Regulations of Gansu Province on River Management (202 1 Revision)
Where laws and administrative regulations have already provided for the protection, treatment, utilization and management of river courses, such provisions shall prevail.
Rivers mentioned in these Regulations include rivers, lakes, reservoir areas, artificial waterways, flood discharge areas, flood storage areas and flood detention areas. Article 3 The protection, management and utilization of river courses shall follow the laws of nature, obey the overall deployment of flood control, and adhere to the principles of overall planning, comprehensive utilization, efficiency and green development. Article 4 The river length system shall be fully implemented, and a four-level river length system shall be established at the provincial, municipal (state), county (city, district), township (town) and village (community) levels.
Provincial, city (state) and county (city, district) levels set up a total river chief; Rivers are divided into provincial, city (state), county (city, district), township (town) and village (community) rivers and lakes.
The establishment and adjustment of the total river length, river length and lake length at all levels shall be implemented in accordance with the relevant provisions of the state and this province. Fifth river chiefs at all levels are responsible for leading the long-term management of inland rivers and lakes within their respective administrative areas. Responsible persons of rivers and lakes at all levels are responsible for organizing and leading the management and protection of corresponding rivers and lakes.
The responsible units of rivers and lakes shall jointly promote the management and protection of rivers and lakes according to the division of responsibilities.
The management and protection of rivers should be included in the assessment of rivers and lakes. Sixth people's governments at or above the county level shall incorporate the protection and management of river courses into the national economic and social development plan at the same level, and incorporate the funds for river course management and protection into the financial budget at the same level. Article 7 The management of river courses shall be based on the system of unified management by water system and hierarchical management by administrative regions.
The water administrative department of the people's government at or above the county level shall be responsible for the river management and supervision within its administrative area in accordance with the prescribed authority, and its subordinate river management institution shall be responsible for the daily work.
The relevant departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in river management. Eighth water administrative departments of the people's governments at or above the county level shall, jointly with relevant departments, establish and improve the joint law enforcement mechanism, strengthen communication and coordination, and do a good job in river management and protection. Ninth township (town) people's governments and sub-district offices shall do a good job in the management and protection of rivers within their respective jurisdictions, strengthen the publicity and education of river management, and popularize the relevant knowledge of river protection.
The village (neighborhood) committee may formulate village rules and regulations or residents' conventions to guide the village (neighborhood) people to consciously maintain the cleanliness of the river and protect the river environment. Article 10 The water administrative department of the people's government at or above the county level shall organize the preparation of plans for river regulation, sand mining in rivers, protection and utilization of watersides, and report them to the people's government at the same level for approval.
The relevant departments shall solicit the opinions of the water administrative department in accordance with the river management authority when preparing the planning of shipping, hydropower generation and fishery breeding. Eleventh water administrative departments of the people's governments at or above the county level shall establish and improve the archives of river management, and strengthen the information construction of river management. Chapter II Protection and Renovation of Rivers Article 12 The scope of management of rivers with dikes includes waters, sandbanks, beaches (including cultivated land), flood discharge areas, dikes and berms on both banks. The scope of management of river courses without dikes shall be determined according to the historical maximum flood level or design flood level.
The specific scope of river management shall be defined by the people's governments at or above the county level according to the relevant standards of rivers, lakes and water conservancy projects in this province.
The water administrative department may, with the approval of the people's government at or above the county level, delimit the dike safety protection zone in the area adjacent to the river management scope according to the importance of the dike and the soil quality of the dike foundation.
The scope of river management and dike safety protection areas shall be announced to the public by the people's governments at or above the county level and signs shall be set up. Thirteenth within the scope of river management, the following activities are prohibited:
(a) the construction of buildings and structures that hinder flood discharge;
(2) Building dikes, water blocking channels and water blocking roads;
(3) Planting trees and long-stalk crops that hinder flood discharge in flood-carrying rivers;
(4) Setting fishing gear for blocking the river;
(five) the disposal of slag, stone slag, coal ash, soil, garbage, etc. ;
(six) to engage in activities that affect the stability of river regime, endanger the safety of banks and dikes, and other activities that hinder the flood discharge of rivers;
(seven) stacking, dumping, burying and discharging objects that pollute water bodies;
(eight) cleaning vehicles and containers that have stored oil or toxic pollutants in rivers;
(nine) other prohibited acts as prescribed by laws and regulations.
Building houses, grazing, ditching, drilling wells, digging pits, burying graves, drying grain, storing materials, exploiting underground resources, conducting archaeological excavations and conducting market trade activities are prohibited in dikes and berms. Fourteenth the following activities within the scope of river management must be reported to the water administrative department for approval; Involving other departments, approved by the water administrative department in conjunction with the relevant departments:
(a) Disposal of sand, mud, gold, sand or sludge;
(2) Blasting, drilling and digging fish ponds;
(three) storing materials, building factories or other building facilities in the river beach;
(four) the exploitation of underground resources and archaeological excavations in the river beach.
