In violation of the provisions of these Regulations, the construction unit of residential properties fails to select property service enterprises through bidding or uses agreement to select employees without approval. For property service enterprises, the real estate administrative department of the local people's government at or above the county level shall order them to make corrections within a time limit, give them a warning, and may impose a fine of not more than 100,000 yuan.

Anyone who violates the provisions of these regulations and engages in property management without obtaining a qualification certificate shall have his illegal gains confiscated by the real estate administrative department of the local people's government at or above the county level, and shall be fined not less than RMB 50,000 but not more than RMB 200,000; If it causes losses to the owner, it shall be liable for compensation in accordance with the law.
