3. Annual leave salary:
(1) Vacation period: employees enjoy the same salary income during the annual vacation as during the normal working period.
Measures for calculating and distributing the daily wage income of employees who implement piecework wage, commission wage or other performance-based wage system:
The daily wage income is converted by dividing the employee's monthly salary by the paid days (2 1.75 days). The monthly salary refers to the average monthly salary 12 months before the employer pays the annual leave salary to the employees. If the working time in this employer is less than 12 months, the average monthly salary shall be calculated according to the actual month.
② Annual leave not taken:
1. With the consent of the employees, if the employer fails to arrange annual leave, or the number of days of annual leave arranged for the employees is less than the number of days of annual leave due, it shall pay 300% of the employees' daily wages for the days of annual leave.
2. The employing unit arranges employees to take annual leave, but if the employees put forward annual leave in writing for their own reasons, the employing unit can only pay their wages for normal working hours.
(3) When the employer dissolves or terminates the labor contract with the employee, if it fails to arrange the employee to take full annual leave within one year, it shall convert the annual leave days into annual leave days according to the working hours of the employee in that year, and pay the annual leave salary, but the converted part of the salary less than 1 full day will not be paid. The conversion method is:
(The number of calendar days that have passed in this company in that year is 365 days) × the number of annual leave days that employees should enjoy throughout the year-the number of scheduled annual leave days in that year. If the employer has arranged annual leave for employees in that year, the number of days exceeding the converted annual leave will not be deducted.
(3) Agreement priority: If the annual leave days stipulated in the labor contract, collective contract or the rules and regulations of the employer are higher than the legal standard, the employer shall implement it in accordance with the relevant agreements or regulations.
(4) Illegal handling: if the employing unit fails to arrange annual leave for employees and fails to pay annual leave wages in accordance with the Regulations and these Measures, the labor administrative department of the local people's government at or above the county level shall order it to make corrections within a time limit according to its functions and powers; If no correction is made within the time limit, in addition to ordering the employer to pay the annual leave salary, the employer shall also pay compensation to the employee according to the amount of the annual leave salary; Refusing to implement the administrative decision of paying wages and annual leave compensation, the labor administrative department shall apply to the people's court for compulsory execution.
