chapter I general provisions article 1 these regulations are formulated in accordance with the highway law of the people's Republic of China and other relevant laws and regulations, and in light of the actual situation of this municipality, in order to strengthen road administration, ensure sound, safe and smooth highways and adapt to economic and social development. Article 2 These Regulations shall apply to the road administration of national trunk highways, autonomous regional trunk highways, county-level highways and township-level highways (hereinafter referred to as national highways, provincial highways, county roads and township roads) within the administrative area of this Municipality. Article 3 road administration is an administrative management for the protection of highways, land for highways, highway facilities (hereinafter referred to as highway property) and building control areas on both sides of highways. Article 4 The traffic administrative departments of the people's governments of cities and counties shall be in charge of road administration within their respective administrative areas. Road administration institutions at all levels (hereinafter referred to as the road management agencies) shall exercise the responsibilities of road administration in accordance with the law, and be specifically responsible for the road management of national, provincial and county roads.

the township (town) people's government is responsible for the road administration of township roads, and accepts the professional guidance and supervision of the higher-level road administration institutions.

the road administration of commercial highways shall be exercised by the road administration agencies or agencies.

the departments of urban construction, land, public security, water conservancy, industry and commerce should cooperate to do a good job in road administration. Article 5 The main responsibilities of the municipal and county road administration institutions are:

(1) To implement the laws and regulations of road administration;

(2) to protect and manage road properties and building control areas on both sides of the road;

(3) responsible for the setting and management of traffic signs, markings and greening;

(4) Keep the road conditions in good condition, and organize to eliminate unexpected road sections;

(5) maintain the normal order of highway maintenance and construction work site;

(6) to examine and approve the construction of facilities for crossing (crossing) highways on the ground, above and underground;

(7) investigate and deal with all kinds of illegal acts such as encroachment, destruction and pollution of highway property;

(8) Other duties as stipulated by laws and regulations. Article 6 Highway properties are protected by state laws, and no unit or individual may occupy or destroy them. It is forbidden for any unit or individual to illegally set up checkpoints, collect fees, impose fines and intercept vehicles on highways. Chapter ii management of highway road products article 7 the following acts are prohibited within the scope of highways and highway land:

(1) threshing and drying grain, piling up sundries, discharging sewage, accumulating fertilizer and making blanks, stocking livestock and planting crops;

(2) dumping muck and garbage;

(4) trying to brake on the highway;

(5) occupying the road for maintenance, setting up stalls, and randomly stopping and placing vehicles;

(6) setting up shacks, toilets, gas stations and other buildings and structures;

(7) digging ditches, constructio n, intercepting water and flushing roads, or using bridges and culverts, side ditches to build dams and store water and set gates;

(8) inflammable, explosive, poisonous and gas pipelines are laid in highway bridges and tunnels;

(9) other damages to road property. Article 8 The following areas outside the outer edges of ditches on both sides of highways are building control areas:

(1) The national highway is not less than 2m;

(2) the provincial highway is not less than 15m;

(3) the county road is not less than 1m;

(4) the township road is not less than 5 meters.

If it is really necessary to extend the construction period, it shall go through the extension formalities at the original approval department 2 days before the expiration. After the completion, the highway facilities should be quickly restored, and the road administration agencies should check and accept them. Article 11 Where bridges, aqueducts, cables and wires are built, or cables, wires and pipes are laid by bridges and culverts within highways, land used for highways and building control areas, the following provisions shall apply:

(1) The construction project plan must conform to the highway development plan and technical standards;

(2) The construction project must be approved by the road administration and relevant agreements must be signed. Article 12 Where an intersection is set up on a highway or overlapped with a highway, it shall be approved by the road administration agency and designed and built in accordance with the technical standards for highway engineering. Thirteenth vehicles that really need to travel beyond roads, bridges, load limits, height limits, width limits and length limits must be approved by the road administration agencies and run according to the designated route and time. Article 14 It is forbidden to destroy or move, alter or dismantle traffic signs, signs, boundary markers, guardrails, fences, protective nets and other highway facilities without authorization.
