Article 2 These regulations shall apply to flood control work and flood control-related activities within the jurisdiction of this province. Article 3 Flood control work shall implement the principles of comprehensive planning, overall consideration, prevention first, comprehensive management, and local interests subordinate to overall interests. Article 4 Flood control work shall be subject to a government administrative head responsibility system, a system of unified command, hierarchical and sub-department responsibility for implementation, and a system of integrating river basin management and regional management. Article 5 Flood control work shall adhere to the combination of engineering measures and non-engineering measures.

Local people's governments at or above the county level should incorporate the construction of flood control engineering facilities into national economic and social development plans, and rely on science and technology to establish and improve non-engineering systems such as flood warning systems and flood control command and decision-making systems.

Local people's governments at or above the county level should strengthen publicity and education on flood prevention to the whole people and raise their awareness of flood prevention. Article 6 Flood control project costs shall be raised in accordance with the law in accordance with the principle of combining government investment with reasonable responsibilities of beneficiaries.

Article 7 The water administrative departments of local people's governments at or above the county level, under the leadership of the people's governments at the same level, are responsible for the organization, coordination, supervision, guidance and other daily work of flood prevention within their respective administrative regions. Other relevant departments of the local people's governments at or above the county level are responsible for relevant flood control work according to their respective division of responsibilities. Article 8 All units and individuals have the obligation to protect flood control engineering facilities and participate in flood prevention and fighting in accordance with the law.

Units and individuals that have made outstanding achievements in flood prevention and relief shall be commended by the local people's governments at or above the county level. Chapter 2 Flood Control Planning Article 9 The water administrative department of the local people's government at or above the county level shall, together with relevant departments, prepare a flood control plan for the administrative region based on the comprehensive water resources planning of the basin, the flood control plan and the comprehensive water resources planning of the region, and submit it to the same level. The people's government shall approve it and report it to the water administrative department of the people's government at the next higher level for record.

Article 10 River flood control plans shall be prepared by the water administrative department of the local people's government at or above the county level in conjunction with relevant departments and regions at the same level in accordance with the following provisions, and shall be submitted to the people's government at the same level for approval, and shall be reported to the water administrative department of the people's government at the next higher level for record:

(1) The flood control plan for first- and second-level rivers shall be prepared by the water administrative department of the Provincial People’s Government;

(3) The flood control plan for fourth-level rivers and fifth-level rivers shall be prepared by the water administrative department of the county (city, district) People's Government.

The flood control plan for rivers across administrative regions shall be prepared by the water administrative department of the people's government at the next higher level.

After receiving the opinions of the department, it shall be submitted to the water administrative department of the people's government of the districted city for approval. Article 12 River sand mining planning shall be subject to flood control safety, consistent with comprehensive river basin planning and professional plans such as flood control, river regulation and navigation regulation, and shall be connected with mineral resources planning. The river sand mining plan should include the following contents:

(1) Prohibited mining areas and allowable mining areas;

(2) Prohibited mining periods and allowable mining periods;

(3) The total annual controlled sand mining volume;

(4) The controlled number of sand mining vessels in the mining area;

Article 13 The regulation plan for the estuaries of rivers and seas shall be formulated by the water administrative department of the local people's government at or above the county level in conjunction with the ocean administrative department, waterway management agency, and maritime management agency.
