or above the county level shall implement comprehensive supervision and management of production safety work.

The public security, transportation, construction, coal, electric power, agriculture, quality supervision, tourism and other departments of the people's governments at or above the county level that are responsible for the supervision and management of production safety (hereinafter referred to as the relevant departments) shall, in accordance with relevant laws and regulations According to the provisions of the regulations, they shall supervise and manage relevant safety production work within their respective scope of responsibilities. Article 7 Trade unions shall strengthen democratic management and democratic supervision of production safety in accordance with the law, urge production and business units to implement production safety measures, make suggestions for ensuring production safety, participate in investigations of production safety accidents, supervise compensation for accident casualties, and safeguard the rights and interests of employees. Legitimate interests. Article 8 People's governments at all levels and their relevant departments and production and operation units shall organize and carry out publicity and education on production safety to improve the awareness of production safety among citizens and employees.

The news media should strengthen publicity and education on production safety and conduct public opinion supervision of violations of production safety laws and regulations. Article 9 The people's governments at or above the county level and their relevant departments shall commend and reward units and individuals who have made outstanding achievements in production safety and reported meritorious acts on production safety. Chapter 2 Production Safety Guarantees for Production and Business Units Article 10 Production and business units must meet the following safety production conditions before they can engage in production and business activities: (1) Safety production conditions stipulated in relevant laws and regulations, And obtain relevant certificates and licenses in accordance with the law;

(2) The production and business premises, equipment, and facilities comply with relevant national standards or industry standards;

(3) Establish and improve the safety production responsibility system and formulate safety Production rules and regulations and relevant operating procedures;

(4) The capital investment necessary to ensure safe production;

(5) Establishing a production safety management agency and staffing safety production management personnel in accordance with the law;

(6) Provide employees with labor tools, labor protection supplies and self-rescue equipment that meet safety technical standards, and ensure that the working environment meets safety and health standards;

(7) Main person in charge and safety production management personnel have production safety knowledge and management capabilities that are suitable for production and business activities;

(8) Employees are qualified through safety production education and training, and special operations personnel have received specialized safety operation training. Obtain special operation qualification certificate.

Article 11 The safety facilities of new, renovated, and expanded engineering projects of production and business entities shall be designed, constructed, and put into production and use at the same time as the main project.

Investment in safety facilities should be included in the construction project budget estimate. Article 12 Mining and construction units, and units that produce, operate, transport, and store dangerous goods shall take the following emergency measures:

(1) Formulate an emergency rescue plan;

(2) Establish a full-time or part-time emergency rescue team;

(3) Equip emergency rescue equipment and items;

(4) Reserve emergency rescue materials;

(5) Carry out emergency rescue drills.

Production and business units can entrust professional emergency rescue agencies to provide services. Article 13 Mining and construction units, units that produce, operate, and store dangerous goods, and road and water passenger transport operating units shall set up special production safety management agencies and be equipped with corresponding full-time safety production management personnel.

Other production and business units other than those specified in the preceding paragraph, with more than 300 employees, shall set up a production safety management agency and be equipped with full-time production safety management personnel at a ratio of 3‰ of employees, but the minimum shall not be less If the number of employees is less than 300, it shall be equipped with full-time or part-time safety production management personnel, or entrust personnel with relevant professional and technical qualifications prescribed by the state to provide safety production management services. If a production and business operation unit has subordinate units, its production safety management institutions and personnel shall be independently set up and staffed.
