Article 3 The safety production management of communication construction projects shall adhere to the policy of safety first and prevention first. When a production safety accident occurs, the cause of the accident must be identified, the responsibility for the accident must be identified, corrective measures must be implemented, the accident should be properly handled, and the relevant personnel must be held accountable in accordance with the law.

Chapter 2 Supervision and Management Responsibilities

Article 7 The communications administration bureaus of each province, autonomous region, and municipality directly under the Central Government are responsible for the supervision and management of safety production of communications construction projects within their respective administrative regions. Article 8 The Ministry of Industry and Information Technology and the communications administration bureaus of all provinces, autonomous regions and municipalities directly under the Central Government have the right to take the following measures when performing their duties of supervision and inspection of production safety in accordance with the law:

(1) Requirements The inspected unit shall provide documents and information related to production safety.

(2) Enter the construction site of the inspected unit for inspection.

(3) Correct violations of production safety requirements.

Article 9 The communications administration bureaus of all provinces, autonomous regions, and municipalities directly under the Central Government shall establish a reporting system to promptly accept reports, accusations and complaints about production safety accidents and accident hazards in communications construction projects; those that exceed their management authority shall be forwarded in a timely manner Departments with administrative authority. Article 10 The safety production status of communication construction projects shall be subject to a regular reporting and statistical system. Telecommunications operating enterprises, design units, construction units and supervision units in each administrative region shall submit the safety production status of communication construction projects to the Communications Administration Bureau of the administrative region; the headquarters of all telecommunications operating enterprises and the design units and construction units affiliated to central enterprises , The supervision unit shall submit the safety production status of the communication construction project to the Ministry of Industry and Information Technology.

Chapter 3 Safety Production Responsibilities

Article 11 Safety production responsibilities of telecommunications operating enterprises (i.e. construction units):

(3) No requirements that do not comply with production safety laws, regulations and mandatory standards shall be imposed on the design unit, construction unit and supervision unit, and the contracted construction period shall not be reduced.

(4) Before the start of a communication construction project, the construction unit shall make a comprehensive and systematic arrangement for the implementation of measures to ensure production safety, and clarify the safety production responsibilities of relevant units.

(5) When conducting qualification review of the construction unit, the construction unit shall review whether the main person in charge of the enterprise, the project leader and the full-time safety production management personnel have passed the safety production assessment of the communications department. Relevant personnel who have not passed the assessment shall not determine the bidding qualification of the bidding unit.

Article 12 Responsibility of the design unit for production safety:

(1) The design unit and relevant personnel are responsible for the safety of their design.

(2) When the design unit prepares the project budget estimate, it must list the safety production costs in full in accordance with relevant regulations.

(3) The design unit shall design in accordance with laws, regulations and mandatory engineering construction standards to prevent production safety accidents caused by unreasonable design.

The design unit shall consider the needs for safe construction operations and protection, indicate in the design documents the key parts and links involving construction safety, and provide guidance on preventing production safety accidents.

(4) The design unit should participate in the analysis of design-related production safety accidents and assume corresponding responsibilities.

Article 13 Responsibilities of production safety of construction units:

(1) The construction unit shall establish a safety production management organization, establish and improve the safety production responsibility system and education and training system, and formulate safety production Establish production rules and regulations and operating procedures, and establish emergency plans for production safety accidents.

The main person in charge of the construction unit shall be fully responsible for the safety production work of the unit in accordance with the law. The project leader shall be responsible for the safe construction of the construction project, implement the safety production responsibility system, safety production rules and regulations and operating procedures to ensure safety Effectively use production costs, organize and formulate safety construction measures according to the characteristics of the project, eliminate hidden dangers of safety accidents, and report production safety accidents in a timely and truthful manner.

(2) Equipped with full-time safety production management personnel in accordance with relevant national regulations. There must be full-time safety production management personnel at the construction site. To ensure production safety training and education, the main person in charge of the enterprise, the project leader and the full-time safety management personnel must obtain the safety production assessment certificate issued by the communications department, and hold the certificate to work.

(3) Establish a safety production cost budget. The project quotation should include the costs required for the safe working environment and safe construction measures of the project construction. It is necessary to ensure that the safety production cost is earmarked for construction safety protection equipment. The procurement and updating of facilities, the implementation of safety construction measures, and the improvement of safety production conditions shall not be used for other purposes.

(4) Construction operations shall be carried out in strict accordance with the mandatory standards for engineering construction and safety production operating specifications.

(5) If a construction project implements general construction contracting, the general contractor shall bear overall responsibility for production safety at the construction site.

If the general contractor subcontracts the construction project to other units in accordance with the law, the subcontracting contract shall clearly specify their respective rights and obligations in terms of production safety. The general contractor and the subcontractor shall bear joint and several liability for the safety production of the subcontracted project.

The subcontracting unit shall obey the production safety management of the general contractor. If the subcontracting unit disobeys the management and causes a production safety accident, the subcontracting unit shall bear the main responsibility.

(6) Participate in work-related injury social insurance in accordance with the law and pay insurance premiums for employees.

Article 14: Safety production responsibilities of supervision units:

(1) Implement supervision in accordance with laws, regulations, rules and regulations, safety production operating specifications and mandatory engineering construction standards, and Responsible for supervision of project construction and production safety.

(2) It is necessary to improve the safety production management system, clarify the safety supervision responsibilities of supervisors, and establish a safety production education and training system for supervisors. (3) Review whether the safety technical measures in the construction organization design or the special construction plan comply with the mandatory standards for engineering construction.

(4) During the supervision process, if any hidden dangers of production safety accidents are discovered, the construction unit shall be required to make rectifications; if the situation is serious, the construction unit shall be required to temporarily stop construction and report to the construction unit in a timely manner. If the construction unit refuses to make corrections or stop construction, the project supervision unit shall report to the relevant competent authorities in a timely manner.

Chapter 4 Safety Production Expenses

Article 15 Safety production expenses of communication construction projects refer to the construction unit’s purchase of construction safety protection equipment, implementation of safety measures, and improvement of safety measures in accordance with relevant national regulations. Costs required for safe production conditions, strengthening safety production management, etc.

Article 16 Production safety fees shall be managed in accordance with the principles of “project calculation, guaranteed use, enterprise coordination, and standardized use”.

Article 17 In accordance with the provisions of the "Interim Measures for the Financial Management of Production Safety Expenses of Enterprises in High-risk Industries" (Caiqi [2006] No. 478) issued by the Ministry of Finance and the State Administration of Work Safety, communications construction projects The extraction rate for production safety expenses is 1% of the construction and installation project cost.

The general contracting unit shall pay the safety costs to the subcontracting units in proportion, and the subcontracting units shall not make repeated withdrawals.

Article 18 When preparing the project budget estimate, the safety requirements shall be determined in accordance with the "Notice on the Release of the "Measures for the Preparation of the Communication Construction Project Budget Estimate" and Related Quotas (Ministry of Industry and Information Technology [2008] No. 75) Production expenses.

Article 19 For construction projects subject to engineering bidding in accordance with the law, when the tendering party or the entrusted bidding agency prepares the bidding documents, a separate list of production safety cost items shall be made clear in the bidding documents.

Article 20 The bidder shall make a separate quotation based on the list of production safety expenses listed separately in the bidding documents, and no deletions shall be allowed.

Article 21 The construction unit and the construction unit shall clarify the safety production responsibilities and safety production plans in the construction contract; clarify the amount of safety production expenses, payment plan, usage requirements, adjustment methods and other terms. If the construction unit has special requirements for safety protection and safe construction and needs to increase safety production expenses, it should make a separate list of increased safety production items based on the actual project conditions.

Article 22 If the contract period is less than one year, the construction unit shall prepay safety production expenses within five days from the date of signing the contract, which shall not be less than 70% of the total cost; if the contract period is less than one year For the above period (including one year), the prepaid safety production fee shall not be less than 50% of the total fee.

Article 23 When the construction unit completes 50% of the project quantity or construction progress, the project leader shall fill in the payment request form and submit it to the supervision unit after it is signed and sealed by the person in charge of the enterprise. The supervision unit shall review the project progress and on-site safety management within 3 days.

If the supervision unit discovers safety hazards at the construction site during the review, the construction unit shall be ordered to make immediate rectifications. After review, only if the requirements are met or the rectifications are qualified, the director can sign the requisition and request the construction unit to pay in time.

For engineering projects that have not been supervised, the project leader will directly submit the request form to the construction unit to apply for payment of the remaining safety production expenses after it is signed and stamped by the person in charge of the enterprise.

Article 24 Production safety expenses shall be used within the following scope in accordance with the provisions of the "Interim Measures for the Financial Management of Production Safety Expenses of Enterprises in High-Risk Industries" (Caiqi [2006] No. 478):

(1) Expenditures for improving, transforming and maintaining safety protection, testing and detection equipment and facilities;

(2) Expenditures for equipping necessary emergency rescue equipment, equipment and safety protection items for on-site workers.

(3) Expenditures for safety production inspection and evaluation;

(4) Expenditures for assessment, rectification and monitoring of major hazard sources and major accident hazards;

( 5) Expenditures on safety skills training and emergency rescue drills;

(6) Other expenses directly related to safety production.

Article 25 Production safety expenses shall be accounted for in a special account. The construction unit shall arrange the use within the prescribed scope and shall not misappropriate or occupy it. If the safety production expenses are insufficient, the excess shall be disbursed according to normal cost channels.

Article 26 The construction unit shall establish and improve an internal safety expense management system and clarify the use and management procedures of safety expenses.

Article 27 The construction unit shall apply for group personal accident insurance or individual accident insurance for personnel engaged in high-altitude, high-pressure, flammable, explosive, highly toxic, radioactive, high-speed transportation, and field operations. . The required expenses are directly included in the cost (expense) and are not included in the security expenses.

The expenses required for occupational disease prevention and treatment, work-related injury insurance, and medical insurance provided by the enterprise for employees are not included in the safety expenses.

Chapter 5 Production Safety Accident Reporting, Investigation and Handling

Article 28 According to the casualties or direct economic losses caused by production safety accidents (hereinafter referred to as accidents), accidents are generally classified into It is the following level:

(1) Extraordinarily serious accidents refer to those that cause more than 30 deaths, or serious injuries to more than 100 people (including acute industrial poisoning, the same below), or direct economic losses of more than 100 million yuan. Accidents;

(2) Major accidents refer to accidents that cause the death of more than 10 but not more than 30 people, or serious injuries of more than 50 but not more than 100 people, or direct economic losses of not less than 50 million yuan but not more than 100 million yuan;

(3) Major accidents refer to accidents that cause the death of 3 to 10 people, or serious injuries to 10 to 50 people, or direct economic losses of 10 million yuan to 50 million yuan; /p>

Article 29 After a production safety accident occurs, the relevant personnel at the accident site should immediately report to the person in charge of the unit. After receiving the accident report, the person in charge of the unit shall report to the work safety supervision and administration department of the people's government at or above the county level where the accident occurred and the Communications Administration Bureau of the administrative region within one hour.

The person in charge of the unit where the accident occurred shall promptly report the accident situation to the construction unit, supervision unit and other relevant units.

Article 30 After receiving the accident report, the person in charge of the unit where the accident occurred shall immediately activate the emergency response plan for accident handling, or take effective measures to organize rescue operations to prevent the accident from expanding and reduce casualties and property losses.

Article 31 In the event of a particularly serious accident or major accident, the Communications Administration Bureau of each province, autonomous region, or municipality directly under the Central Government shall report it to the Ministry of Industry and Information Technology within 2 hours after receiving the accident report.

Article 32 The accident report shall include the following contents:

(1) Overview of the unit where the accident occurred

Article 33 After receiving a report of a production safety accident, the Communications Administration Bureau at the location of the accident shall actively cooperate with the relevant work safety supervision and management departments to organize accident rescue, accident investigation and accident handling.

Article 34 After an accident occurs, relevant units and personnel shall properly protect the accident site and relevant evidence. No unit or individual may damage the accident site or destroy relevant evidence.

Chapter 6 Supervision and Management

Article 35 Telecommunications operating enterprises (i.e. construction units), design units, construction units and supervision units fail to submit production safety reports on time in accordance with these regulations If the situation is serious, they will be ordered to make corrections within a time limit. If they fail to make corrections within the time limit, they will be notified and criticized. Article 36 If a telecommunications operating enterprise (i.e., a construction unit) commits any of the following acts, it shall be punished in accordance with Article 55 of the "Regulations on the Management of Safety Production in Construction Projects".

(1) Put forward requirements for design, construction, supervision and other units that do not comply with production safety laws, regulations, safety production operating specifications and mandatory standards.

(2) Requiring construction companies to shorten the construction period agreed in the contract;

(3) Subcontracting construction projects and demolition projects to construction units that do not have the corresponding qualification level.

Article 37 If a construction unit violates these regulations and fails to provide safety production expenses for communication construction projects or fails to pay them in full on time, it shall be ordered to make rectifications within a time limit; if it fails to make rectifications within the time limit, it shall be ordered to stop the construction of the construction project and Notify and criticize.

Article 38 If a construction unit misappropriates production safety expenses, it shall be punished in accordance with Article 63 of the "Regulations on the Administration of Safety Production in Construction Projects".

Article 40 If the main person in charge of the construction unit or the project person in charge fails to perform safety production management responsibilities or violates these regulations, he shall be punished in accordance with the 66th provisions of the "Construction Project Safety Production Management Regulations" punishment.

Article 41 If a design unit fails to separately list safety production expenses as required when preparing a project budget estimate, it will be ordered to make corrections within a time limit.
