Regulations of Jinzhong Municipality on the Administration of Kitchen Waste

Chapter I General Provisions Article 1 In order to strengthen the management of kitchen waste, promote the recycling of resources, maintain environmental sanitation, and ensure food safety and public health, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the generation, collection, transportation, treatment and related supervision and management activities of kitchen waste in the built-up areas of this Municipality and within the scope determined by the people's governments of counties (cities, districts). Article 3 The term "kitchen waste" as mentioned in these Regulations refers to the food residue, kitchen waste and waste edible oil produced in catering services, unit feeding and food production and processing activities other than residents' family life.

Kitchen waste generating units refer to units and self-employed households that generate kitchen waste in the process of production and operation. Article 4 The management of kitchen waste shall follow the principles of territorial management, centralized collection, transportation and specialized treatment, and realize the reduction, recycling and harmlessness of kitchen waste. Fifth city management department is responsible for the supervision and management of the generation, collection, transportation and treatment of kitchen waste in this city.

City, county (city, district) city appearance and environmental sanitation management department and city appearance and environmental sanitation administrative law enforcement department are responsible for the specific management and law enforcement of kitchen waste within their respective functions and duties.

Neighborhood offices and township (town) people's governments are responsible for the management of the collection and transportation of kitchen waste within their respective jurisdictions.

Food and drug supervision, industry and commerce, quality supervision, public security, environmental protection, health, animal husbandry and other relevant departments shall, according to their respective functions and duties, do a good job in the management of kitchen waste. Article 6 The urban management department of the city shall, jointly with relevant departments, formulate a plan for kitchen waste disposal facilities according to the overall urban planning and national economic and social development plan of this city, and incorporate it into the special plan for city appearance and environmental sanitation facilities of this city, and make overall arrangements for the investment, layout, land use and scale of kitchen waste collection, transportation and treatment facilities. Article 7 The catering trade association shall play the role of industry self-discipline, participate in the formulation of relevant standards, standardize industry behaviors, popularize technologies and methods to reduce the generation of kitchen waste, and bring the management of kitchen waste into the scope of rating and integrity management of catering enterprises. Article 8 Radio, television, newspapers, Internet and other media shall carry out publicity and education activities on laws and regulations related to food safety and kitchen waste management, and guide citizens to save resources and protect the environment. Article 9 Encourage and advocate reducing the amount of kitchen waste through classified delivery, listing clean vegetables, improving processing technology and civilized dining.

Encourage units and individuals to use kitchen waste resource products for agricultural production, afforestation and transportation. Article 10 It is forbidden for any unit or individual to process non-food raw materials such as kitchen waste and waste grease into edible grease for use or sale. Chapter II Generation, Collection, Transportation and Disposal of Kitchen Wastes Article 11 Units that generate kitchen wastes shall abide by the following provisions:

(a) every year before the end of June 38 +2, to the local city appearance and environmental sanitation management department to declare the type and quantity of kitchen waste expected to be produced in the next year; The newly established kitchen waste generating unit shall declare the types and estimated quantity of kitchen waste of the unit to the local city appearance and environmental sanitation management department before opening;

(two) set up an oil-water separation device that meets the specified requirements or set up a grease trap and other facilities to separate and store oil and water;

(three) put the kitchen waste into a special collection container provided by the processing unit;

(four) it is forbidden to mix kitchen waste with non-kitchen waste;

(five) it is forbidden to directly discharge kitchen waste into the urban drainage pipe network or dump oil-water mixture;

(six) signed a collection and transportation service agreement with the unit that obtained the license for the collection and transportation of kitchen waste;

(seven) the establishment of kitchen waste generation ledger, a true and complete record of kitchen waste generation time, type, quantity, destination and so on. ;

(eight) the kitchen waste will be delivered to the collection and transportation unit that has obtained the service license within 24 hours after it is produced;

(nine) it is forbidden to hand over the kitchen waste without harmless treatment to livestock and poultry breeding enterprises or individuals as livestock and poultry feed. Twelfth units engaged in the collection, transportation and treatment of kitchen waste shall obtain the service license for the collection, transportation and treatment of kitchen waste according to law.

City, county (city, district) city appearance and environmental sanitation administrative departments shall determine the collection, transportation and treatment units of kitchen waste through bidding and other means, and announce them to the public.

Without permission, no unit or individual may engage in the collection, transportation and treatment of kitchen waste.

Encourage and promote the integrated operation of kitchen waste collection, transportation and treatment. Thirteenth kitchen waste collection and transportation units shall meet the following conditions:

(1) Having the qualification of a legal person;

(2) Fully enclosed special collection containers with classified collection function, and special transport vehicles with functions of preventing odor diffusion, spillage and dripping;

(3) Having corresponding technology, quality, safety and monitoring management systems;

(4) Having a fixed office space and a place for parking working machinery, equipment and vehicles;

(5) Other conditions stipulated by laws and regulations.
