Measures of Zhangzhou Municipality on the Administration of Domestic Waste

Article 1 In order to strengthen the management of domestic waste, improve the living environment, and promote the construction of ecological civilization and the sustainable development of economy and society, these measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Law of the People's Republic of China on the Promotion of Circular Economy, and the Regulations of Fujian Province on the Management of Urban and Rural Domestic Waste, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the management activities such as source reduction, delivery, collection, transportation and disposal of domestic garbage and the planning and construction of related facilities within the administrative area of this Municipality.

The term "domestic waste" as mentioned in these Measures refers to the solid waste generated in daily life or activities providing services for daily life and the solid waste regarded as domestic waste according to laws and regulations.

The term "city" as mentioned in these Measures refers to the urban built-up area within the administrative area of this Municipality and the area where urbanization management is determined by the county (city) people's government. The specific scope is determined by the people's governments of cities and counties (cities) and announced to the public.

The term "rural areas" as mentioned in these Measures refers to the areas within the administrative area of this Municipality except the urban built-up areas and the areas determined by the county (city) people's governments to implement urbanization management. Article 3 The management of domestic waste in this Municipality follows the principles of government-led, participation by the whole people, overall planning of urban and rural areas, territorial management, source reduction and classified disposal, and timely implements total amount control to gradually improve the level of domestic waste reduction, resource utilization and harmlessness. Article 4 The people's governments at the city and county levels shall strengthen their leadership, determine and implement the management objectives of domestic waste, make overall plans for the layout and construction of domestic waste treatment facilities, ensure the capital investment of domestic waste management, and establish and improve the whole-process classified treatment system of domestic waste classified delivery, classified collection, classified transportation and classified disposal.

The township (town) people's government and street offices shall be responsible for the specific implementation of the classified delivery, collection and transshipment of domestic garbage and related supervision and disposal work within their respective jurisdictions.

Village (neighborhood) committees shall assist in the management of domestic waste within their respective jurisdictions, and publicize and mobilize units and individuals to participate in the reduction and classified delivery of domestic waste. Article 5 The competent department of urban management of the Municipal People's Government is the competent department of urban domestic waste management, and is responsible for the supervision and management of urban domestic waste.

The competent department of housing and urban and rural construction of the Municipal People's Government is the competent department of rural domestic waste management in this Municipality, and is responsible for the supervision and management of rural domestic waste in this Municipality.

The supervision and management of domestic waste of the people's government at the county level shall be organized and implemented by the department determined by the people's government at the same level (hereinafter referred to as the supervision and management department of domestic waste of the people's government at the county level).

The municipal and county people's governments in charge of development and reform, education, finance, agriculture and rural areas, commerce, market supervision and management shall, in accordance with the division of responsibilities, coordinate in the management of domestic waste. Article 6 The municipal and county people's governments and their relevant departments, township (town) people's governments, neighborhood offices and village (neighborhood) committees shall popularize the knowledge of domestic waste classification to the public in various ways, enhance the public's awareness of reduction and classification, organize public opening activities of domestic waste classified collection, transportation and disposal facilities, and encourage the public to participate in the supervision of domestic waste treatment activities.

State organs, institutions, social organizations, public places management units and state-owned enterprises shall play a leading role in the source reduction and classified delivery of domestic waste.

The competent education department shall urge all kinds of schools at all levels to incorporate the knowledge of source reduction, classified delivery, recycling and harmless disposal of domestic waste into the educational content, and organize activities such as classified education and practice of domestic waste.

Newspapers, radio, television, internet and other media should regularly carry out public welfare publicity on source reduction and classified delivery of domestic waste. Seventh, advocate the whole society to practice a low-carbon lifestyle and reduce the generation of domestic garbage.

Units and individuals shall fulfill the obligation of domestic waste classification, take the initiative to carry out domestic waste classification activities in accordance with the relevant provisions and requirements of garbage classification, cultivate the habit of domestic waste classification, and have the right to dissuade, complain and report violations of these measures. Article 8 The municipal and county people's governments shall, according to the economic and social development trend of their respective administrative regions, the generation and treatment of domestic garbage and the annual construction plan, and in accordance with the requirements of urban-rural synchronization and regional overall planning, build various domestic garbage treatment facilities that meet the needs of local domestic garbage treatment, such as incineration power plants, perishable garbage treatment plants, harmful waste treatment plants, large-scale garbage treatment plants and garbage transfer stations. Encourage cross-regional * * * construction * * to enjoy all kinds of domestic waste treatment facilities. Encourage the use of advanced technology and comprehensive treatment methods to build an intensive domestic waste treatment environment park.

The people's governments at the city and county levels shall, according to the needs of the final disposal of local domestic garbage, build sanitary landfills for burying incineration residues and fly ash that meet the exemption conditions and emergency use.

No unit or individual may interfere with or hinder the construction of domestic waste treatment facilities. Article 9 New construction, renovation and expansion projects shall, in accordance with national, provincial and municipal standards and planning conditions, support the construction of domestic waste sorting collection and transfer facilities, and design, construct, accept and deliver them synchronously with the main project, and shall not change the nature of use without authorization. If the construction project design plan submitted by the construction unit applying for the construction project planning permit and supporting the construction of domestic waste classified collection and transfer facilities, the location, area and purpose of the domestic waste classified collection and transfer facilities shall be specified.

People's governments at the county level, township (town) people's governments, street offices, village (neighborhood) committees responsible for the supervision and management of domestic waste and those responsible for the classified delivery and collection of domestic waste shall set up domestic waste collection sites and supporting facilities in accordance with relevant standards and norms.
