How soon will the defendant be notified after the appeal?

Legal analysis: In theory, the defendant usually receives a summons within 7 days after filing a case, but in real life, how long it takes to receive a summons after filing a case is generally controlled, usually within 10 day to one month. After the case is filed, the defendant should be summoned first, and the plaintiff will be notified only after the defendant is notified. In other words, the defendant should be informed by phone first. If the notice cannot be served by direct service, lien service, entrusted service or mail service, the summons will be served by announcement. Announcement refers to the service of summons through newspapers 60 days after the date of announcement.

Legal basis: Article 125 of the Civil Procedure Law of People's Republic of China (PRC), the people's court shall send a copy of the complaint to the defendant within five days from the date of filing the case, and the defendant shall submit a reply within fifteen days from the date of receiving the complaint. The written defense shall specify the name, sex, age, nationality, occupation, work unit, domicile and contact information of the defendant, the name and domicile of the legal person or other organization, and the name, position and contact information of the legal representative or principal responsible person. The people's court shall send a copy of the defense to the plaintiff within five days from the date of receiving the defense.
