Measures of Kunming Municipality on the Administration of Pedestrian Overpass

Article 1 In order to strengthen the construction and management of footbridges, ensure the integrity of footbridges, give full play to their functions, and promote the economic and social development of our city, these measures are formulated in accordance with relevant laws and regulations such as the Regulations on the Administration of Urban Roads in the State Council and the Regulations on the Administration of Urban Roads in Kunming, combined with the actual situation of our city. Article 2 All units and individuals engaged in the construction, maintenance and management of footbridges within the urban planning area of Kunming shall abide by these measures.

The term "footbridge" as mentioned in these Measures refers to the structure with certain technical conditions erected on urban roads for pedestrians to cross the street. Article 3 Kunming Public Utilities Bureau is the administrative department in charge of overpass management within the urban planning area of this Municipality, and is responsible for the industrial management of overpasses within the urban planning area of this Municipality. Article 4 Overpass construction shall follow the principles of unified planning, rational layout and convenience for the masses. Site selection should be carried out in strict accordance with the opinions of the planning department. Fifth overpass construction funds can be raised through government investment, transfer of overpass advertising rights, naming rights and benefit investment. Sixth overpass construction funds by the management department unified management, earmarked for overpass construction and maintenance, and accept the supervision of the financial department at the same level. Article 7 After the overpass invested by the government is approved by the planning department, the administrative department shall organize the construction. Units that invest in the construction of overpasses must go through the examination and approval procedures at the planning department, and can only start construction after being approved by the administrative department; After the completion of the overpass, the construction unit shall submit the completion drawing to the administrative department, and the administrative department shall participate in the acceptance before putting it into use. Article 8 The maintenance of the overpass shall be undertaken by the property right unit or the relevant departments entrusted by it, and the overpass granted the right to publish advertisements shall be undertaken by the transferee or the departments entrusted by it. Ninth overpass management units shall establish and improve the overpass maintenance and safety management system, ensure the cleanliness of the bridge and the safety of pedestrians, and accept the supervision and inspection of the administrative department. Tenth pedestrian bridge facilities within the scope of cleaning, in principle, according to the relevant provisions of Kunming city appearance and environmental sanitation to the environmental health department for cleaning. If the overpass built by the unit or the advertising right has been transferred, it shall be responsible for cleaning or entrust the relevant departments to clean it according to the requirements of city appearance and environmental sanitation, and accept the supervision and inspection of the city appearance management department. Eleventh overpass within the scope of the following acts are prohibited:

(1) Setting up billboards and other hanging objects without authorization;

(two) occupy the footbridge facilities to set up stalls and pile up items;

(three) the construction of buildings or other structures that affect the function and safety of the overpass in the overpass safety protection zone;

(four) motorcycles, human tricycles in the overpass;

(five) riding and sliding bicycles on the overpass;

(six) unauthorized use of overpasses to lay pipelines or install other facilities;

(seven) over and over the overpass railing;

(eight) other acts of damage and occupation of overpass. Twelfth in the premise of ensuring the normal function of overpass facilities and the safety of vehicles and pedestrians, with the consent of the administrative department, you can use overpass facilities to set up advertisements in accordance with the relevant provisions of the "Regulations on the Administration of Outdoor Advertising in Kunming". Thirteenth overpass naming rights and advertising rights can be transferred. After the transfer, the naming rights and advertising rights may not be transferred again.

Investors can share the advertising revenue of Tianqiao in proportion to their investment, or they can obtain the advertising rights by one-time investment. Specific matters shall be determined through consultation between investors and management departments. Fourteenth need to set up commercial advertisements within the scope of overpass facilities, must go through the formalities with the relevant departments in accordance with the relevant provisions of the "Regulations on the Administration of Outdoor Advertising in Kunming", before setting up. The location, area and time of occupying the overpass must be approved by the property right unit, reported to the administrative department for approval, and paid to the property right unit before use. Fifteenth approved occupation of overpass advertising, shall not be set higher than the overpass guardrail closed advertising. In principle, the materials used in advertising should be light materials and set according to the requirements of the design bearing capacity of the overpass.

In the past, overpass advertisements that did not meet the requirements of the above specifications were cleaned up by the administrative department and put forward opinions, which were reported to the Kunming Municipal People's Government for approval before implementation. Sixteenth overpass occupation units shall use the overpass and set up advertisements in accordance with the approved time limit and specifications. After the expiration of the use period, the overpass shall be restored to its original state in time, and the damaged overpass shall be repaired or compensated. Seventeenth according to the needs of urban management, the examination and approval authorities can change and terminate the occupation of overpass scale and duration, users must unconditionally obey, property units must refund the remaining use fees. Eighteenth national holidays and major provincial and municipal activities, overpass management units must obey the arrangement of the administrative department, the obligation to hang relevant slogans. Nineteenth the use of overpasses to hang political propaganda slogans must be approved by the Propaganda Department of the Municipal Party Committee and reported to the competent department for approval before hanging. Twentieth in violation of these measures, one of the following acts, by the Kunming Municipal Public Utilities Bureau depending on the seriousness of the case, be punished:

(a) without the approval of the administrative department, unauthorized construction of overpass, shall be ordered to dismantle, and impose a fine of 20000 ~ 30000 yuan;

(two) if the overpass is put into use without acceptance, a fine of less than 2% of the project cost shall be imposed;

(three) if the overpass is not maintained according to the regulations, it shall be ordered to make corrections within a time limit, and if losses are caused, it shall be responsible for compensation;

(4) Those who use the overpass to set up advertisements without the approval of the administrative department shall be given a warning, ordered to dismantle it within a time limit, and fined 100 ~ 1000 yuan for the responsible person and 10000 ~ 20000 yuan for the unit;

(five) in violation of these measures, set up stalls on the overpass, shall be ordered to make corrections, refused to make corrections, and impose a fine of 50 ~ 200 yuan;

(six) in violation of the provisions of Item (3) of Article 1l of these Measures, it shall be ordered to make corrections within a time limit, and the responsible person shall be fined 100 ~ 200 yuan, and the responsible unit shall be fined 10000 ~ 20000 yuan, and if losses are caused, it shall be responsible for compensation;

(seven) in violation of the provisions of Item (6) of Article1/kloc-0 of these Measures, the unit shall dismantle it within a time limit and impose a fine of 1000 yuan;

(eight) in violation of the provisions of article 1 1 (7) of these measures, give a warning;

(nine) in violation of the provisions of the first paragraph of Article 13 of these measures, it shall be ordered to make corrections, confiscate the illegal income, and impose a fine of less than 3 times the illegal income, with a maximum of 30,000 yuan;

(ten) in violation of the provisions of article 15 and 16 of these measures, it shall be ordered to make restitution and be responsible for compensating the losses caused;
