What contracts should the industrial and commercial bureau file?

Legal analysis: housing sale, housing agency, residential renovation contract; Property service contract; Tourism service contract; Electricity, water, gas and heat supply contracts; Postal, communication and cable TV service contracts; Consumer loan contract; Personal and property insurance contracts; Other format clauses contracts that the Municipal People's Government deems necessary for filing.

Legal basis: Article 496 of the Civil Code of People's Republic of China (PRC) is a standard clause drawn up by the parties in advance for reuse, and there is no need to consult with each other when concluding a contract.

Where a contract is concluded by standard terms, the party providing the standard terms shall follow the principle of fairness to determine the rights and obligations between the parties, and take reasonable measures such as exempting or lightening their responsibilities to remind the other party of the terms that have a significant interest in them, and explain the terms according to the requirements of the other party. If the party providing the standard terms fails to fulfill its obligation to prompt or explain, so that the other party fails to pay attention to or understand the terms that have a significant interest in it, the other party may claim that the terms will not become the content of the contract.

Article 12 of the Measures for the Supervision of Contract Format Clauses in Wuhan City, if the following contracts contain format clauses, the provider shall submit the contract text to the administrative department for industry and commerce for the record 30 days before the use of the contract text, except for those which are regarded as contract format clauses in the second paragraph of Article 2 of these Measures: (1) House sales, house agency and residential renovation contract;

(2) Property service contracts;

(3) Tourism service contracts;

(4) electricity, water, gas and heat supply contracts;

(5) Postal, communication and cable TV service contracts;

(6) Consumer loan contract;

(7) Personal and property insurance contracts;

(eight) other format terms contracts that the Municipal People's Government thinks need to be put on record.

Where there are other provisions in laws and administrative regulations on the examination and approval of contract texts listed in the first paragraph of this article, those provisions shall prevail.

If the contract text to be used by the supplier has been reported to the administrative department for industry and commerce for the record by the superior competent department or relevant administrative departments and industry organizations, it is not necessary to put it on record, unless the contract text is changed.
