Measures for the classified management of domestic waste in Putian City

Article 1 In order to strengthen the classified management of domestic waste and improve the ecological environment, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations of Fujian Province on the Management of Urban and Rural Domestic Waste and the Regulations of Putian City on the Management of Urban and Rural Environmental Sanitation, and combined with the actual situation of this Municipality.

Article 2 These Measures shall apply to the production activities such as classified delivery, collection, transportation and disposal of domestic garbage in the urban built-up areas of this Municipality. Township, town and village (neighborhood) can refer to the implementation.

The term "domestic waste" as mentioned in these Measures refers to the solid waste generated in daily life or activities providing services for daily life and the solid waste regarded as domestic waste according to laws and regulations.

Article 3 The classified management of domestic waste shall follow the principles of governance according to law, unified planning, participation of the whole people, overall planning of urban and rural areas, adaptation to local conditions and reduction.

Article 4 The municipal and county (district) people's governments shall strengthen the supervision over the classified management of domestic waste, incorporate it into the national economic and social development plan, establish a coordination mechanism, improve the treatment system, and incorporate the classified management of domestic waste into the scope of government target responsibility assessment. The funds required for the classified management of domestic waste shall be included in the fiscal budget at the corresponding level.

Township people's governments and sub-district offices shall be responsible for the supervision and implementation of the classified delivery, collection, transshipment and disposal of domestic garbage within their respective jurisdictions.

Village (neighborhood) committees shall cooperate with township people's governments and subdistrict offices to publicize and guide the classification of domestic waste, and urge the units under their jurisdiction, village (neighborhood) residents and property service enterprises to consciously abide by the provisions of these measures.

Article 5 The Municipal Urban Management Bureau is the administrative department in charge of classified management of domestic waste in this Municipality, and is responsible for organizing the implementation of these Measures. Unified development of the city's domestic waste classification guidelines, clear classification, delivery, collection, transportation, disposal rules and other production matters, and announced to the public.

County and district city appearance and environmental sanitation administrative departments shall be responsible for the guidance, publicity, training, assessment and supervision of domestic waste classification within their respective jurisdictions, formulate and implement the domestic waste classification management plan, clarify the ways of domestic waste delivery, collection time, transportation routes and other matters within their respective jurisdictions, and implement the system of responsible areas and responsible persons.

Article 6 The natural resources management department shall be responsible for bringing the sanitation facilities determined in the special environmental sanitation plan into the national spatial planning.

The administrative department of commerce shall be responsible for formulating and implementing the development plan and industrial policy of renewable resources recycling industry within its administrative area.

The competent department of ecological environment administration is responsible for environmental monitoring and inspection of the operation of domestic waste disposal facilities, and supervision and management of the collection, transportation and disposal of harmful waste.

The property administrative department is responsible for urging the property service enterprises to classify domestic waste, and incorporating the implementation of the environmental sanitation responsibility system into the credit management system of the property service enterprises.

The education administrative department shall incorporate the knowledge of source reduction, classified delivery, recycling and harmless treatment of domestic waste into education, teaching and social practice, and cultivate and improve students' awareness of source reduction and classification of domestic waste.

Seventh new construction, renovation and expansion projects should be in accordance with national and provincial standards and planning conditions, supporting the construction of domestic waste collection and transfer facilities, and synchronous design, synchronous construction, synchronous acceptance and synchronous delivery with the main project, and shall not change the nature of use without authorization. If the construction project design plan submitted by the construction unit applying for the construction project planning permit and supporting the construction of domestic waste classified collection and transfer facilities, the location, area and purpose of the domestic waste classified collection and transfer facilities shall be specified.

In urban roads, squares, green spaces and other public plots (domains) or existing residential areas, it is not necessary to go through relevant procedures such as planning, construction and occupation of green spaces to build, modify (expand) facilities such as domestic waste sorting and collection houses (kiosks).

Eighth units or individuals should be classified according to the following requirements:

(1) Recyclable materials refer to domestic garbage suitable for recycling, mainly including waste paper, waste plastics, waste metal, waste glass, waste fabrics, waste furniture, waste electrical and electronic products, etc. ;

(2) Hazardous waste refers to the domestic hazardous waste listed in the National Hazardous Waste List, which has direct or potential harm to human health and the natural environment, mainly including waste batteries, lamps, waste drugs, thermometers, sphygmomanometers, waste paints, pesticides, disinfectants and their packaging;

(3) Kitchen waste, also known as "wet waste", refers to perishable household kitchen waste, kitchen waste and other kitchen waste containing organic matter, mainly including discarded ingredients, leftovers, vegetables, fruits, meat, aquatic products, etc.

(4) Other garbage, also called "dry garbage", refers to domestic garbage other than recyclables, kitchen garbage and harmful waste.

Domestic waste generating units or individuals shall regularly and regularly put the classified harmful waste, kitchen waste and other wastes into the corresponding marked domestic waste collection containers or specially set delivery points; Recyclable materials are put into recyclable material collection points or sold to renewable resource recycling enterprises.

Hazardous waste, medical waste, industrial waste, construction waste and other wastes shall be managed in accordance with relevant laws, regulations and rules, and shall not be mixed with domestic garbage.

Ninth units or individuals shall abide by the provisions of the classification and reduction of domestic waste, take the initiative to reduce the production of domestic waste, and put the domestic waste into the classification. The person responsible for the classified management of domestic waste shall, in accordance with the regulations on the management of urban and rural domestic waste in Fujian Province, implement the system of responsible areas and responsible persons.

Article 10 Units of classified collection, transportation and disposal of domestic garbage shall collect, transport and dispose of domestic garbage in accordance with the technical specifications for environmental sanitation operations.

If the domestic waste classified collection, transportation and disposal unit finds that the domestic waste put in does not meet the classification standards, it shall require the person in charge of management to correct it immediately; Refuses to correct, have the right to refuse to accept, and complain to the local city appearance and environmental sanitation department. The relevant units shall complete the disposal within 24 hours.

Eleventh recyclables, hazardous wastes and large garbage should be collected regularly according to the time agreed by the collection and transportation enterprise and the person in charge of domestic garbage classification management.

Garbage such as kitchen waste should be collected regularly every day and cleaned up every day.

Recyclable materials shall be transported by the unit, individual or responsible person responsible for the classified management of domestic waste, or by the recycling enterprise to make an appointment to collect and transport them at home; Hazardous wastes are transported by units that meet the requirements of hazardous waste transportation; Kitchen garbage and other garbage shall be transported by units that meet the prescribed transportation conditions of domestic garbage.

It is forbidden to pile up and sort domestic garbage in public areas such as sidewalks and green parks.

Twelfth domestic waste classification and transportation units shall comply with the following provisions:

(a) transport vehicles should be transported in a closed manner, and the types of domestic garbage transported should be marked in a prominent position on the body;

(two) the domestic waste will be transported to the designated transfer station or disposal site, and it is strictly forbidden to transport the classified domestic waste in a mixed way;

(three) according to the classification of domestic waste, collection, operation time and other reasonable allocation of transport vehicles, determine the frequency of transport, so that Nissan Nissin;

(4) During transportation, domestic garbage shall not be discarded or scattered along the way. After the operation, the vehicles and sites shall be cleaned in time to keep the domestic garbage transport vehicles, transfer facilities and the surrounding environment clean and tidy;

(5) establish a management ledger, record the source, type, quantity and destination of domestic waste, formulate an emergency plan for classified collection and transportation of domestic waste, and report it to the local city appearance and environmental sanitation department for the record.

Thirteenth new large and medium-sized domestic waste transfer station should be set up a separate kitchen waste transfer station.

Temporary storage of garbage in transfer stations should be standardized. Kitchen garbage and other garbage shall be stored in a sealed manner for no more than 24 hours.

Fourteenth domestic garbage should be classified, improve the level of resource utilization, and promote resource utilization:

(1) Recyclable materials are recycled by renewable resource recycling enterprises or comprehensive resource utilization enterprises;

(two) the hazardous waste in the city shall be treated harmlessly in accordance with the relevant provisions of the state, and if it belongs to hazardous waste, it shall be disposed of by a qualified hazardous waste disposal unit;

(3) The kitchen waste adopts a comprehensive treatment method based on biochemical treatment;

(four) other garbage by incineration, power generation and other ways for harmless treatment.

Fifteenth domestic waste disposal units shall classify domestic waste in accordance with the relevant provisions of the state, province and city, and abide by the following provisions:

(a) according to the provisions of the time and requirements to receive and deal with domestic garbage;

(2) Treating sewage, waste gas, waste residue, dust, etc. Garbage generated in the process of disposal shall be treated according to relevant national standards to prevent secondary pollution;

(3) Regularly monitor the environmental impacts such as water, gas and soil as required, and test and evaluate the performance and environmental protection indicators of domestic waste treatment facilities;

(four) to carry out regular maintenance and maintenance of domestic waste disposal facilities and auxiliary facilities and equipment, and report to the relevant administrative departments before shutdown and overhaul to ensure the safe operation of facilities and equipment;

(5) establish a management ledger, record the daily domestic waste transportation unit, the source, type and quantity of domestic waste, formulate an emergency plan for disposal, and report it to the local city appearance and environmental sanitation administrative department for the record.

Article 16 The municipal administrative departments in charge of industry and information technology, commerce, market supervision, cultural tourism, agriculture, postal services, and office affairs management shall, according to their respective functions and duties, establish a mechanism for reducing the source of domestic waste covering production, circulation, consumption and other fields. To formulate incentive measures to guide and encourage units and individuals to participate in the classification and reduction of domestic waste.

Article 17 Establish a coordination mechanism for the recycling system of renewable resources, which is under the responsibility of the competent commercial departments, with the participation of relevant administrative departments such as development and reform, natural resources, public security, market supervision, ecological environment, industrial informationization, postal management, housing and urban and rural construction, and urban management, and encourage enterprises to recycle low-value-added recyclable materials such as plastics and glass and recyclable materials with large volume.

Establish a recycling information system for renewable resources, providing information such as recycling types, transaction prices and recycling methods.

Producers and sellers are encouraged to recycle products and packages by refunding deposits, exchanging old products for new ones, online shopping and delivery.

Eighteenth city and county (District) people's governments shall commend and reward the units and individuals that have made outstanding achievements in the management of domestic waste classification, and may implement the method of rewarding the responsible persons. Relevant units can guide individuals to correctly classify and put domestic garbage through exchange points and other means.

Encourage units and individuals to participate in the classification, recycling and harmless treatment of domestic waste through donations, voluntary labor and voluntary services, and promote enterprises and social organizations to carry out domestic waste classification services.

If the realty service enterprise increases its expenses due to the performance of the duties of the person in charge of management, it may consult with the owners or the owners' committee and make it clear in the realty service contract.

Nineteenth city and county (District) city appearance and environmental sanitation administrative departments, street offices, Town People's Government shall establish and improve the supervision and inspection system of domestic waste classification, and regularly supervise and inspect the classification of domestic waste.

City and county (District) people's governments shall establish and improve the comprehensive assessment system of domestic waste classification at the corresponding level, incorporate the waste classification management into the assessment indicators of urban and rural environmental sanitation, and regularly publish the assessment results.

Twentieth city and county (District) administrative departments of city appearance and environmental sanitation shall, in accordance with the division of responsibilities, establish credit files of service units for classified collection, transportation and disposal of domestic garbage. Incorporate the information such as the service unit's violations and treatment results into the credit file and the credit evaluation system of environmental sanitation service units, conduct annual evaluation on the service quality and credit rating of service units, and publish the evaluation results.

Twenty-first city appearance and environmental sanitation administrative departments shall announce the telephone number of reports and complaints to the public, and set up a mailbox for reports and complaints. Units and individuals found in violation of these measures have the right to report complaints to the administrative department of city appearance and environmental sanitation. The administrative department of city appearance and environmental sanitation shall promptly investigate and deal with it according to law, and inform the informant or complainant of the investigation and handling results.

Twenty-second in violation of the provisions of these measures, under any of the following circumstances, the county (District) city appearance and environmental sanitation department shall be punished according to law. Where laws and regulations provide otherwise, such provisions shall prevail.

(a) units and individuals in violation of the provisions of article eighth of these measures, shall be ordered to stop the illegal behavior, and make corrections within a time limit; If no correction is made within the time limit, the unit shall be fined not less than 5,000 yuan but not more than 50,000 yuan, and the individual shall be fined not more than 200 yuan;

(two) the person in charge of domestic waste classification management fails to fulfill the obligations of the person in charge of the responsible area as stipulated in the first paragraph of Article 9 of these Measures, and shall be ordered to make corrections within a time limit; If no correction is made within the time limit, the unit shall be fined not less than 1,000 yuan but not more than 5,000 yuan, and the individual shall be fined not more than 200 yuan;

(three) domestic garbage collection and transportation units in violation of the provisions of the first paragraph of Article 10 of these measures, shall be ordered to make corrections within a time limit and impose a fine of ten thousand yuan to thirty thousand yuan.

Whoever transports or disposes of hazardous waste in violation of the relevant state regulations on hazardous waste management shall be punished by the administrative departments of ecological environment, transportation and other departments according to law.

Article 23 If, in violation of the provisions of these measures, the staff of administrative departments fail to perform their duties of supervision and management or neglect their duties, abuse their powers or engage in malpractices for selfish ends in the classified management of domestic garbage, the directly responsible person in charge and other responsible persons shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 24 Whoever obstructs the staff of the city appearance and environmental sanitation administrative department and the relevant administrative departments from performing their official duties according to law, or insults or beats the environmental sanitation staff, encloses domestic garbage collection and treatment facilities and transport vehicles, obstructs the construction and normal operation of domestic garbage treatment facilities, and violates the administration of public security, shall be given administrative penalties for public security according to law; If the case constitutes a crime, it shall be transferred to judicial organs for criminal responsibility.

Twenty-fifth Meizhou Island Management Committee and Meizhou Bay North Shore Management Committee shall implement classified management of domestic garbage according to these measures.

Article 26 These Measures shall come into force as of March 6, 2022.
