Article 4 The sign of the Red Cross has the functions of protection and identification, and shall not be confused. Article 5 Local people's governments at various levels shall, in accordance with these Measures, supervise and administer the use of the Red Cross symbols within their respective administrative areas. The local Red Cross Societies at various levels shall assist the people's governments at the corresponding levels to supervise and manage the use of the Red Cross symbols. Chapter II Protective Use of the Red Cross Symbol Article 6 The protective use of the Red Cross Symbol means that in an armed conflict, all parties to the conflict must protect and respect the personnel wearing the Red Cross Symbol, the places marked with the Red Cross Symbol, their articles and medical transportation tools in accordance with the provisions of these Measures. Article 7 When the Red Cross is used as a protective symbol, nothing shall be added. When the Red Cross is used as a protective symbol, if it is used on the flag, it shall not touch the edge of the flag; If it is used on the armband, the red cross should be placed in the middle of the armband; If it is used in buildings, the red cross sign should be placed in a prominent position at the top of the building. When the red cross is used as a protective symbol, it should be identified as far away or in different directions as possible; At night or when visibility is low, lights should be used for lighting or decorated with luminous objects. Article 8 In armed conflict, the following persons may use the protective Red Cross symbol: (1) medical personnel in the army and staff of medical institutions; (2) Staff and medical personnel of the Red Cross; (3) Staff and medical personnel of the International Red Cross and foreign Red Cross organizations approved by the State Council or the Central Military Commission (CMC); (4) Medical personnel and staff on military and civilian medical transport vehicles; (five) the medical staff of domestic and foreign voluntary rescue groups and private medical institutions approved by the State Council or the Central Military Commission. Article 9 In armed conflict, the following institutions or organizations, their places, articles and medical transport vehicles may use the protective Red Cross emblem: (1) Military medical institutions; (2) The Red Cross participates in relief activities; (3) Voluntary rescue organizations and medical institutions at home and abroad approved by the State Council or the Central Military Commission; (4) International organizations approved by the State Council or the Central Military Commission (CMC). Article 10 Persons who use the protective Red Cross sign must carry the identity certificate issued by the department authorized by the State Council or the Central Military Commission (CMC). Article 11 The personnel, places, articles and medical transport vehicles of military medical institutions may be marked with protective Red Cross signs in peacetime. Chapter III Significant Use of the Red Cross Symbol Article 12 The significant use of the Red Cross Symbol refers to the marking of people or things related to Red Cross activities. Chapter V Punishment Article 19 The Red Cross Society has the right to dissuade anyone who violates the provisions of these measures in any of the following circumstances and ask him to stop using it; If it refuses to stop using it, the Red Cross Society may request the people's government to order it to stop using it: (1) People other than Red Cross staff, members and young members use the distinctive Red Cross logo; (two) the use of the obvious Red Cross sign in buildings and other places where the Red Cross sign is not used; (3) Medical institutions other than the Red Cross use distinctive Red Cross symbols; (4) Articles and means of transport that do not belong to the Red Cross use the marked Red Cross symbol; (five) there are other situations in which the Red Cross sign is used in violation of the provisions of these measures. Twentieth in violation of the provisions of article eighteenth of these measures, unauthorized use of the Red Cross sign, the people's governments at or above the county level shall be ordered to stop using, confiscate the illegal income, and impose a fine of 1000 yuan. Chapter VI Supplementary Provisions Article 23 Matters not involved in the protection and use of the Red Cross symbols in these Measures shall be implemented in accordance with the relevant provisions of the Geneva Conventions and their Additional Protocols. The Geneva Conventions and their Additional Protocols mentioned in the preceding paragraph refer to the conventions and protocols stipulated in Article 27 of the Law of the People's Republic of China on the Red Cross Society. Article 24 These Measures shall come into force as of the date of promulgation.
