Provisions of Changzhi Municipality on Prohibiting Fireworks and Firecrackers

Article 1 These Provisions are formulated in accordance with the provisions of relevant laws and administrative regulations and in the light of the actual situation of this Municipality in order to protect the state and collective property and the personal and property safety of citizens, prevent environmental pollution and maintain social order. Article 2 Fireworks and firecrackers mentioned in these Provisions refer to fireworks and firecrackers products and civil black powder, pyrotechnics, fuses and other articles used for the production of fireworks and firecrackers. Article 3 Fireworks and firecrackers are prohibited in the following areas of this Municipality:

(1) Luzhou District, Shangdang District, Lucheng District and Tunliu District;

(2) Danzhu Town, Baodian Town, Shuilan Town, Dabaotou Town, Linz Town, Song Cun Township, Nanzhang Town, Longquan Town, Huangshan Township, Wulong Mountain Scenic Resort Scenic Area Township, Jinzhuang Town, Jidian Township, Huguan Economic Development Zone, Qingyang Town, Miao Zhuang Town and Beishe Township of Pingshun County;

(3) Built-up areas where other county people's governments are located;

(four) other areas where fireworks are prohibited by laws and regulations.

In the above areas, no unit or individual may produce, manage, store or transport fireworks and firecrackers. Article 4 Fireworks and firecrackers are prohibited in the following places other than Article 3 of these Provisions:

(a) cultural relics protection units;

(2) Transportation hubs such as stations, docks and airports and railway line safety protection zones;

(3) Units that produce and store inflammable and explosive articles;

(4) Kindergartens, schools, old-age care institutions and medical institutions;

(5) Within the safety protection zone of power transmission and transformation facilities;

(six) key fire prevention areas such as mountains and grasslands;

(seven) other places where fireworks and firecrackers are prohibited as prescribed by the people's government of the city or county (District). Fifth people's governments at all levels shall be responsible for the work of prohibiting the discharge of fireworks and firecrackers within their respective administrative areas.

The public security organ is responsible for the safety management of fireworks and firecrackers, and is the competent department that prohibits the discharge of fireworks and firecrackers, and specifically organizes the implementation of these Provisions.

Emergency management, ecological environment, market supervision and management, transportation and other departments shall, in accordance with their statutory duties, do a good job in the safety management of fireworks and firecrackers.

City management, city appearance and environmental sanitation, supply and marketing units and neighborhood offices, residents' committees, villagers' committees and property service enterprises shall, in accordance with their respective functions and duties, cooperate with relevant departments to do a good job in prohibiting the discharge of fireworks and firecrackers. Sixth major national events and festivals need to set off fireworks, the Municipal People's government issued a notice.

The announcement shall specify the specific time, place and variety of discharge. Seventh in violation of the provisions of the production, management, storage, transportation and discharge of fireworks, any organization or individual has the right to stop, and report to the public security organs or other relevant departments. If the report is verified, the whistleblower will be rewarded. Eighth people's governments at all levels and their relevant departments, neighborhood offices, residents' committees, villagers' committees, social organizations, schools, hospitals and other enterprises, institutions and other organizations shall carry out publicity and education activities to prohibit the discharge of fireworks and firecrackers.

Guardians of minors shall educate minors about the prohibition of fireworks and firecrackers, and stop minors from setting off fireworks and firecrackers in areas where fireworks and firecrackers are prohibited. Ninth in violation of these provisions, laws, administrative regulations and provincial local regulations have legal liability provisions, from its provisions. Tenth in violation of these regulations, illegal production, operation, storage and transportation of fireworks and firecrackers without permission shall be punished by the relevant competent departments in accordance with the provisions of relevant laws and regulations. Eleventh in violation of the provisions of fireworks, the public security organs shall be ordered to stop the discharge, a fine of one hundred yuan to five hundred yuan; If it constitutes a violation of public security administration, it shall be punished by the public security organ according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Those who set off fireworks and firecrackers in violation of regulations and cause economic losses or personal injury to the infringed shall be liable for damages according to law. Article 12 These Provisions shall come into force on July 1 day, 2065438.
