Article 2 The Kaifeng City Wall referred to in these Regulations refers to the existing Ming and Qing Dynasty City Walls in Kaifeng City, including walls, city gates, ancillary buildings and underground ruins, etc. Article 3 These Regulations apply to the protection and management of the Kaifeng City Wall, its protection scope, and construction control zones. Article 4 The protection scope of the Kaifeng City Wall refers to the area where key protection is implemented within a certain range of the city wall itself and its surroundings.

The construction control zone of Kaifeng City Wall refers to the area outside the protection scope where construction projects are restricted to protect the safety, environment and historical features of the city wall.

The protection scope and construction control zone of Kaifeng City Wall shall be implemented in accordance with the scope approved by the Provincial People's Government. Article 5 The Provincial People's Government shall strengthen its leadership over the protection and management of Kaifeng City Wall.

Relevant departments of the Provincial People's Government should strengthen guidance on the protection and management of Kaifeng City Wall. Article 6 The Kaifeng Municipal People's Government shall incorporate the protection and management of Kaifeng City Wall into the national economic and social development plan, the city's overall plan and the Kaifeng historical and cultural city protection plan, and include protection funds in the fiscal budget. Article 7: Encourage citizens, legal persons and other organizations to establish the Kaifeng City Wall Protection Fund through donations, etc., specifically for the protection of the Kaifeng City Wall. Article 8: The Kaifeng Municipal Cultural Relics Administration Department is responsible for the protection and management of Kaifeng City Wall. The district people's governments where the Kaifeng City Wall is located and the Kaifeng Municipal Public Security, urban and rural construction planning, land and resources, urban management, environmental protection, industry and commerce, tourism, civil air defense and other relevant departments shall do a good job in Kaifeng within the scope of their respective responsibilities. Protection and management of city walls. Article 9: Kaifeng city wall protection shall implement an expert consultation system.

The Kaifeng Municipal People's Government should establish an expert consultation database and listen to expert opinions when formulating the Kaifeng City Wall protection plan, approving construction projects related to the Kaifeng City Wall, and deciding on other major matters related to the Kaifeng City Wall protection. Article 10 Citizens, legal persons and other organizations have the obligation to protect the Kaifeng City Wall in accordance with the law, and have the right to report and stop the destruction and damage of the Kaifeng City Wall.

Departments and units responsible for protecting the Kaifeng City Wall shall promptly investigate and deal with the report in accordance with the law after receiving the report. Article 11 The Kaifeng Municipal People's Government shall set up Kaifeng City Wall protection signs at prominent locations within the protection scope of the Kaifeng City Wall and other areas where the public needs to be reminded.

The Kaifeng City Wall protection sign should indicate the name, construction year, protection level, protection scope, and construction control zone of the Kaifeng City Wall. Article 12 The reinforcement, repair and restoration project of the Kaifeng City Wall and its ancillary facilities shall be organized by the Kaifeng Municipal Cultural Relics Administration Department to formulate a plan and be implemented after completing relevant procedures in accordance with relevant regulations. Article 13 The Kaifeng City Wall Protection and Management Agency shall conduct daily maintenance and monitoring of the Kaifeng City Wall and establish logs; if any safety hazards are discovered, control measures shall be taken immediately and reported to the Kaifeng Municipal Cultural Relics Administration Department in a timely manner. Article 14 The following behaviors are prohibited within the protection scope of Kaifeng City Wall: (1) Hanging, posting, and writing advertisements or slogans on the city wall and ancillary buildings without authorization;

(3) Damaging and moving the city wall protection signs without authorization;

(6) Storing flammable and explosive items;

Article 15 No construction projects or blasting, drilling, excavation and other operations unrelated to the protection of the city wall shall be carried out within the protection scope of the city wall; if it is necessary to carry out other project construction or blasting, drilling, excavation and other operations within the protection scope of the city wall due to special circumstances, The safety of the Kaifeng City Wall must be ensured and approved by the Provincial People's Government. The approval of the cultural relics administration department of the State Council must be obtained before approval.

Article 16 The existing buildings and structures within the protection scope of Kaifeng City Wall that have nothing to do with the protection of the city wall shall be dealt with in accordance with the following provisions:

(1) Any illegal construction without approval shall be handled in accordance with laws and regulations. Demolition is stipulated;

(2) If the construction is approved, it shall not be renovated, reconstructed or expanded; if it endangers the safety of the Kaifeng city wall or damages the historical style of the city wall, the Kaifeng Municipal People's Government shall determine it in accordance with the provisions of relevant laws and regulations. demolition and compensation in accordance with the law. Article 17 Construction projects carried out within the Kaifeng City Wall Construction Control Zone shall comply with the Kaifeng City Wall Protection Plan and shall not damage the historical features of the Kaifeng City Wall. The engineering design plan shall be obtained from the State Council before being submitted to the Kaifeng City Urban and Rural Construction Planning Competent Department for approval. The cultural relics administration department agreed. Article 18: For scattered cultural relics such as bricks and inscriptions from the Kaifeng City Wall, the Kaifeng Municipal Cultural Relics Administration Department shall promptly recover them, and citizens, legal persons and other organizations shall cooperate.
