Regulations of Heilongjiang Province on the Administration of Public Security in Public Places and Special Industries

Chapter I General Provisions Article 1 In order to standardize the administration of public security in public places and special industries, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on Public Security Administration Punishment, the Law of People's Republic of China (PRC) on Public Security Administration Punishment, the People's Police Law of the People's Republic of China and other laws and regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to public places and units and individuals engaged in special industries within the administrative region of this province. Article 3 The term "public places" as mentioned in these Regulations refers to:

(a) stations, ports, docks, airports, parking lots and other transportation places;

(two) business entertainment, sports and fitness places such as song and dance halls, recreation rooms, chess rooms, theaters, stadiums (gymnasiums) and ski resorts;

(three) parks, playgrounds, exhibition halls, tourist attractions (spots) and other scenic spots;

(four) shops, markets and other commodity trading places;

(five) Internet cafes, information ports and other Internet service sites;

(six) restaurants, bars, cafes, teahouses, bathing, massage, beauty salons, information intermediary and other service places;

(seven) other places that the provincial people's government needs to manage according to the actual situation. Article 4 The term "special industries" as mentioned in these Regulations refers to:

(1) hotel industry;

(2) official seal engraving industry;

(3) pawnbroking;

(4) unlocking industry;

(five) the old mobile phone trading industry;

(six) gold and silver jewelry processing and replacement industry;

(seven) scrap metal acquisition industry;

(eight) motor vehicle maintenance industry;

(9) Trust consignment business. Article 5 Public security management in public places and special trades shall adhere to the principle of combining management with service and combining education with punishment. Sixth public security organs are the competent departments of public security management in public places and special industries in this province. Public security organs at or above the county level shall be specifically responsible for the administration of public security in public places and special industries within their respective jurisdictions, and shall perform the following duties according to law:

(a) the implementation of administrative licensing and filing review;

(two) to supervise and inspect the implementation of public security system and safety measures in public places and special industries;

(three) to organize and guide the public security training of the legal representative or responsible person and employees;

(four) to check the public security situation, put forward rectification opinions in time for the hidden dangers, and urge the rectification;

(five) to investigate and deal with public security cases in a timely manner and deal with emergencies and public security disasters. Chapter II Employment Conditions and License Filing Article 7 To set up an office space and special industries, the following conditions shall be met:

(1) Having a qualified legal representative or person in charge;

(2) Having qualified fixed business premises and business facilities;

(3) Keep a safe distance from factories and warehouses of inflammable, explosive, toxic and radioactive dangerous goods, and the site layout and facilities meet the fire safety and other relevant safety requirements;

(4) Having a public security management system and corresponding management measures;

(5) Don't share the stairway with residents.

Scrap metal purchasing outlets shall not be set up near railways, mining areas, oil fields, ports, airports, construction sites, military restricted zones and metal smelting and processing enterprises, and the areas where outlets are prohibited shall be designated by local public security organs at the county level and copied to the administrative department for industry and commerce at the same level. Article 8 Whoever engages in criminal activities by unlocking the lock, engraving the official seal, entrusting to sell on a commission basis, processing and replacing gold and silver jewelry, etc., shall be subject to criminal punishment. If the circumstances of illegal acquisition of productive scrap metal are serious, the scrap metal acquisition industry shall not engage in business activities in this industry. Article 9. Business premises, motor vehicle maintenance industry, scrap metal acquisition industry and trust consignment business shall be filed with the local county-level public security organ within 15 days after obtaining the business license; If the legal representative is closed, merged, relocated, renamed or changed, the public security organ shall be informed in writing within fifteen days after the cancellation or change.

The establishment of a non-operating public place shall be filed with the local county-level public security organ within fifteen days from the date of approval. Tenth public places, motor vehicle maintenance industry, scrap metal acquisition industry, trust consignment industry for the record shall provide the following written materials:

(1) A copy of the business license;

(two) a copy of the examination and approval procedures of the relevant departments;

(3) Site plan and emergency evacuation plan.

If the filing materials are complete, the public security organ shall issue a receipt for filing. Article 11 Anyone who meets the conditions for the establishment of hotel industry, official seal engraving industry and pawnbroker industry shall apply to the local county-level public security organ within 30 days after obtaining the special trade license, and apply to the administrative department for industry and commerce for registration.

Those who meet the start-up conditions of unlocking industry, used mobile phone trading industry and gold and silver jewelry processing and replacement industry shall apply to the local county-level public security organ within 15 days after obtaining the business license and obtain the special trade license. Article 12 Where the hotel industry, the official seal engraving industry and the pawnbroker industry are changed or cancelled, the public security organ that originally issued the special trade license shall go through the formalities of change or cancellation, and go through the formalities of change or cancellation of registration with the administrative department for industry and commerce.

If the lock-unlocking industry, used mobile phone trading industry, gold, silver and jewelry processing industry and replacement industry are changed or cancelled, the operator shall, within 15 days from the date of registration by the administrative department for industry and commerce, go through the formalities of change and cancellation at the public security organ that originally issued the special trade license.
