Article 1 In order to promote the recycling of waste agricultural film, prevent and control agricultural non-point source pollution, protect the agricultural ecological environment, and promote sustainable agricultural development, this document is formulated in accordance with the provisions of relevant laws and administrative regulations and in light of the actual situation of the province. regulations. Article 2 These regulations shall apply to the recycling and utilization of waste agricultural film and related activities within the administrative region of this province.

The term "waste agricultural film" as mentioned in these Regulations refers to agricultural mulch film and agricultural shed film that are discarded or remain in the agricultural production process. Article 3 The recycling and utilization of waste agricultural film shall follow the principles of government leadership, public participation and comprehensive utilization. Article 4 The county (city, district) people's government shall strengthen the construction of the waste agricultural film recycling system, incorporate the recycling of waste agricultural film into the environmental protection target responsibility system, rationally arrange recycling outlets, and support enterprises and other organizations in recycling waste agricultural film. Article 5 People's governments at or above the county level shall include the funds required for recycling waste agricultural film into the fiscal budget of the same level.

The Provincial People's Government has set up special funds to support the construction of waste agricultural film processing enterprises and the research, development and promotion of waste agricultural film recycling technology. Article 6 The agricultural administrative departments of the people's governments at or above the county level are responsible for the guidance, supervision and management of the recycling of waste agricultural films within their respective administrative regions. Their main responsibilities are:

(1) Carrying out agricultural ecological environmental protection Publicity and education;

(2) Carry out technical guidance on the recycling of waste agricultural film and the introduction, testing, demonstration and promotion services of related technologies;

(3) Work with relevant departments to carry out waste management Declaration and use management of special funds for the recycling of agricultural film and other subsidy funds;

(4) Responsible for the monitoring and evaluation of agricultural pollution of used agricultural film, and organize the comprehensive management of agricultural pollution areas;

(5) Responsible for the supervision and inspection of the recycling of waste agricultural films, and investigate and deal with agricultural pollution accidents of waste agricultural films in accordance with the law.

The agricultural ecological environment protection management agency affiliated to the agricultural administrative department of the people's government at or above the county level is responsible for the specific work of recycling waste agricultural film. Article 7 The financial department of the people's government at or above the county level is responsible for the fund raising, budget preparation and fund management of the recycling of waste agricultural film; the development and reform department is responsible for incorporating the recycling of waste agricultural film into the circular economy plan and providing project and financial support. support.

The industry and information technology, science and technology, environmental protection, quality and technical supervision, industrial and commercial administration, taxation and other departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job in the recycling and utilization of waste agricultural film. Article 8 The township (town) people's government shall determine full-time or part-time personnel to be responsible for the organization, publicity, supervision and management of waste agricultural film recycling within their jurisdiction.

Village committees should organize and urge agricultural workers and agricultural production and operation organizations to pick up waste agricultural films, and provide convenience for relevant units and individuals to set up outlets to recycle waste agricultural films. Article 9 The provincial quality and technical supervision department shall, together with the provincial agricultural administrative department, formulate local standards for agricultural mulch film production based on the actual conditions of the province. Article 10 Various agricultural technology promotion agencies should guide agricultural workers and agricultural production and operation organizations to scientifically use agricultural mulch films and shed films, and promote new technologies such as mechanical film removal and film picking. Article 11 Agricultural workers and agricultural production and operation organizations shall promptly pick up the waste agricultural film produced during the agricultural production process and shall not discard, bury or burn it at will. Article 12 It is prohibited to produce, sell and use agricultural mulch films with a thickness less than 0.008 mm.

Promote the use of agricultural mulch films with a thickness greater than 0.01 mm, a weather resistance period greater than 12 months, and compliance with other national quality and technical standards, and agricultural shed films with a thickness greater than 0.12 mm.

The government’s unified procurement of agricultural mulch films and the production of agricultural mulch films that enjoy other subsidies shall be governed by the provisions of paragraph 2 of this article. Article 13: Enterprises and other organizations and individuals that produce, sell, and recycle agricultural mulching films and greenhouse films are encouraged to set up outlets to recycle waste agricultural films.

Enterprises that apply for financial subsidies for the recycling of waste agricultural film should sign a film recycling responsibility letter with the county (city, district) agricultural environmental protection management agency. After assessment and acceptance, if they meet the standards agreed in the responsibility letter, they will enjoy financial subsidies. subsidy. Article 14: Waste agricultural film recycling enterprises shall research and develop waste agricultural film regeneration processing technology to reduce waste emissions and prevent secondary pollution to the environment.

Article 15 The people's governments at or above the county level shall support enterprises engaged in the recycling of waste agricultural films by providing awards in lieu of subsidies, loan interest discounts, etc., and shall enjoy preferential policies such as agricultural electricity prices in accordance with relevant national and provincial regulations.

People's governments at or above the county level should include agricultural film-removing and film-picking machines into the scope of agricultural machinery purchase subsidies; enterprises that produce agricultural mulch films, greenhouse films and recycle waste agricultural films will be given priority under the same conditions. Purchase the standard agricultural mulch film and shed film produced by it. Article 16 The agricultural administrative departments of the people's governments at or above the county level may, in accordance with the law, inspect places where agricultural mulching films, shed films, and recycling and processing of waste agricultural films are sold and used, and investigate and understand relevant situations; quality and technical supervision, industrial and commercial administration and other departments The production and sale of agricultural mulch films, greenhouse films or waste agricultural film recycled products that do not meet quality and technical standards shall be sealed up and detained in accordance with the law. Article 17 Anyone who violates the provisions of these Regulations by producing or selling agricultural mulch film with a thickness less than 0.008 mm shall be ordered by the quality and technical supervision and industrial and commercial administration departments of the county (city, district) people's government to stop production and sales, and the illegal production and sales will be confiscated. products, and shall be fined one to three times the value of the products illegally produced and sold.
