Hunchun Border Economic Cooperation Zone Management Regulations
Chapter 1 General Provisions Article 1 In order to speed up the construction of the Hunchun Border Cooperation Zone, develop foreign trade and economic and technological cooperation, and promote the prosperity and stability of the border areas, these regulations are formulated in accordance with relevant national laws and regulations. Article 2 The Hunchun Border Economic Cooperation Zone (hereinafter referred to as the Cooperation Zone) as mentioned in these Regulations refers to the Hunchun Border Economic Cooperation Zone established with the approval of the State Council of the People’s Republic of China. The cooperation zone is located in the south of Hunchun City, Yanbian Korean Autonomous Prefecture. Article 3 These regulations apply to the development, construction and management of cooperation zones. Article 4 The Cooperation Zone encourages Chinese and foreign investors to set up export processing industries, high-tech industries and corresponding tertiary industries in the Cooperation Zone to develop an export-oriented economy. Article 5 The cooperation zone provides domestic and foreign investors with a good investment environment and working and living conditions. Provide water supply, power supply, drainage, communications and other infrastructure and public facilities, service facilities and information consulting services for established enterprises. Article 6 Employees of enterprises and institutions within the cooperation zone have the right to establish trade union organizations and carry out trade union activities in accordance with the law. Article 7 The investment, property, income and other legitimate rights and interests of investors in the cooperation zone shall be protected by the laws of the People's Republic of China. Any unit or individual in the cooperation zone must abide by the laws, administrative regulations and local regulations of the People's Republic of China. Chapter 2 Administrative Management Article 8 The Hunchun Border Economic Cooperation Zone has established a management committee (hereinafter referred to as the Cooperation Zone Management Committee) to implement unified leadership and management of the economic and administrative affairs of the cooperation zone on behalf of the Hunchun Municipal People's Government. The Cooperation Zone Management Committee has various provincial-level economic and administrative management powers delegated to Hunchun City by the Jilin Provincial People's Government. Article 9 The Management Committee of the Cooperation Zone shall exercise the following powers:
(1) Formulate various administrative regulations for the Cooperation Zone in accordance with national laws, regulations and these regulations;
( 2) Prepare the overall plan and economic and social development plan within the administrative area of ??the cooperation zone, and organize its implementation after approval;
(3) Make overall arrangements for investment projects in the cooperation zone, and in accordance with the authority stipulated by the country and the province, Approval or review of investment projects in the cooperation zone;
(4) Responsible for the planning, acquisition, development and management of land in the cooperation zone;
(5) Responsible for the finance of the cooperation zone , state-owned assets, taxation, labor and personnel, and industrial and commercial administration;
(6) Plan and manage various infrastructure and public facilities in the cooperation zone, and manage urban construction;
(7) Establish and manage various public institutions such as culture, education, health, and sports in the cooperation zone;
(8) Responsible for the environmental protection work in the cooperation zone;
( 9) In accordance with national regulations, handle foreign-related affairs in the cooperation zone and manage the import and export business of the cooperation zone;
(10) Coordinate the branches of finance, insurance, foreign exchange management, customs, commodity inspection and other departments in the cooperation zone work;
(11) Supervise the enterprises and institutions in the cooperation zone in accordance with the law;
(12) Responsible for the social security and household registration management of the cooperation zone, and protect the Persons and property in the cooperation zone shall be inviolable, and relevant disputes in the cooperation zone shall be mediated and resolved;
(13) Appoint, remove, hire, reward and punish staff of the management committee and its subordinate units in accordance with the prescribed authority;
(14) Other powers granted by the superior government. Article 10 The Management Committee of the Cooperation Zone may, based on the needs of development and construction and in accordance with the principle of efficiency and leanness, establish a number of functional departments with approval to be specifically responsible for various administrative matters of the Cooperation Zone. Article 11 Finance, insurance, foreign exchange management, customs, commodity inspection and other departments may set up branches or dispatched agencies in the cooperation zone to handle relevant matters. Article 12 The power to review and approve land within the cooperation zone shall be implemented in accordance with the decision of the Standing Committee of the Provincial People's Congress on delegating provincial-level land review and approval power to the Hunchun Municipal People's Government.
Chapter 3 Investment and Operation Article 13 The following methods may be adopted for investment and operation in the cooperation zone:
(1) Sino-foreign joint venture;
(2) Sino-foreign cooperative operation;

(2) Those that discharge pollutants exceeding legal standards;

Article 16 Chinese and foreign investors who invest in and establish enterprises and various undertakings in the cooperation zone shall submit an application to the cooperation zone management committee. After review and approval, they shall go through relevant procedures such as land use, industrial and commercial registration, and tax registration respectively in accordance with regulations. , can start business. Article 17 For approved construction projects, the construction unit must invest capital and start construction within the prescribed time limit.
