Regulations of Shangluo Municipality on the Administration of Fireworks and Firecrackers

Article 1 In order to strengthen the management of fireworks and firecrackers, improve the environmental quality, and ensure the safety of the public and personal and property, these Regulations are formulated in accordance with the Regulations of the State Council Municipality on the Safety Management of Fireworks and Firecrackers and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the discharge of fireworks and firecrackers and their management activities within the administrative area of this Municipality. Article 3 Fireworks and firecrackers as mentioned in these Regulations refer to fireworks and firecrackers products and civil black powder, pyrotechnics, fuses and other articles used for the production of fireworks and firecrackers. Article 4 The Municipal People's Government shall be responsible for organizing the implementation of these Regulations, establishing a coordination mechanism for the management of fireworks and firecrackers, and making overall arrangements for the management of fireworks and firecrackers.

County (District) people's government is responsible for the management of fireworks and firecrackers in this area, and urges relevant departments to perform their duties of fireworks and firecrackers management according to law.

Town People's Government and sub-district offices shall incorporate the management of fireworks and firecrackers into grassroots social governance, and strengthen organization, coordination, guidance and supervision.

Village (neighborhood) committees shall cooperate with the management of fireworks and firecrackers, publicize, educate and guide the villagers to change their customs, and set off fireworks and firecrackers in accordance with the law, civilization and safety. Fifth public security organs are the administrative departments in charge of fireworks management, responsible for the safety management of fireworks and firecrackers, and investigate and deal with illegal fireworks and firecrackers according to law.

The urban management department shall investigate and deal with the acts of peddling fireworks stalls and setting off fireworks and firecrackers, which affect environmental sanitation and destroy urban greening and municipal facilities.

The housing and urban-rural construction departments shall urge the construction, construction and other units to abide by the regulations on the management of fireworks and firecrackers, urge the property service enterprises to do a good job in the management of fireworks and firecrackers in the service area, and discourage and report the acts of setting off fireworks and firecrackers in violation of the regulations.

Civil affairs departments should guide marriage registration, funeral homes, cemeteries and other units to carry out publicity, and guide weddings and funerals to comply with the provisions on setting off fireworks and firecrackers.

Emergency management, ecological environment, market supervision and management, education, transportation and other departments shall, within the scope of their respective duties, coordinate in the management of fireworks and firecrackers. Sixth organs, enterprises and institutions, social organizations, owners' committees, property service enterprises and other organizations shall assist in the management of fireworks and firecrackers.

The guardian of a person without or with limited capacity for civil conduct shall strengthen the education and supervision over the discharge of fireworks and firecrackers by his ward.

Radio, television, newspapers, internet and other news media should do a good job in the publicity and education of fireworks management. Article 7 To the west of the G40 high-speed lead in Shangzhou District of this Municipality, to the east of the northern section of Huannan Road (Huanxi Road), the Guishan ridge line extends eastward to the north of Shangyang Avenue, and fireworks and firecrackers are prohibited in the area south of Huancheng North Road.

Outside the areas specified in the preceding paragraph, the people's governments of cities and counties (districts) may, according to the actual situation of urban development, timely determine the areas where emissions are prohibited and announce them to the public, and report them to the Standing Committee of the people's congress at the same level for the record. Article 8 It is forbidden to set off fireworks and firecrackers in the following places outside the areas specified in Article 7 of these regulations:

(1) State organs and important military facilities;

(2) Medical institutions, schools, kindergartens and pension institutions;

(three) the scope of protection of museums, cultural relics protection units and historical buildings;

(4) Tourist attractions and drinking water sources;

(five) shopping malls, markets, squares, hotels, theaters, Internet cafes, bookstores, libraries, exhibition halls, gymnasiums, entertainment places and other crowded places;

(six) transportation hubs such as stations and airports, rail transit and railway line safety protection zones, and motor vehicle parking lots;

(seven) urban roads, elevated roads, overpasses, overpasses, tunnels, underground passages and other underground spaces;

(eight) corridors, stairs, roofs, balconies and windows of buildings and structures;

(9) Places where inflammable and explosive articles are produced, stored, sold and used, and keep a safe distance from the outside world;

(ten) power transmission and transformation, gas and fuel facilities in the safety protection zone;

(eleven) parks, forests, grasslands, wetlands, green spaces, nurseries and other natural ecological protection areas and key fire prevention areas;

(twelve) other places where fireworks are prohibited. Ninth outside the forbidden zone, it is forbidden to set off fireworks and firecrackers in the following time periods:

(a) during the college entrance examination and senior high school entrance examination;

(two) the early warning period of heavy pollution weather above yellow;

(three) the guarantee period of major activities issued by the people's government of the city or county (District). Tenth in addition to the areas and places stipulated in Article 7 and Article 8 of these regulations, the people's governments of cities and counties (districts) may determine the areas where fireworks are restricted and announce them to the public, and report them to the Standing Committee of the National People's Congress at the same level for the record. Eleventh in the restricted fireworks area, the time allowed to set off fireworks is from Lunar New Year's Eve to the fifth day of the first month and the Lantern Festival, and fireworks are not allowed at other times. Twelfth in the forbidden area, fireworks shall not be set off in the following ways:

(1) Setting off or throwing fireworks and firecrackers in buildings and structures;

(2) throwing fireworks and firecrackers at inflammable, explosive and dangerous chemicals, buildings, structures, crowds, vehicles, rivers, public green spaces, sewers and inspection wells;

(3) Obstructing road traffic safety;

(4) Setting off fireworks and firecrackers in other ways, endangering public safety and personal and property safety.

Any unit or individual shall clean up the residue on site in time after setting off fireworks and firecrackers.
