What does the trespassing title mean?

The so-called "intrusion into private residences" refers to illegal intrusion into other people's homes. That is the act of another person trespassing into another person's house without the permission of the owner of the house or the competent authority failing to follow legal procedures.

According to Article 39 of the "Constitution":

The residences of citizens of the People's Republic of China are inviolable. Illegal searches or illegal intrusions into citizens' homes are prohibited. That is to say, the inviolability of citizens' residences is a basic right of citizens, which is equally important as citizens' personal freedom, personal dignity and other rights, and is also protected by the law.

Based on this, my country's "Criminal Law" stipulates the crime of "illegal intrusion into a residence". Those who constitute this crime will be sentenced to fixed-term imprisonment of not more than three years or criminal detention. The abuse of power by judicial staff constitutes a severe punishment for this crime. If the illegal intrusion into another person's residence is not enough for criminal punishment, he shall be detained for not more than 15 days, fined not more than 200 yuan, or given a warning.

The main characteristics of the crime of illegal intrusion into other people’s houses are:

(1) The object of the crime is the citizen’s freedom of residence. The object of the crime is a residence occupied by others.

(2) The objective aspect of crime is the act of illegally invading other people’s homes.

(3) The subjective aspect of crime can only be intentional. Entering another person's house by mistake, or entering another person's house without the owner's permission without legitimate reasons, does not constitute this crime.

(4) The criminal subject is a general subject.
