Interim Measures of Ezhou Municipality on the Administration of Electric Vehicles

chapter I general provisions article 1 in order to standardize the management of electric vehicles, maintain road traffic order, ensure the safety and smoothness of road traffic, and protect the legitimate rights and interests of citizens, legal persons and other organizations, in accordance with the road traffic safety law of the people's Republic of China, the product quality law of the people's Republic of China, the implementation regulations of the road traffic safety law of the people's Republic of China and the law of the people's Republic of China. Article 2 These Measures shall apply to the production, sale, registration, filing, traffic and related management activities of electric vehicles within the administrative area of this Municipality. Article 3 The term "electric vehicles" as mentioned in these Measures refers to road vehicles with two or more wheels driven by electric devices, including electric vehicles, electric motorcycles and electric bicycles.

an electric vehicle refers to a road vehicle that is driven by an electric device and travels on the road for people to ride or transport goods.

an electric motorcycle refers to a two-wheeled or three-wheeled road vehicle that is driven by an electric device and conforms to the national standard "Technical Requirements for Motor Vehicle Operation Safety" (GB7258-212). Electric motorcycles belong to motor vehicles.

an electric bicycle refers to a special bicycle that uses a storage battery as an auxiliary energy source, has two wheels, the maximum speed is not more than 2km/h, and the weight of the whole vehicle is not more than 4kg, and can realize the functions of human riding, electric driving or electric power assistance. Electric bicycles belong to non-motor vehicles. Chapter II Division of Responsibilities Article 4 The municipal and district (development zone) people's governments (administrative committees) shall be responsible for the unified management of electric vehicles in their respective regions. Article 5 Public security organs shall be responsible for the registration, filing and traffic management of electric vehicles.

the transportation management department is responsible for building and improving the public transportation network, and supervising and managing the road transportation behavior of electric vehicles.

the quality and technical supervision department is responsible for the supervision and management of the production quality of electric vehicles, and compiling and announcing the catalogue of registered products of electric vehicles.

the administrative department for industry and commerce is responsible for the supervision and management of electric vehicle sales.

the environmental protection administrative department is responsible for the supervision and management of the disposal of used batteries of electric vehicles.

the financial department is responsible for including the funds required for the registration and filing of electric vehicles into the financial budget and providing adequate guarantee.

municipal departments and units such as economic and information, planning, people's society, civil affairs, safety supervision, text and electricity, urban management, taxation, people's Sect, and disabled persons' Federation shall do a good job in the supervision and management of electric vehicles according to their respective responsibilities. Article 6 The traffic management, industry and commerce, quality supervision, environmental protection, letter, transportation, urban management, price and other departments of the public security organ shall establish a complaint reporting system, publish the complaint reporting telephone number, and handle relevant complaint reporting matters according to law. Seventh electric vehicle related industry associations should establish and improve the rules and regulations of industry self-discipline, carry out guidance and service work on the production and sales of electric vehicles, and guide the healthy development of the industry. Article 8 All localities and departments shall publicize the laws and regulations on the management of electric vehicles through news, publication, radio, television, internet and other channels, so as to raise public awareness of road traffic safety. Chapter III Production and Sales Article 9 Electric vehicles produced and sold in this Municipality shall belong to the registered product catalogue compiled and announced by the quality and technical supervision department. Article 1 No unit or individual may commit the following acts:

(1) Assembling electric vehicles;

(2) changing the technical parameters of the electric vehicle by modifying the power device and changing the speed limit device of the electric vehicle;

(3) add power devices, hoods, seats (except child safety seats), high-decibel speakers, stereos and other equipment or devices to the electric vehicle to change the external structure of the electric vehicle;

(4) selling and driving electric vehicles under the circumstances listed in the first three items;

(5) other behaviors that affect the traffic safety of electric vehicles. Article 11 A seller of electric vehicles shall, in the place of sale, promise consumers that the electric vehicles they sell conform to the provisions of these Measures by means of shop notices and sales vouchers. When selling, it shall provide consumers with product quality certificates and invoices, and inform them of the safe driving knowledge and precautions of the electric vehicles sold.

if the vehicle purchased by the buyer can't be registered in this city or can't run on the road due to the seller's failure to fulfill the obligation of informing, the buyer can request to return or exchange goods according to law. Twelfth to encourage the production and use of new energy electric vehicles.

encourage electric vehicle manufacturers, maintenance units and sales units to recycle used batteries and electric vehicles by exchanging old ones for new ones and buying them back at a discount. Thirteenth electric vehicle owners or managers should send the waste batteries of electric vehicles to electric vehicle manufacturers, sellers or other units with hazardous waste disposal qualifications for disposal, and shall not discard them at will. Article 14 The administrative department of environmental protection shall supervise and inspect the collection, storage, dismantling, utilization and disposal of used batteries of electric vehicles according to law. Chapter IV Registration and Filing Article 15 A registration or filing management system shall be implemented for electric vehicles traveling on roads. Article 16 If an electric vehicle belongs to a motor vehicle, it shall be registered in accordance with the Measures for Motor Vehicle Registration of the Ministry of Public Security. If it is a non-motor vehicle, it shall go through the registration formalities in accordance with these measures.
