Chapter 1 General Provisions Article 1 In order to promote the development and construction of the Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone (hereinafter referred to as the Qianhai Cooperation Zone), deepen close cooperation with Hong Kong, develop modern service industries and strategic Emerging industries, building an open and innovative industrial system, and formulating these regulations in accordance with the basic principles of laws and administrative regulations. Article 2 The scope of the Qianhai Cooperation Zone includes the area determined by the "Overall Development Plan for the Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone" approved by the State Council (hereinafter referred to as the "Qianhai Plan") and the expanded area approved by the State Council. Article 3 Qianhai Cooperation Zone insists on relying on Hong Kong, serving the mainland, and facing the world, innovatively developing modern service industries such as finance, logistics, information services, scientific and technological services, and cultural creativity, promoting the development of strategic emerging industries, and building a new international urban center. It will play a greater role in the construction of the Guangdong-Hong Kong-Macao Greater Bay Area and the construction of Shenzhen as a pioneer demonstration zone for socialism with Chinese characteristics. Article 4 The Municipal People's Government shall strengthen its leadership over the implementation of the "Qianhai Plan", formulate implementation plans in accordance with the functional positioning and development priorities determined in the "Qianhai Plan", and coordinate and promote the comprehensive implementation of the "Qianhai Plan". Article 5 The Qianhai Cooperation Zone should actively explore new mechanisms, new models, and new approaches for cooperative development with Hong Kong.

The development, construction and management of the Qianhai Cooperation Zone should learn from and absorb advanced experiences from Hong Kong and other regions and internationally, and explore ways to integrate with international rules and practices. Article 6 The Municipal People's Government shall establish and improve systems and mechanisms suitable for the development needs of the Qianhai Cooperation Zone in accordance with these Regulations.

Relevant departments of the Municipal People’s Government, the people’s governments of the jurisdictions and the management agencies of the Qianhai Cooperation Zone should improve the system and mechanism of the Qianhai Cooperation Zone, and carry out the development and construction, industrial development, investment promotion, market supervision, and social development of the Qianhai Cooperation Zone. System integration innovation has been continuously promoted in key areas and key links such as governance and rule of law construction. Chapter 2 Governance Structure Article 7 Establish the Shenzhen Qianhai Shenzhen-Hong Kong Modern Service Industry Cooperation Zone Administration (hereinafter referred to as the Administration).

Under the leadership of the Municipal People's Government, the Administration Bureau shall, in accordance with these Regulations, perform relevant administrative and public service responsibilities such as development and construction, operation management, industrial development, rule of law construction, and social construction promotion of the Qianhai Cooperation Zone. , can implement corporate management but must not aim at making a profit.

The division of powers in the expansion area of ??Qianhai Cooperation Zone approved by the State Council shall be separately stipulated by the Municipal People's Government.

The administration shall prepare an annual work report and publish it to the public. Article 8 The Municipal People's Government shall, based on the actual development, construction and management of the Qianhai Cooperation Zone, specifically stipulate and adjust the administrative responsibilities and public service scope of the Administration, as well as the relevant departments of the Municipal People's Government and the people's governments of the jurisdictions beforehand. The list of powers and responsibilities of the administration shall be announced to the public by the Municipal People's Government. Article 9: The Administration Bureau shall have a director and several deputy directors. The Administration may set up consulting organizations based on work needs. Article 10: In the field of approval and management of non-financial industrial projects, the Administration shall exercise the management authority of cities under separate state planning in accordance with state authorization. Article 11 The Municipal People's Government shall, based on the strategic positioning and management system of the Qianhai Cooperation Zone, establish and improve a stable and predictable financial guarantee system that is conducive to the construction and development of the Qianhai Cooperation Zone. Article 12 The Administration may independently decide on the organizational structure, personnel recruitment and internal salary system based on the development situation and actual needs of the Qianhai Cooperation Zone and in accordance with the determined quotas or standards. Article 13: The administrative bureau may organize government procurement on its own in accordance with the law, and the municipal finance department shall implement supervision and management in accordance with the law. Article 14 The Administration Bureau may establish an enterprise in accordance with the law, which shall be responsible for the primary development of land in the Qianhai Cooperation Zone, the construction and operation of infrastructure and public service facilities, etc.

The Management Bureau performs the investor's responsibilities for the established enterprises and enjoys the rights of investors such as asset income, participation in major decision-making, and appointment of directors, supervisors, senior managers, etc. in accordance with the law. Article 15 The Administration Bureau shall improve the level of government services, innovate public administration systems and mechanisms, and create a stable, fair, transparent, and predictable legalized business environment in the Qianhai Cooperation Zone. Article 16: Establish an integrity supervision agency in the Qianhai Cooperation Zone to perform supervisory duties on the development, construction, operation and management activities of the Qianhai Cooperation Zone.

The Qianhai Cooperation Zone’s anti-corruption supervision agency exercises corresponding powers according to the authorization of the Shenzhen Municipal Supervisory Committee, and its working funds are arranged by the municipal financial budget at the same level. Article 17 Shenzhen Qianhai Local Financial Supervision Bureau exercises municipal-level local financial supervision and management powers in the Qianhai Cooperation Zone, performs corresponding duties such as administrative licensing, administrative penalties, administrative enforcement, and administrative inspections, and is responsible for the local financial supervision and management of the Qianhai Cooperation Zone. For overall planning, coordination, statistics, and investigation work in the management field, relevant pilot and pilot supervision systems can be formulated.

Shenzhen Qianhai Local Financial Supervision and Administration Bureau can launch a pilot program of comprehensive financial supervision supported by cooperative supervision and coordinated supervision, and explore the construction of a cross-border financial innovation supervision zone. Article 18 Enterprises are encouraged to establish industry associations, chambers of commerce and other organizations in accordance with the law to safeguard the legitimate rights and interests of the industry.

When formulating rules and guidelines involving industry management and development, the Administration shall fully consult with relevant industry associations, chambers of commerce, etc. to reach consensus on major issues.
