Regulations of Liaoning Province on Urban Gas Management (revised in 2022)

Chapter I General Provisions Article 1 In order to strengthen the management of urban gas, ensure the supply of gas, standardize the operation and use of gas, prevent and reduce gas safety accidents, safeguard the safety of citizens' lives and property, and safeguard the legitimate rights and interests of gas users and gas operators, these Regulations are formulated in accordance with the Regulations of the State Council on the Management of Urban Gas and relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the planning, construction, operation, service, use, facility protection, safety accident prevention and treatment and related management activities of city gas within the administrative area of this province.

These regulations are not applicable to the production and import of natural gas and liquefied petroleum gas, the pipeline transportation of natural gas outside city gates, the industrial production with gas as raw materials, and the production and use of biogas and straw gas. Article 3 The people's governments of provinces, cities and counties (including county-level cities and districts, the same below) shall strengthen their leadership over urban gas work, incorporate gas work into the national economic and social development plan, establish and improve the comprehensive supervision system for gas safety, promote the use of gas and improve the management level of gas.

Township people's governments and sub-district offices shall assist in the relevant work of gas management. Article 4 The competent department of housing and urban construction of the people's governments of provinces, cities and counties or the competent department of gas determined by the government (hereinafter referred to as the gas management department) shall be responsible for the gas management within their respective administrative areas.

Development and reform, education, science and technology, public security, natural resources, transportation, water conservancy, commerce, emergency management, market supervision and other relevant departments shall, according to their respective responsibilities, do a good job in gas-related work according to law. Article 5 Gas operators, gas-using enterprises and units shall incorporate gas safety into the safety production management objectives of their own enterprises and units.

Gas operators shall be responsible for the safety of gas supply and strengthen service guidance and technical support for the safe use of gas. Gas users should be responsible for the safety of gas use. Sixth gas work should follow the principles of overall planning, supporting construction, ensuring safety, ensuring supply, standardizing service, energy saving and high efficiency. Seventh to encourage and support gas science and technology research, promote the use of safe, energy-saving, efficient and environmentally friendly gas new technologies, new processes, new equipment and new products. Article 8 The people's governments of provinces, cities and counties and their relevant departments shall organize various forms of publicity activities, popularize gas laws and regulations and safety knowledge, and incorporate gas safety knowledge into school safety education, so as to raise the awareness of gas safety of the whole society.

Newspapers, radio, television, internet and other news media should carry out public welfare publicity of gas safety knowledge. Chapter II Planning and Construction Article 9 The gas management department shall, jointly with the relevant departments, organize the preparation of the gas development plan in its own administrative region according to the national economic and social development plan, the land and space plan, the energy plan and the gas development plan at the next higher level, and combine the local conditions, and organize the implementation after the approval of the people's government at the same level, and report it to the gas management department of the people's government at the next higher level for the record.

The preparation of gas development planning should co-ordinate the construction of urban gas facilities, and rationally arrange all kinds of gas facilities such as pipeline gas, liquefied petroleum gas supply stations and gas vehicle filling stations.

The approved gas development plan shall not be changed or adjusted without authorization. If it is really necessary to change or adjust, it shall be submitted for approval and filing in accordance with the original procedures. Article 10 The construction of new areas and the transformation of old areas shall build gas facilities in accordance with the national land and space planning and gas development planning, or reserve land for the construction of gas facilities. The reserved land for supporting construction of gas facilities shall not be changed by any unit or individual without authorization.

In the construction of gas facilities within the scope of gas development planning, the competent department of natural resources shall solicit the opinions of the gas management department at the same level on whether the construction of gas facilities conforms to the gas development planning when issuing site selection opinions, construction land planning permits and rural construction planning permits according to law.

Within the scope of gas development planning, the gas facilities supporting the construction of new construction, renovation and expansion projects shall be planned, designed, constructed and accepted synchronously with the main project of the construction project. Article 11 The people's governments of provinces, cities and counties shall, in accordance with the relevant requirements of the state, establish and improve the gas emergency reserve system, organize the construction of gas emergency reserve facilities in accordance with the planning and reserve of land for the construction of urban gas emergency gas source reserve facilities, prepare emergency plans for gas reserves, and improve the gas emergency support capacity. Twelfth gas management departments shall, in conjunction with the development and reform and other relevant departments, monitor, predict and warn the supply and demand of gas. Article 13 In case of serious gas supply shortage, gas supply interruption and other emergencies, the people's governments of provinces, cities and counties shall promptly take emergency measures such as using reserves and emergency dispatching to give priority to ensuring residents' domestic gas use, and gas operators and other relevant units and individuals shall cooperate and undertake relevant emergency tasks. Article 14 The survey, design, construction and supervision of gas facilities construction projects shall be undertaken by units with corresponding qualifications.

Gas operators shall not abuse their dominant market position to monopolize the engineering installation business within their business scope, or designate interested parties to engage in gas engineering installation, which will hinder fair competition in the market. Chapter III Construction of Smart Gas Article 15 Encourage and support the intelligent application of gas engineering, and develop smart gas by using new generation information technologies such as artificial intelligence.

The Municipal People's Government shall promote the informatization construction of gas safety supervision, organize relevant departments and units to promote the establishment of a unified gas safety management service platform, and implement the whole process supervision of gas safety.

Conditional counties can establish a gas safety management service platform and connect with the municipal platform.
