Chapter I General Provisions Article 1 This Law is formulated for the purpose of regulating and ensuring the performance of duties by the marine police, safeguarding national sovereignty, security and maritime rights and interests, and protecting the legitimate rights and interests of citizens, legal persons and other organizations. Article 2 The maritime police force of the People's Armed Police Force, that is, the marine police agency, shall uniformly perform the duties of safeguarding rights and enforcing the law at sea.

Marine police agencies include China Marine Police and its branches and bureaus directly under it, provincial marine police, municipal marine police and marine police workstations. Article 3 This Law shall apply to the maritime rights protection and law enforcement activities of maritime public security organs in the waters under the jurisdiction of People's Republic of China (PRC) (hereinafter referred to as the waters under the jurisdiction of China) and over them. Article 4 Law enforcement of maritime rights protection adheres to the leadership of the Communist Party of China (CPC), implements the overall concept of national security, and follows the principles of management according to law, comprehensive management, standardization, efficiency, fairness and civilization. Article 5 The basic tasks of law enforcement for maritime rights protection are to implement maritime security, maintain public order at sea, crack down on smuggling and smuggling at sea, supervise and inspect activities such as the development and utilization of marine resources, the protection of marine ecological environment and the production and operation of marine fisheries within the scope of duties, and prevent, stop and punish illegal and criminal activities at sea. Article 6 Marine police agencies and their staff members shall be protected by law when performing their duties according to law, and no organization or individual may illegally interfere, refuse or hinder them. Article 7 The staff of marine police organs shall abide by the Constitution and laws, respect honor, be loyal to their duties, be strict in discipline, strictly enforce the law, and be honest and upright. Article 8 The State establishes a cooperative mechanism for maritime rights protection and law enforcement with overall planning of land and sea, division of labor and cooperation, and scientific and efficient. Relevant departments of the State Council, coastal local people's governments, relevant military departments and marine police agencies should strengthen cooperation and do a good job in maritime rights protection and law enforcement. Article 9 Organizations and individuals who have made outstanding contributions to maritime rights enforcement activities shall be commended and rewarded in accordance with the provisions of relevant laws and regulations. Chapter II Institutions and Responsibilities Article 10 The State shall, in accordance with administrative divisions and task areas, set up maritime sub-bureaus and directly affiliated bureaus in coastal areas, such as China Marine Police, provincial marine police, municipal marine police and marine police workstations, to be responsible for the relevant maritime rights protection and law enforcement work within their respective jurisdictions. According to the relevant regulations of the state, the marine police agencies under the leadership of China Marine Police Bureau carry out law enforcement work on maritime rights protection. Article 11 The areas under the jurisdiction of the Marine Police Department shall be reasonably demarcated and adjusted according to the needs of maritime law enforcement, and shall not be restricted by administrative divisions.

Delineation and adjustment of the area under the jurisdiction of the marine police agency shall be announced to the public in a timely manner and notified to the relevant authorities. Twelfth marine police agencies shall perform the following duties according to law:

(1) Cruise, guard and guard the key islands and reefs in the waters under our jurisdiction, protect the maritime boundary, and prevent, stop and eliminate acts endangering national sovereignty, security and maritime rights and interests;

(2) Implementing security for important maritime targets and major activities, and taking necessary measures to protect the safety of key islands and reefs, artificial islands, facilities and structures in the exclusive economic zone and continental shelf;

(three) the implementation of maritime security management, investigate and deal with violations of maritime security management, entry and exit management, prevent and respond to maritime terrorist activities, and maintain maritime security order;

(four) to inspect the means of transport or goods, articles and personnel suspected of smuggling by sea, and investigate and deal with illegal acts of smuggling by sea;

(5) To supervise and inspect activities such as sea area use, island protection, development and utilization of uninhabited islands, exploration and development of marine mineral resources, laying and protection of submarine electric (optical) cables and pipelines, marine survey and measurement, marine basic surveying and mapping, and foreign-related marine scientific research, and investigate and deal with illegal acts;

(6) To supervise and inspect marine engineering construction projects, marine pollution damage caused by marine dumping wastes, protection and utilization of nature reserves to the coastline and other activities, investigate and deal with illegal acts, and participate in emergency disposal and investigation and handling of marine environmental pollution accidents according to the prescribed authority;

(7) To supervise and inspect the fishery production and marine wildlife protection activities in the bottom trawl closed fishing area of motor boats and the waters outside the fishing grounds with specific fishery resources, investigate and deal with illegal acts, and organize or participate in the investigation and handling of maritime fishery production safety accidents and fishery production disputes according to law;

(8) Preventing, stopping and investigating criminal activities at sea;

(9) Handling maritime emergencies in accordance with the relevant division of responsibilities of the state;

(10) To undertake relevant law enforcement tasks in areas beyond the jurisdiction of China according to laws and regulations and international treaties concluded or acceded to by China;

(eleven) other duties as prescribed by laws and regulations.

Division of responsibilities between the Marine Police Department and public security, natural resources, ecological environment, transportation, fishery, fishery administration, customs and other competent departments. It shall be implemented in accordance with the relevant provisions of the state. Thirteenth marine police agencies received emergency help due to natural disasters, accidents and maritime disasters, etc., should promptly notify the relevant competent departments, and actively carry out emergency assistance. Fourteenth central state organs shall, in accordance with the relevant provisions of the state, provide professional guidance to the law enforcement of marine rights protection. Article 15 China Marine Police and its maritime sub-bureau shall, in accordance with the relevant provisions of the state, coordinate and guide the maritime law enforcement teams of coastal local people's governments to carry out related law enforcement work such as sea area use, island protection and development, marine ecological environment protection and marine fishery management.

According to the needs of maritime law enforcement, China Marine Police and its branches can coordinate and organize ships and personnel of maritime law enforcement teams of coastal local people's governments to participate in major maritime law enforcement actions.
