Is it illegal to curse others?

Curse others for breaking the law. Swearing others, if the circumstances are serious, is suspected of insulting. This kind of crime can only be dealt with if it is told, except those that seriously endanger social order and national interests. According to the law, whoever publicly insults others by violence or other means or fabricates facts to slander others, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights.

The elements to determine the crime of insult are:

1, object elements, the object of this crime is the personal dignity and reputation of others;

2, objective elements, this crime is objectively manifested as publicly insulting the personality and reputation of others by violence or other means, and the circumstances are serious;

3, the main elements, the subject of this crime is a general subject, reaching the age of criminal responsibility and having criminal responsibility ability;

4. Subjective elements, this crime has subjective intention.

Legal basis: Article 246th of the Criminal Law of People's Republic of China (PRC).

Whoever publicly insults others by violence or other means or fabricates facts to slander others, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights.

The crimes mentioned in the preceding paragraph, except those that seriously endanger social order and national interests, can only be dealt with by telling.

If the victim informs the people's court of the acts specified in the first paragraph through the information network, but it is really difficult to provide evidence, the people's court may request the public security organ to provide assistance.
