On February 22, 2018, the Ministry of Justice website published the full text of the revised "Measures for Letters and Calls by Judicial Administrative Agencies" (hereinafter referred to as the "Measures"). Effective on April 1, 2018.

The "Measures" states in Chapter 1 General Provisions that judicial administrative agencies should establish a responsibility system for petition work, incorporate the performance of petition work into the civil servant assessment system, and investigate the relevant persons responsible for dereliction of duty and dereliction of duty in petition work in accordance with the law. The responsibilities of personnel shall be rewarded to units or individuals who have made outstanding achievements.

The "Measures" clearly stipulates 8 situations in which the relevant responsible persons will be held accountable, and those who constitute a crime will be held criminally responsible:

1. Exceeding or abusing their powers and infringing upon the legitimate rights and interests of the petitioner

2. The judicial administrative agency fails to act when it should, thereby infringing upon the legitimate rights and interests of the petitioner;

3. The application of laws and regulations is wrong or in violation of legal procedures, thereby infringing upon the legitimate rights and interests of the petitioner;

Rights and interests;

4. Refusing to implement opinions in support of petition requests made by administrative agencies with the power to handle the matter.

5. Disclose and transfer the complainant’s report or exposure materials or relevant information to the person or unit being reported or exposed; Concealing, lying about, or delaying reporting of urgent petition matters and petition information, or instructing others to conceal, lie, or delay reporting, causing serious consequences;

7. Having a rough style, intensifying conflicts and causing serious consequences;

8. To retaliate against the petitioner.

In addition, those who commit the following five acts will also be held accountable:

1. Failure to register the letters and visits received as required;

2. Refusing to accept letters and calls that fall within the legal scope of authority;

3. Failure to notify the letter-writer in writing within the prescribed time limit whether the letter or call will be accepted;

4. Shifting the blame and being perfunctory , Delaying the handling of petition matters or failing to complete the petition matters within the prescribed time limit;

5. Failure to support complaints that have clear facts and comply with laws, regulations, rules or other relevant provisions.
