Article 2 These Provisions shall apply to travel agencies (including travel agencies or other organizations of the same nature), automobile companies and restaurants (including hotels, restaurants, etc.). ), shops and visiting units that receive foreigners, overseas Chinese, compatriots from Hong Kong, Macao and Taiwan. Article 3 The reception staff mentioned in these Provisions refers to the staff of the units listed in the preceding article, including managers, translators, tour guides, escorts, waiters, salespeople and drivers. Article 4 The kickbacks and tips mentioned in these Provisions refer to various forms of "gifts" such as in kind, cash or valuable coupons given by hotels, shops, tourist units or tourists to receptionists in tourism business. Fifth in the tourism business, tourists take the initiative to give gifts, the receptionist should politely decline; Can not refuse, in accordance with the relevant provisions of the state and the city on gift handling. Article 6 It is strictly forbidden for receptionists to take advantage of engaging in tourism business to ask for or collect kickbacks or tips.

In violation of the provisions of the preceding paragraph, the unit to which the receptionist belongs (hereinafter referred to as the unit) shall give administrative warning or demerit according to different situations; Those who refuse to mend their ways after repeated education may stay in the Party for probation or be dismissed from public office. The Municipal Tourism Bureau (hereinafter referred to as the Municipal Tourism Bureau) and the administrative department for industry and commerce shall supervise the implementation of the above provisions by their units, and shall be held accountable for the violations of the above provisions by their units. Seventh in violation of the provisions of the first paragraph of article sixth of these measures, the Municipal Tourism Bureau may, in conjunction with the administrative department for Industry and commerce, confiscate its illegal income and impose a fine of less than three times the illegal income. Article 8 Whoever asks for or accepts kickbacks or tips in a relatively large amount, if the circumstances are serious and violates the criminal law, shall be punished by judicial organs according to law. Ninth restaurants, shops and visiting units are strictly prohibited from paying kickbacks to receptionists. Restaurants, shops and visiting units are not allowed to pay kickbacks to receptionists with operating income, profits and enterprises' own funds.

In violation of the provisions of the preceding paragraph, the competent department at a higher level shall seriously deal with it, and may give administrative sanctions to the person in charge of the unit; The administrative department for industry and commerce may impose a fine of less than three times the amount of the fine, revoke its business license, and impose a fine of less than 200 yuan on the person in charge of the unit and the person directly responsible; For those who refuse to correct, the Municipal Tourism Bureau can notify them and suspend their reception of inbound tourists. Article 10 Persons who have been dismissed from public office in violation of these regulations shall not be employed in any unit that receives inbound tourists in this Municipality. Eleventh active personnel who report and expose violations of these provisions shall be commended and rewarded. Twelfth fines and physical objects in accordance with the relevant provisions of the state and the city. Thirteenth Municipal Tourism Bureau is the competent department of the city's tourism industry, responsible for the implementation and interpretation of these provisions.

The administrative departments of industry and commerce, finance, taxation, auditing, labor and other higher authorities of the reception unit shall, according to their respective responsibilities, assist the Municipal Tourism Bureau in implementing these Provisions. Fourteenth units that receive domestic tourists in this Municipality shall refer to these Provisions. Fifteenth the term "below" as mentioned in these Provisions includes this number. Article 16 These Provisions shall come into force as of November 15th, 1987.
