Article 2 These Measures shall apply to the business activities, supervision and management of online booking of taxis (hereinafter referred to as online booking) within the administrative area of Foshan City.

Article 3 Our city insists on giving priority to the development of urban public transport, moderately developing taxis, developing online taxis in a coordinated, standardized and orderly manner, and implementing classified management of online taxis and cruise taxis (hereinafter referred to as cruise taxis) to achieve coordinated development of dislocation and provide citizens with high-quality and diversified travel services. The freight rate of the network car is subject to market adjustment.

Article 4 The rental capacity of the network car in this Municipality shall conform to the traffic development planning and traffic function orientation of this Municipality, adapt to the road traffic carrying capacity of this Municipality, and coordinate with public transportation and cruise car travel services.

Article 5 The municipal transportation department is the administrative department in charge of online car rental in this Municipality, responsible for the management of online car rental in this Municipality and organizing the implementation of these Measures.

The competent transportation departments of all districts shall, in accordance with the authority prescribed in these Measures, carry out daily management, supervision and inspection of the network car in the administrative area at the corresponding level.

The municipal public security organ shall check the background of the drivers and vehicles of the network car according to law, and supervise and manage the network car according to the statutory duties.

Article 6 The municipal department in charge of transportation shall establish a dynamic monitoring mechanism for the scale of the network car industry, regularly publish a special blue book in combination with urban road traffic operation indicators and development trends, environmental and space protection, regional traffic development and other factors, timely implement the dynamic incremental management of the network car capacity, and announce the delivery adjustment plan, so as to develop the network car in an orderly manner.

The municipal departments of industry and information technology, commerce, market supervision, human resources and social security, taxation, online information, the People's Bank of China, finance and other departments shall supervise and manage the online car-related business in accordance with their statutory duties.

Chapter II Business License

Section 1 Network Car Platform Company

Article 7 Anyone who applies to engage in the operation of the online car rental platform shall obtain the online car rental business license issued by the municipal transportation department.

Article 8 To apply for the operation of online carpooling platform, the following conditions shall be met:

(1) Having the qualification of an enterprise legal person;

(2) Having the Internet platform and interactive processing capability of information and data for automobile-related online business suitable for the business to be carried out, and having the conditions for relevant regulatory authorities such as transportation, communication, public security, taxation and online information to search and query relevant network data and information according to law. The data of the network service platform is transmitted to the online supervision information interaction platform of the Ministry of Transport to ensure that the access data is true, complete, standardized and timely. The server is located in the mainland of China, and it has a network security management system and security protection technical measures that meet the requirements.

(3) Where electronic payment is used, an agreement shall be signed with banks and non-bank payment institutions to provide payment and settlement services;

(four) a sound management system, production safety management system and service quality assurance system;

Article 9 If a foreign enterprise as a legal person applies for operating the online car-hailing platform, it shall submit the power of attorney that the enterprise as a legal person authorizes the service institution of this Municipality to undertake the online car-hailing service of this Municipality.

Article 10 Anyone who applies for operating an online carpooling platform shall apply to the local district and county transportation authorities and submit the relevant materials stipulated in Articles 8 and 9 of these Measures. After receiving the relevant application materials, the district transportation department shall complete the preliminary examination within 5 working days and send it to the municipal transportation department for examination and approval. After receiving the materials submitted by the district transportation department, the municipal transportation department shall make a decision on approval or disapproval within 15 working days. If no decision can be made within the above-mentioned time limit, with the approval of the person in charge of the municipal transportation department, it may extend 10 working days, and inform the applicant in writing of the reasons for the extension.

Article 11 If the municipal transportation department makes an administrative licensing decision on the application for booking a taxi online, it shall issue a business license for booking a taxi online, and specify in the business license for booking a taxi online that the business scope is booking a taxi online, and the business area is the administrative area of this Municipality, valid for 5 years; If an online car platform company that does not meet the prescribed conditions applies for a decision not to grant an administrative license, it shall issue a decision not to grant an administrative license to the applicant.

Article 12 A network taxi booking platform company can carry out related business only after obtaining the corresponding network taxi booking license and applying for Internet information service for filing with the provincial transportation authorities where the enterprise is registered. The contents of the record include the real identity information of the operator, access information, and the "Network Appointment Taxi Business License" issued by the taxi administrative department.

The network car platform company shall go to the municipal public security organ for filing within 30 days from the date of formal networking.

Article 13 If the network car platform company suspends or terminates its operation, it shall submit a written report to the municipal transportation department 30 days in advance to explain the relevant situation, notify the owner and driver of the access vehicle, and make an announcement to the public through the local mainstream media. If the network car platform company terminates its operation, it shall return the corresponding "Network Appointment Taxi Business License" to the municipal transportation department within 3 days from the date of termination. If it is not returned within the time limit, the municipal transportation department shall clearly record it and announce it to the public.

Before the expiration of the business license 30 days ago, the network car platform company can submit the application materials for the continuation of business to the municipal transportation department in accordance with the provisions of Articles 8 and 9 of these Measures, and the municipal transportation department will make a decision on whether to approve the extension before the expiration of the license.

Section 2: Vehicles and drivers of the network car

Article 14 A vehicle that intends to engage in online rental car business shall meet the following conditions in addition to the conditions stipulated in the Interim Measures for the Administration of Online Rental Car Business Services:

(a) New energy vehicles with 7 seats or less, with a wheelbase of not less than 2,650 mm. ..

(3) It is less than two years from the date of first registration and obtaining a motor vehicle driver's license to the date of applying for online booking of a taxi transport license.

(5) The network car shall not be equipped with overhead lights, empty lights and other service facilities and equipment similar to cruise cars, and meet the requirements of the competent departments of transportation, public security, publicity and civilization on the appearance of the car body.

(VI) Vehicles shall be equipped with on-board service terminals that meet the technical requirements of the municipal transportation department, and have the functions of satellite positioning with driving record function, service platform server for online car service, driver identification, service evaluation, etc. , and directly connected with the municipal government supervision platform.

Fifteenth vehicles that meet the conditions stipulated in Article fourteenth, the owner shall meet the following conditions when applying for the "Network Booking Taxi Transport Certificate":

Article 16 To apply for booking a taxi transport permit online, the applicant shall submit the following materials to the district transportation department where the vehicle owner's address is located:

(1) Application Form for Online Appointment of Taxi Transport Certificate and Application Form for Change of Vehicle Use Nature;

(2) Signing a letter of intent for network operation with a qualified network car platform company, specifying the platform operation commission and service charging standard;

(3) For the vehicle that has been registered as a motor vehicle, submit the original (inspection) and photocopy of the motor vehicle driving license and motor vehicle registration certificate, two color photos of the vehicle and photo electronic documents;

(four) the original (verification) and photocopy of the vehicle certificate submitted by the newly purchased vehicle, two color photos of the vehicle and the electronic documents of the photos;

(five) the vehicle model and standard configuration certification materials, which meet the technical requirements of the municipal transportation department in charge of vehicle service terminal installation technical certification materials;

(6) If the vehicle owner is an enterprise legal person, submit the original (inspection) and photocopy of the resident ID card of the agent, the original (inspection) and photocopy of the business license of the enterprise legal person (if it belongs to a branch, submit the business license of the branch), and a description of the road traffic accidents of the enterprise in the past year;

(7) If the vehicle owner is an individual, submit the original (inspection) and photocopy of the vehicle owner's resident identity card, the original (inspection) and photocopy of the online taxi driver's card issued by this Municipality, and the description of the road traffic accidents that occurred in the last three consecutive scoring cycles;

(eight) if the vehicle owner entrusts the network car platform company to apply for it, it shall also provide a valid entrustment agreement signed by both parties;

(nine) other materials required by laws, regulations and rules.

Article 17 The district transportation department shall complete the preliminary examination within 3 working days after receiving the application materials for the transportation license of the network car, and send them to the municipal transportation department; The municipal transportation department shall review the materials submitted by the district transportation department within 5 working days, and send the vehicle information to the municipal public security organ for review after the review; After receiving the vehicle information copied by the municipal transportation department, the municipal public security organ shall complete the audit within 8 working days and give feedback to the municipal transportation department. For vehicles that meet the requirements after examination, the municipal transportation department shall issue a certificate of change of vehicle registration to the applicant. The applicant holds the certificate of vehicle registration change and related materials to the vehicle management department of the municipal public security organ to register the change of vehicle use nature, and then to the district transportation department to obtain the certificate of network booking taxi transportation.

Article 18 If the owner's qualification or business license of an enterprise as a legal person is revoked, revoked or cancelled, it shall quit the operation, and the municipal transportation department shall cancel the corresponding network reservation taxi transportation certificate, and cooperate with the vehicle management department of the municipal public security organ to change the nature of vehicle use.

If the owner of the online car-hailing vehicle withdraws from the online car-hailing service for some reason and reapplies for the online car-hailing operation, when applying for the online car-hailing transportation certificate again, in addition to meeting the conditions stipulated in Article 14 and Article 15, it is also necessary to check the service quality credit assessment and integrity record in the last online car-hailing service cycle. In the last three years, there are bad records of service quality, reputation and integrity, which will not be dealt with.

Nineteenth "network booking taxi transport certificate" is valid and linked to the service life of the vehicle, the longest not exceeding 8 years. Forced scrapping when the mileage of the network car reaches 600,000 kilometers; If the mileage has not reached 600,000 kilometers, but the service life has reached 8 years, it will quit the network car business, and the municipal transportation department will cancel the corresponding Network Booking Taxi Transport Certificate, and cooperate with the vehicle management department of the municipal public security organ to change the nature of vehicle use; Vehicles that quit the network car service will be scrapped when the mileage reaches 600,000 kilometers.

Twentieth vehicles that have obtained the "Network Booking Taxi Transport Certificate" may apply to the municipal transportation department for the change registration of the "Network Booking Taxi Transport Certificate" when the ownership of the vehicle changes:

(a) where the owner of a motor vehicle is changed into an enterprise, the applicant shall comply with the provisions of the first paragraph of Article 15 of these Measures, and after changing the motor vehicle driving license, apply to the municipal transportation department for the change procedures.

(two) if the owner of a motor vehicle is changed to an individual, it shall comply with the provisions of the second paragraph of Article 15 of these Measures, and apply to the municipal transportation department for change after changing the motor vehicle driver's license.

The municipal transportation department shall make a decision on whether to approve the change within 15 working days from the date of receiving the application for change. If the license is changed, it shall go through the change registration of the Network Booking Taxi Transport Certificate.

Twenty-first drivers engaged in online car rental services shall meet the following conditions in addition to the conditions stipulated in the Interim Measures for the Administration of Online Booking Taxi Management Services:

(a) with the city's household registration or residence permit;

(two) the examination institutions confirmed by the municipal transportation department have passed the examination, are familiar with the human geography of Foshan, and master the passenger service and safety emergency skills;

Those who have obtained the qualification of touring car drivers in this city and are operating on the job, have served in this city for three years without any bad credit record, and the credit assessment of service quality in the last three years is AAA or above, can directly apply for an online taxi driver's license.

Twenty-second to apply for the "network booking taxi driver's license", it must be confirmed by the examination institution of the municipal transportation department, and the applicant shall submit the following materials to the district transportation department:

Application Form for Taxi Driver's Qualification Certificate;

(2) The original (inspection) and photocopy of the resident ID card (or residence permit) and motor vehicle driving license;

(3) Background statement: No traffic accident crime, dangerous driving crime record, drug abuse record, drunk driving record, no score of 12 for three consecutive scoring cycles recently, and no violent crime record;

(4) If the driver entrusts the network car platform company to apply on his behalf, he shall also provide a valid entrustment agreement signed by both parties;

(five) other materials required by laws, regulations and rules.

Twenty-third district transportation department shall complete the preliminary examination within five working days after receiving the application materials of online taxi drivers and send them to the municipal transportation department for approval. If the municipal transportation department decides to grant or disapprove the license within the statutory time limit, it shall issue a taxi driver's license for online reservation to the driver.

Twenty-fourth network car drivers should apply for qualification registration according to the "Regulations on the Administration of Taxi Drivers' Qualification".

Before the implementation of these measures, the online taxi driver's license obtained according to law will continue to be valid. Before the expiration of the validity period of the original certificate, you can apply to the municipal transportation department for a new certificate and register it according to the regulations.

Twenty-fifth municipal transportation departments shall, in conjunction with the municipal public security organs and other departments, establish an online joint audit mechanism for vehicles and drivers. The municipal public security organ shall check the taxi driver and vehicle information on the interactive network of the municipal transportation department, and feed back the driver's criminal record, driver's license information, traffic violation records and vehicles and other related information to the municipal transportation department. The municipal transportation department shall make a decision on whether to approve or not according to the information feedback from the municipal public security organ and the audit results of other conditions.

Chapter III Commercial Service Management

Article 26. The network booking taxi platform company shall bear the carrier's responsibilities, and shall take the following measures to ensure the operation safety and protect the legitimate rights and interests of passengers in addition to complying with the relevant management provisions of the Interim Measures for the Administration of Online Booking Taxi Management Services:

(1) Undertaking the main responsibility for service quality and safe production, establishing and improving the pre-job training and continuing education system for drivers of online car-sharing, regularly organizing drivers to carry out education and training on relevant laws and regulations, professional ethics, service standards and safe operation, and establishing training files; A regular vehicle inspection and maintenance system should be established, and technical files of vehicles should be established to ensure that vehicles are tested in accordance with regulations.

(II) Clarify service quality standards, make public service quality commitments, set up local service supervision and complaint handling institutions according to regulations, publish complaint methods and handling procedures such as service supervision telephone numbers, handle passenger complaints in a timely manner, inform passengers of the complaint handling results within the prescribed time limit, establish a complaint handling file system, and accept the complaint verification of the transportation authorities.

(3) It shall ensure that drivers who provide services have legal qualifications, and sign various forms of labor contracts or agreements with drivers in accordance with the provisions of relevant laws and regulations and the characteristics of working hours and service frequency, so as to clarify the rights and obligations of both parties. The contract or agreement shall not in any way reduce or exempt the carrier liability that the network car platform company should bear to passengers.

(5) Before providing online car service, the rights and responsibilities of all parties shall be made clear to passengers through electronic agreements and other means. The agreement should clarify the responsibilities of the network car operator in fulfilling transportation services, safety management and protecting users' personal information. The legal obligations in the service agreement shall not be exempted.

(six) to establish a regular inspection system for driver background information and safe driving information, and submit the driver and vehicle information to the municipal public security organ for background verification every quarter. If the problems existing in the verification no longer meet the requirements of the drivers and vehicles of the network car, the platform should get off the relevant drivers and vehicles in time, and urge to go through the formalities such as cancellation of documents. If the network car-sharing platform organizes private passenger car sharing at the same time, it should refer to the background check and regulatory requirements of the network car driver for network management.

Article 27 The network car platform company shall bring relevant operation data and vehicle service terminal data into government supervision, and abide by the following provisions:

(1) The platform operation data shall be transmitted to the vehicle-related supervision information interactive platform of the Ministry of Transport in a true, complete, standardized and timely manner as required, and the data transmission quality shall be ensured. Vehicle satellite positioning data with driving record function is directly connected to the municipal government supervision platform.

(2) Real-time dynamic monitoring of vehicle operation and service process is carried out through the online car platform and vehicle service terminal, and personal characteristic data such as the driver's portrait should be collected in real time during the operation period, and compared with the background personal identity information of the driver; The vehicle-mounted service terminal shall adopt the mainstream operating system compatible with the supervision and service software, and ensure the normal operation of the supervision and service software in the vehicle-mounted service terminal without interference.

(3) The online car-sharing platform shall have the functions of recording, retaining, inquiring and retrieving relevant data, and establish the working system and ability to cooperate with public security, transportation, taxation, market supervision, online information and other departments to retrieve and query relevant network data and information according to law.

Article 28 The application program of the online car-hailing platform shall have the following security service functions: the basic attribute information and location information of the vehicle and the driver can be shared in real time, and a third person confirmed in writing by the owner or passenger can check the dynamic location information of the vehicle at any time during the service; Personal telephone encryption function, passengers and drivers communicate through technical means; The "one-button call" function enables passengers to automatically send real-time dynamic information of vehicles and driver information to the network car platform company in an emergency.

The network car platform shall not push new operation demand scheduling information when the driver carries passengers.

Article 29 The platform company of online car rental shall reasonably determine the freight rate level and structure of online car rental, do a good job in publicizing the charging standards and service prices, and actively and truthfully announce the driver's income, the amount and rules of dispatching service charges, etc. , and update in time. The implementation of market subsidies, incentives, promotions and other acts shall comply with relevant laws and regulations.

If the departure place and destination of passengers are specified at the time of booking, the network car platform company shall estimate the fare according to the determined pricing rules and inform the passengers, list the bill details to the passengers after completing the service, and issue the taxi invoice of this city according to the network car operation service specification.

Thirtieth network car platform company shall declare and pay taxes to the tax authorities of this Municipality according to law.

Thirty-first in addition to the provisions of the Interim Measures for the Administration of Online Booking Taxi Management Services, online booking taxi drivers shall also comply with the following provisions:

(a) to maintain the vehicle service terminal in good condition, to ensure that the driving record, service evaluation and other functions are normal, and shall not be damaged or modified; If the function of the operating equipment fails, it can only be operated after the failure is eliminated.

(two) when operating, carry the "network booking taxi transport certificate" and "network booking taxi driver's card".

(three) according to the reasonable route or the route required by passengers, and shall not abandon passengers or deliberately detour.

(4) Vehicles shall not be handed over to personnel who have not obtained the qualification of network car, and personal network car shall not be handed over to others for operation.

(5) Do not parade to attract passengers, do not enter the special waiting station and driveway for parade vehicles, and do not attract passengers by other means than the information provided by the network car platform company.

(6) No other reservation business shall be undertaken when carrying passengers, and the information shall be fed back to the relevant platform through the client after carrying passengers.

Article 32 The online car platform can organize and implement the qualification examination and training for online car drivers by itself, and can apply for the qualification examination center for online car drivers in accordance with relevant regulations.

No enterprise or individual may provide information docking to vehicles and drivers who have not obtained legal qualifications to carry out network car service. It is not allowed to provide online car service in the name of private car sharing.

Chapter IV Supervision and Administration

Article 33 The departments of transportation, public security, industry and information technology, commerce, market supervision, human resources and social security, taxation, online information and the People's Bank of China at all levels in this Municipality shall establish and improve a joint supervision mechanism to jointly supervise illegal acts such as engaging in online carpooling business without obtaining the online carpooling business license, inconsistent online and offline vehicles or personnel, information disclosure, failure to pay taxes according to law, unfair competition, and payment and settlement of illegal operating funds.

(1) Those who engage in online car business activities without obtaining the online car business license or engage in online car business activities in disguised form shall be dealt with by the competent transportation department at or above the municipal level. If an online car platform company that has obtained the business license of online car has violated laws and regulations, it shall be dealt with according to law by the departments of transportation, public security, industry and information technology, commerce, market supervision, human resources and social security, taxation, online information and the People's Bank of China within their respective responsibilities. (3) If the above-mentioned illegal acts continue to occur after the carriers such as the mobile Internet application (APP) of the network car platform company are suspended from the shelves, the joint supervision department shall request the superior competent department to start the disposal process of stopping Internet services, networking or suspending business for rectification according to procedures.

Article 34 The transportation authorities shall make full use of passenger evaluation and government supervision information, regularly organize and carry out service quality evaluation and credit evaluation of network car drivers, and timely announce to the public the basic information, service quality evaluation results, passenger complaint handling, safety production, commitment and other information of the network car platform companies in this Municipality.

Article 35 When exercising the statutory powers such as administrative inspection and administrative law enforcement according to law, the municipal transportation department may retrieve and consult the relevant data and materials of the registration, operation and transaction of the car-hailing platform companies within its jurisdiction, compare and evaluate the reliability with the data of the municipal supervision platform, ensure the reliability of the data, and identify the illegal facts according to the traffic monitoring video data, car driving recorder, satellite positioning system and the information of the car-hailing platform companies retrieved according to law. The platform company must provide technical support and cooperation.

Thirty-sixth transportation departments should establish a platform, passengers and drivers complaint acceptance supervision system, announce the channels and methods of complaint acceptance, and investigate and handle complaints objectively and fairly.

If the network car company causes adverse effects due to illegal operation, failure to perform due diligence or improper safety and service management, the traffic management department shall order it to make rectification within a time limit. Overdue rectification, handled by the traffic management department according to law.

Thirty-seventh municipal finance department shall supervise and manage the financial leasing enterprises engaged in online car rental business according to law, and monitor their operating conditions and operating risks.

Article 38 The departments of public security, industry and information technology, network information and so on shall, according to their respective functions and duties, investigate and deal with the illegal collection, storage, processing and utilization of users' related information by network car platform companies, and violate the relevant provisions of telecommunications and Internet information services, endangering network and information security, using their service platforms to publish or disseminate harmful information, or providing convenience for enterprises, individuals and other organizations to publish or disseminate harmful information. The network car platform company identified by the relevant departments as having violated the law shall cooperate with the relevant departments to dispose of it according to law.

Article 39 The public security organ shall maintain public safety and social order according to law, conduct background investigation on the personnel and vehicles engaged in online car-hailing service or engaged in online car-hailing service in disguised form, investigate and deal with the illegal acts of platform management personnel who organize illegal operation, notify the relevant government departments, conduct safety risk assessment with relevant departments on the safety background of employees and the safety responsibility of the main body of the operating platform, and make it public; Supervise and inspect the implementation of the network security management system and safety protection technical measures of the network car platform company, prevent and investigate related illegal and criminal activities, and maintain social order and social stability according to law. When the public security organs carry out national security work according to law, they may ask the platform company to provide technical support and assistance to prevent and investigate illegal and criminal activities. The platform company shall truthfully submit data and information. If the platform company refuses to perform, it shall be handled by the public security organ according to law. Article 40 The market supervision department shall investigate and deal with price violations, unfair competition and violations of measurement laws and regulations during the operation of the network car platform company according to law. Illegal acts that infringe upon the legitimate rights and interests of workers shall be investigated and dealt with by the human resources and social security departments according to law; Acts that violate tax laws and regulations shall be investigated and dealt with by tax authorities according to law.

The People's Bank of China deals with banks and non-bank payment institutions that provide payment and settlement services in violation of regulations.
