Measures for the implementation of safety production license for non-coal mining enterprises

Chapter I General Provisions Article 1 In order to strictly regulate the safety production conditions of non-coal mining enterprises and do a good job in the issuance and management of safety production licenses for non-coal mining enterprises, these implementation measures are formulated in accordance with the Regulations on Safety Production Licenses and relevant laws and administrative regulations. Article 2 Non-coal mining enterprises must obtain safety production licenses in accordance with the provisions of these Measures.

Those who have not obtained the safety production license shall not engage in production activities. Article 3 The issuance and management of safety production licenses for non-coal mining enterprises shall follow the principles of enterprise application, two-level certification and territorial supervision. Article 4 The safety production supervision and management department of the State Council shall guide and supervise the issuance and management of safety production licenses for non-coal mining enterprises nationwide, and be responsible for the issuance and management of safety production licenses for non-coal mining enterprises (group companies, head offices and listed companies) and offshore oil and gas enterprises under central management.

The safety production supervision and management departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the provincial safety production license issuing and management organs) are responsible for the issuance and management of safety production licenses for non-coal mining enterprises other than those specified in the preceding paragraph and other non-coal mining enterprises with non-coal mines and tailings ponds. Chapter II Conditions for Safe Production Article 5 To obtain a safety production license, a non-coal mining enterprise shall meet the following conditions for safe production:

(a) to establish and improve the main person in charge, the person in charge, the safety production management personnel, functional departments and post safety production responsibility system; Formulate rules and regulations such as safety inspection system, occupational hazard prevention system, safety education and training system, production safety accident management system, major hazard monitoring and major hidden dangers rectification system, equipment safety management system, safety production file management system, and safety production reward and punishment system; Formulate operation safety regulations and operation regulations for each type of work;

(two) safety investment in line with the requirements of safety production, in line with the relevant provisions of the special fund for safety technical measures;

(three) the establishment of safety management institutions, equipped with full-time safety management personnel;

(four) the main person in charge and the safety production management personnel's safety production knowledge and management ability have passed the examination;

(five) special operations personnel have passed the examination by the relevant competent departments and obtained the qualification certificate for special operations;

(six) other employees in accordance with the provisions of safety education and training, and passed the examination;

(seven) to participate in work-related injury insurance according to law and pay work-related injury insurance premiums for employees;

(eight) to conduct regular inspections of places where occupational hazards exist, and to have specific measures to prevent and control occupational hazards, and to equip employees with labor protection articles that meet national standards or industry standards according to regulations;

(nine) safety evaluation according to law;

(10) Regularly inspect the equipment with high safety conditions and high risks in the working environment, and have safety technical guarantee measures to prevent accidents;

(11) Accident-prone places, facilities and equipment such as oil and gas storage and transportation facilities, open-air slopes, personnel lifting equipment, tailings ponds, dumping sites and blasting equipment depots, with registration files, inspection and evaluation reports and monitoring measures;

(twelve) to formulate emergency rescue plans for accidents such as blowout out of control, poisoning and suffocation, slope collapse, roof caving, flooded well collapse and geological disasters induced by mining;

(thirteen) the establishment of emergency rescue organizations, equipped with necessary emergency rescue equipment and equipment; If the production scale is small and it is not necessary to establish an accident emergency rescue organization, it shall designate part-time emergency rescue personnel and sign an ambulance agreement with the adjacent accident emergency rescue organization. Article 6 Non-coal mining enterprises (group companies, head offices and listed companies) under the central management have the provisions of Item (1), Item (2), Item (3) and Item (4) of Article 5 of these Measures, and Item (8), Item (10), Item (11) and Item (4) of Article 5 of these Measures are formulated. Article 7 The production system of onshore oil and gas exploration enterprises shall meet the following conditions in addition to the provisions of Article 5 of these Measures:

(a) oil and gas wells, stations, tanks, warehouses, pipelines and other oil and gas places should set up obvious safety signs prohibiting fireworks, use explosion-proof electrical equipment, install lightning protection and anti-static devices and combustible gas concentration detection and alarm devices;

(2) If hot work is needed for expansion, reconstruction, overhaul and maintenance of oil and gas wells, stations, tanks, warehouses, pipelines and other oil and gas places, hot work can only be carried out after hot work conditions are met, hot work procedures are handled and safety measures are implemented;

(3) Oil and gas plants, stations and warehouses should be equipped with safety venting devices, venting torches and ignition devices should be safe and reliable, and oil and gas import and export main pipes should be equipped with emergency cut-off valve;

(4) Oil and gas storage tanks shall be equipped with flame arresters, mechanical breathing valves and hydraulic safety valves, with fire dikes around them, and the inlet and outlet pipelines shall be connected by soft metal;

(5) Safety valves and pressure gauges on special containers for petroleum, special wet steam generators, heating furnaces and boilers should be installed completely, with good performance and inspected regularly;

(6) Fire roads, fire water sources, fire-fighting facilities and fire-fighting equipment in oil and gas plants, stations and warehouses shall be implemented in accordance with Code for Fire Protection Design of Crude Oil and Natural Gas Engineering (GB50 183) and Code for Design of Low Expansion Foam Fire Extinguishing System (GB50 15 1);

(7) Keep a safe distance between oil and gas pipelines and important facilities in accordance with relevant regulations, and install block valves at appropriate positions;

(eight) the storage, transportation and use of explosives in petroleum geophysical exploration operations conform to the provisions of the Regulations on the Administration of Explosives for Civil Use;

(9) Well control design, installation of well control devices and formulation and implementation of well control measures shall be carried out in oil and gas drilling operations;

(10) When logging, perforating, oil and gas testing, fracturing, acidizing and workover operations are carried out on oil and gas wells with flowing ability, the well should be killed and the ground flow should be installed in strict accordance with the design requirements, the wellhead device suitable for construction requirements should be replaced, and the pressure test should be passed;

(eleven) natural gas fields containing hydrogen sulfide should be evaluated and investigated before development. When drilling, testing and producing oil and gas in oil and gas wells containing hydrogen sulfide, it is necessary to use sulfur prevention tools, downhole tools, wellhead devices and ground technology, and take other technologies and protective measures to prevent the harm of hydrogen sulfide.
