Is the new divorce policy 202 1 true?

The new divorce policy of 202 1 came out, and the proposal of a 30-day cooling-off period for divorce was actually passed. In the new marriage law of 202 1, if you want to divorce, you need to apply for 30 days, and only one person can register for a divorce certificate. For details, please see the introduction provided by this website.

Is the new divorce policy of 202 1 true? Yes

According to a recent document of the Ministry of Civil Affairs, it will take effect from 20211. Couples who reach an agreement for divorce in the Civil Affairs Bureau need to go through five steps: application, acceptance, cooling-off period, examination and registration (certification). Within 30 days after the cooling-off period of divorce, both parties need to get a divorce certificate from the marriage registration office. Those who fail to apply for divorce at the expiration of the period shall be deemed to have withdrawn their application for divorce.

In addition, if the marriage is coerced, the marriage registration agency will no longer accept the request to cancel the business. According to the provisions of the Civil Law, "if the marriage is forced, the forced party may request the people's court to cancel the marriage."

202 1 what changes have taken place in the new marriage law? The newly adjusted divorce registration procedures are as follows:

Including application, acceptance, cooling-off period, review, registration (certification) and so on.

1. If both husband and wife apply for voluntary divorce, they shall sign a written divorce agreement, apply to the competent marriage registration authority, and provide relevant certificates and supporting materials.

2. The registrar accepting the marriage shall conduct a preliminary examination of the materials submitted by the parties in accordance with the relevant provisions of the Marriage Registration Ordinance. After the documents and certification materials submitted by the parties are correct, a "receipt of divorce registration application" will be issued. People who do not meet the requirements for divorce registration will not be accepted. If a party requests to issue an application for divorce registration, it shall issue it.

3. Cooling-off period: Within 30 days from the date when the marriage registration office receives the application for divorce registration and issues the Receipt for Divorce Registration to both parties, if either party is unwilling to divorce, it can show its valid identity certificate and the Receipt for Divorce Registration (if it is lost, it is not required to provide a written explanation), and withdraw the application for divorce registration from the marriage registration office that accepted the application for divorce registration, and fill in "Divorce Registration in person". After verification, the marriage registration authority will issue an application for cancellation of divorce registration and an application for divorce registration. The Application for Cancellation of Divorce Registration and the Confirmation of Cancellation of Divorce Registration (stub copy) will be distributed and filed together.

Within 30 days after the expiration of the cooling-off period for divorce, if both parties fail to apply to the marriage registration office for a divorce certificate, the divorce application shall be deemed to have been withdrawn.

4. Within 30 days after the expiration of the cooling-off period for divorce (if the last day of the holiday is a holiday, the first day after the holiday is the expiration date), both parties shall abide by the documents and materials of marriage registration (4) to (7) in Article 55 of the Provisions on the Cooling-off Period for Divorce, and * * * apply to the marriage registration authority for a divorce certificate.

The marriage registration authority shall conduct and review the marriage registration in accordance with the procedures and conditions stipulated in the Regulations on Marriage Registration. The marriage registration authority shall not handle those who do not meet the conditions for divorce registration. If a party requests to issue a Notice of No Divorce Registration (Annex 7), it shall do so.

5. Registration (certification) The marriage registration authority shall register in accordance with the Regulations on Marriage Registration and issue a divorce certificate.

202 1 introduction to the new divorce management law: divorce by agreement is no longer something you can leave if you want!

The Civil Code will come into effect next month. If you want a divorce, please register with the Civil Affairs Bureau and apply, and then wait 30 days after applying. During this period, any party who does not want to leave can withdraw the divorce application from the Civil Affairs Bureau.

If both parties want to leave, and both parties have not withdrawn their applications within 30 days after registration, they can apply to the Civil Affairs Bureau for a divorce certificate together within the next 30 days. However, if the party who has obtained the certificate does not participate, it will be regarded as an evacuation application. This is the second obstacle of 202 1 divorce.

60 days is enough to make both parties feel sorry, and the success rate of divorce by agreement will be greatly reduced next year.
