If there is any dispute in the performance of the contract, arbitration or prosecution can be chosen according to the terms of the contract. The industrial and commercial department does not intervene in contract disputes, and only when it involves issues such as commodity quality, consumer rights protection, unfair competition in the market, false propaganda, etc.

The industrial and commercial department has a supervision and management department specializing in contract management, and one of its departments is called "Contract Intermediary Department", which can go to the industrial and commercial bureau for mediation in case of contract disputes. However, the mediation opinions of the industrial and commercial bureau are not binding, and only if both parties to the dispute are willing to be mediated by the industrial and commercial bureau. Contract disputes belong to civil disputes, and only the civil judgment of the court has mandatory force.

the people's courts accept civil lawsuits brought by citizens, legal persons, other organizations and among them for property relations and personal relations.

For the following contracts, one party has the right to request the people's court or an arbitration institution to modify or cancel them:

(1) The contract was concluded due to gross misunderstanding;

(2) obviously unfair at the time of conclusion of the contract.

if one party leads the other party to conclude a contract against its true meaning by fraud, coercion or taking advantage of others' danger, the injured party has the right to request the people's court or arbitration institution to modify or cancel it.
