First-class appraisal standard for minor injuries

The criteria that constitute the minor injury level are as follows:

3. Skull depression or comminuted fracture;

4. Skull base fracture with cerebrospinal fluid leakage;

5, brain contusion;

6. Intracranial hemorrhage;

7. Chronic intracranial hematoma;

8. Traumatic subdural effusion.

The judgment and compensation for minor injuries are as follows:

1. If the crime of intentional injury causes minor injuries, it is generally fixed-term imprisonment of not more than three years, public surveillance or criminal detention;

2. If the result of forensic identification is minor injury, the other party will constitute a criminal offence. The police station will investigate the case clearly and submit it to the procuratorate, and then the procuratorate will initiate a public prosecution and investigate the criminal responsibility of the other party. Generally, the crime of intentional injury is sentenced to fixed-term imprisonment of not more than three years, public surveillance or criminal detention;

3. The injured party may also file an incidental civil lawsuit, demanding compensation from the other party for medical expenses, nutrition expenses, transportation expenses, nursing expenses, lost time, compensation for mental damages and other expenses. The specific compensation standard depends on whether the injury constitutes a civil disability level, and then the specific compensation amount is calculated according to the disability level, specific losses and local economic development level.
