Article 2 These Regulations apply to coal mine production safety and its supervision and management activities within the administrative region of this province. Article 3 Safety production work in coal mines should be people-oriented, adhere to safe development, implement the policy of safety first, prevention first, and comprehensive management, strengthen and implement the main responsibilities of coal mining enterprises, and establish the responsibility of coal mining enterprises, employee participation, government supervision, and industry self-discipline and social supervision mechanisms. Article 4 The people's governments of provinces, cities and counties in coal-producing areas (including county-level cities and districts, the same below) shall strengthen coal mine safety management, formulate industrial policies and regulations to promote safe production in coal mines, and support coal mining enterprises in carrying out safety production technical transformation. and safety production standardization activities to support coal mining enterprises in adopting safe production applicable technologies and new standards, new equipment, and new processes. Article 5 The departments responsible for the supervision and management of coal mine safety in provinces, coal-producing regions, cities and counties (hereinafter referred to as the coal mine safety production supervision and management department) shall, in accordance with the division of responsibilities prescribed by the state and local people's governments, conduct daily supervision of coal mine safety in the region. manage.

The township (town) people's governments in coal-producing areas shall do a good job in coal mine safety production within their jurisdiction in accordance with their management responsibilities.

The development and reform, public security, industry and commerce, land and resources, environmental protection, health and other departments shall supervise and manage relevant coal mine production safety work within the scope of their respective responsibilities in accordance with the law. Article 6 Coal mining enterprises are the main body responsible for coal mine production safety. Coal mining enterprises implement a safety production responsibility system for all employees. The legal representative and the actual controller are both the first person responsible for safety production. The main person in charge of the coal mining enterprise (including the actual controller of the coal mining enterprise, the same below) is responsible for the safety production work of the coal mine. Comprehensive responsibility; other persons in charge are responsible for coal mine safety production within their respective scope of responsibility, and the main technical person in charge has the power to make technical decisions and command on safety production. Chapter 2 Coal Mine Production Safety Guarantee Article 7 Coal mining enterprises shall obtain a mining license, production safety license and business license in accordance with the law before they can engage in production activities.

Coal mining enterprises shall reasonably arrange production plans and labor quotas in accordance with the approved production capacity.

Production by organizations with superpowers, super strength, or over-capacity personnel is prohibited. Employees shall not be ordered to violate regulations or force employees to work in violation of regulations or take risks. Article 8 The main person in charge of a coal mining enterprise shall have the following responsibilities for the safety production work of the coal mine:

(1) Establish, improve and organize the implementation of the safety production responsibility system of the coal mine;

( 2) Organize the formulation and supervise the implementation of the coal mine's safety production regulations and operating procedures;

(3) Ensure the coal mine's investment in safety production and its effective implementation;

(4) Regular research Solve production safety problems;

(5) Supervise and inspect the production safety work of the coal mine, and investigate and manage hidden production safety hazards;

(6) Organize the formulation and implementation of production safety policies of the coal mine Safety accident emergency rescue plan;

(7) Truthfully report production safety accidents within the specified time, organize accident rescue, and cooperate with production safety accident investigations;

(8) Report to the workers’ meeting, The workers' congress, shareholders' meeting or general meeting of shareholders shall report on production safety conditions and accept the supervision of production safety work by trade unions, employees and shareholders;

(9) Other duties stipulated in laws, regulations and rules. Article 9 Coal mining enterprises shall set up safety production management agencies in accordance with the law or equip full-time safety production management personnel. Coal mines shall, in accordance with regulations, be equipped with mine directors, chief engineers and deputy mine directors in charge of safety, production, mechanical and electrical, as well as coal mining, excavation, mechanical and electrical personnel. Professional and technical personnel for transportation, ventilation, and geological survey work. Each shift should be equipped with full-time safety inspectors responsible for underground safety inspections. Small coal mining enterprises must have at least five full-time safety inspectors.

Coal mining enterprises shall establish and improve technical management systems in accordance with relevant national regulations to provide technical guarantee for safe production in coal mines. Article 10: Coal mining enterprises shall establish and improve safety production education and training systems, and provide safety production education and training to employees before and on the job, on the job, and when they transfer (return) to their jobs in accordance with regulations. Employees who have not received education and training on safety production are not allowed to work.

The main person in charge and safety production management personnel of a coal mining enterprise shall have production safety knowledge and management capabilities corresponding to the production and operation activities of the enterprise, and shall pass the assessment in accordance with regulations.

Special operation personnel of coal mining enterprises must undergo special safety operation training in accordance with relevant national regulations and obtain a special operation qualification certificate before they can work with the certificate.

Coal mining enterprises shall issue a coal mine employee safety manual that meets the requirements free of charge to each employee and truthfully inform relevant safety production matters. Article 11 Coal mining enterprises shall abide by the following regulations when mining: (1) Mining operations shall prepare operating procedures in accordance with regulations, and manage the roof in accordance with the provisions of the operating procedures. The mining operations shall pass through geological fracture zones or other When lifting the broken site, support should be strengthened;

(2) Mechanical and electrical equipment and its protective devices should be regularly inspected and repaired, and technical files should be established to ensure safe use;

(3) The concentration of toxic and harmful substances in the air in the workplace shall not exceed national standards or industry standards, and shall be tested regularly in accordance with national regulations;

(4) Open-pit mining operations shall be controlled in accordance with design regulations The stage height, width, slope angle and final slope angle of the mining and stripping working face; mining and stripping operations and earth dumping operations must not cause harm to deep or adjacent tunnels;

(5) Coal mining enterprises shall Strictly implement the gas inspection system, and no one is allowed to carry tobacco or igniting items into the well;

(6) There is gas outburst and impact on the ground pressure, under buildings, structures, railways, water bodies that need to be protected, and under the ground temperature For mining in abnormal areas, special design documents shall be prepared in accordance with regulations;

(7) Mines with the possibility of natural fires shall adopt fireproof grouting or other effective comprehensive measures to prevent natural fires;

(8) The underground air volume, wind quality, wind speed and the climate of the working environment shall comply with the provisions of coal mine safety regulations;

(9) Comprehensive prevention measures shall be taken for operations that generate dust on the surface and underground. Dust measures should be taken to control dust hazards; underground pneumatic rock drilling, dry drilling is prohibited;

(10) Other mining regulations required by laws, regulations, rules and coal mine safety regulations.
