New provisions of the law on the protection of retired soldiers

The Law of People's Republic of China (PRC) on the Protection of Veterans came into force on 202 1 1.

The Law on the Protection of Retired Soldiers in People's Republic of China (PRC) has many highlights.

1. The local people's government should hang glory cards for the families of veterans and carry out regular visits and condolence activities.

2. When the state, local governments and the armed forces hold major celebrations, representatives of retired military personnel shall be invited to participate.

When participating in major celebrations, the invited retired military personnel can wear the standard clothing when they retired, and wear medals, medals, commemorative medals and other badges obtained during their active service and after retirement.

3. The state pays attention to giving full play to the active role of retired military personnel in patriotic education and national defense education activities. Organs, mass organizations, enterprises, institutions and social organizations may invite retired soldiers to assist in patriotism education and national defense education. The education administrative department of the people's government at or above the county level may invite retired soldiers to participate in national defense education and training in schools, and schools may employ retired soldiers to participate in military training for students.

4. The local people's governments at or above the county level shall be responsible for the work of local chronicles, and the names and deeds of the following ex-servicemen within their respective administrative areas shall be compiled into local chronicles:

(1) Retired soldiers who participated in the war;

(2) Retired military personnel who have won awards above Class II;

(3) Retired soldiers who have been commended at or above the provincial or ministerial level;

(4) Other qualified veterans.

The state advocates the construction of military cemeteries. Qualified veterans can be buried in military cemeteries after their death.

6. The competent department of retired military personnel of the people's government at or above the county level shall establish and improve the mechanism for safeguarding the rights and interests of retired military personnel, smooth the channels for expressing their demands, and provide support and help for the maintenance of the legitimate rights and interests of retired military personnel. The legitimate rights and interests of retired military personnel are infringed upon and should be resolved according to law. Relevant institutions of public legal services shall provide legal aid and other necessary help to ex-servicemen according to law.

7. Retired soldiers who violate the law and commit crimes shall be suspended, reduced or cancelled by the competent department of retired soldiers of the provincial people's government in accordance with the relevant provisions of the state, and reported to the competent department of retired soldiers in the State Council for the record.

Retired soldiers who are dissatisfied with the decision made by the competent department of retired military personnel of the provincial people's government to suspend, reduce or cancel their retirement-related treatment may apply for administrative reconsideration or bring an administrative lawsuit according to law.

This law shall come into force as of the date of 20211.
