Are court summonses delivered via SMS?
The court's summons for hearing can be served to the parties by text message.
However, there are many scammers in society now. If the text message does not clearly inform the main content such as the judge handling the case, the name of the plaintiff, the location of the hearing, etc., most of them are scammers.
Article 261 of the "Interpretation of the Supreme People's Court on the Application of the Civil Procedure Law of the People's Republic of China" stipulates: When applying simplified procedures to hear cases, the People's Court may adopt oral communication, Summon both parties, notify witnesses, and serve litigation documents other than judgment documents through simple means such as phone calls, text messages, faxes, and emails.
If a court hearing notice is delivered in a simple manner without confirmation by the party concerned or there is no other evidence to prove that the party has received it, the people's court shall not make a default judgment.
