1. It is forbidden for any unit or individual to build kilns, build houses, build graves, dig sand, quarry, mine, borrow soil, pile up solid wastes or engage in other activities that destroy basic farmland in the basic farmland protection area. It is forbidden for any unit or individual to occupy basic farmland to develop forestry and fruit industry and dig ponds to raise fish.

2, prohibit any unit or individual idle, barren basic farmland. If a unit or individual contracted to operate basic farmland abandoned cultivated land for two consecutive years, the original contractor shall terminate the contract and recover the contracted basic farmland. The land administrative departments and agricultural administrative departments of the local people's governments at or above the county level have the right to order correction of acts that destroy basic farmland within their respective administrative areas.

3. If the signs of basic farmland protection areas are destroyed or changed without authorization, the land administrative departments or agricultural administrative departments of local people's governments at or above the county level shall order them to restore to the original state and may impose a fine of 1000 yuan.

4. Whoever violates the regulations on the protection of basic farmland and commits any of the following acts shall be given a heavier punishment in accordance with the relevant provisions of the Land Administration Law of the People's Republic of China and the Regulations for the Implementation of the Land Administration Law of the People's Republic of China:

Illegal occupation of basic farmland without approval or by deception;

(two) more than the approved number, illegal occupation of basic farmland;

(3) illegally approving the occupation of basic farmland;

(four) the sale or other forms of illegal transfer of basic farmland.

5. "Five prohibitions" on basic farmland, that is, non-agricultural construction other than national key construction projects stipulated by law shall not occupy basic farmland; In the name of returning farmland to forests, basic farmland with good farming conditions shall not be included in the scope of returning farmland to forests, and the area of basic farmland shall be reduced without authorization in violation of the overall land use plan; Shall not occupy basic farmland for afforestation and develop forest and fruit industry; It is not allowed to dig ponds to raise fish, raise livestock and poultry in basic farmland in the name of agricultural structural adjustment, or other production and business activities that seriously damage the arable layer; Do not occupy the green channel and green isolation belt for the construction of basic farmland.
