What is organized crime?

Anti-organized crime work should adhere to the combination of special work and mass line, special governance and systematic governance, anti-corruption and strengthening the construction of grassroots organizations, and combine punishment and prevention. The Law on Combating Organized Crime requires that the mechanism for combating organized crime and the prevention and control system of organized crime should be established and improved, and people's governments at all levels should incorporate the prevention and control of organized crime into the evaluation system. The Central Committee of the Communist Party of China has set up a national leading group for eliminating evils and its office, and party committees and relevant departments at all levels have retained corresponding institutions, which embodies the spirit stipulated by law. The Law on Combating Organized Crime has also established a series of specific working mechanisms, such as the working mechanism for preventing organized crime from infringing on minors and the governance mechanism of key industries.

1. Under any of the following circumstances, the punishment may be lenient according to law, but it shall be strictly applied to the organizers and leaders of organized crime:

1, which provides important clues or evidence for finding out the organizational structure of criminal organizations and the status and role of organizers, leaders and ringleaders;

2 to provide important clues or evidence for the identification of criminal organizations to commit major crimes;

3 to provide important clues or evidence for investigating and dealing with organized crimes committed by state functionaries.

Two, the property involved in any of the following circumstances, shall be recovered and confiscated according to law:

1. Providing property to organized criminal organizations and their members to support or finance organized criminal activities;

2. The part of the family property of members of an organized criminal organization that is actually used to support organized criminal activities;

3, the use of organized criminal organizations and their members to carry out illegal and criminal activities of the property and its fruits and interests.

Legal basis: Article 3 of the Law of People's Republic of China (PRC) on Combating Organized Crime should adhere to the overall concept of national security, and comprehensively use legal, economic, scientific, technological, cultural and educational means to establish and improve the working mechanism for combating organized crime and crack down on organized criminals.
