Chapter I General Provisions Article 1 In order to strengthen and standardize the supervision and management of fishing boats in fishing ports, maintain the order of fishery production and water safety, protect the legitimate rights and interests of fishing boat owners and operators, safeguard the personal and property safety of citizens, prevent environmental pollution, and promote the sustainable development of fisheries, these Regulations are formulated in accordance with the provisions of the Fisheries Law of People's Republic of China (PRC) and other laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the planning, construction, operation and management of fishing ports and the design, manufacture, transformation and use of fishing boats within the administrative area of this province. The fishery administrative department of the third provincial people's government is responsible for the supervision and management of fishing boats in the fishing ports of the province; The fishery administrative departments of the people's governments of cities, prefectures and counties (cities, districts) shall be responsible for the supervision and administration of fishing ports and fishing boats within their respective administrative areas.

The fishery administration and fishing port supervision and management institution under the fishery administrative department is responsible for the specific work of the supervision and management of fishing boats in fishing ports; Fishing vessel inspection agencies undertake the inspection of fishing vessels.

Other relevant departments of the people's governments at or above the county level shall, in accordance with the division of responsibilities, do a good job in the supervision and administration of fishing boats in fishing ports.

Township People's governments shall do a good job in safety publicity, education and management of owners and operators of fishing boats in fishing ports under their jurisdiction, and cooperate with fishery administrative departments to do a good job in supervision and management of fishing boats in fishing ports. Article 4 People's governments at or above the county level shall incorporate fishing port construction into the national economic and social development plan, arrange corresponding financial funds, and focus on supporting fishing port construction, fishing boat technology research, fishing port fishing boat management information system and water safety emergency mechanism construction. Fifth fishery administrative departments at or above the county level shall publicize the basis, conditions, procedures, time limit, list of materials to be submitted, demonstration text of the application, etc. For the fishing port management approval project, take convenience measures to simplify the procedures for handling permits. Article 6 The fishery administrative department and its fishery administration and fishing port supervision and management institutions and fishing vessel inspection institutions shall do a good job in fishing port supervision, fishing vessel management, consultation, service, publicity, safety education, investigation and handling of fishing vessel water traffic accidents within their respective administrative areas, and their working funds shall be guaranteed. Seventh fishing port operators should abide by the national industrial policy, protect the environment, save resources, operate and pay taxes according to law; Its legally acquired management rights are protected by law, and no unit or individual may illegally interfere. Chapter II Planning, Construction and Management of Fishing Ports Article 8 The provincial fishery administrative department shall, according to the needs of economic and social development, combine the overall planning of fishing ports in China, and link up with the urban and rural planning and port layout planning of our province, and work out the fishing port layout planning of our province in conjunction with the departments of development and reform, environmental protection, land and resources, transportation and water conservancy, and submit it to the provincial people's government for approval. Article 9 The people's governments at or above the county level shall, according to the layout planning of fishing ports, draw up a fishing port construction plan, and report it to the fishery administrative department at the next higher level for the record according to the prescribed procedures.

Fishing port construction planning, the provisions of the state need to be approved, from its provisions. Tenth fishing port construction, renovation, expansion and technical transformation projects shall go through the formalities for examination and approval of capital construction in accordance with the relevant provisions of the state and province, and strictly implement the relevant national and provincial standards and technical specifications. Fishery administration and fishing port supervision and management institutions shall participate in the final acceptance.

The safety facilities and environmental protection facilities of the fishing port shall be designed, constructed and put into use simultaneously with the main project of the fishing port.

Engaged in engineering construction in the fishing port area must be approved by the local municipal, state and county (city, district) fishery administrative departments. Eleventh ships entering and leaving the fishing port shall abide by the articles of association of the fishing port, accept supervision and management, and pay legal fees; The fishing port charter shall be formulated by the fishery administrative department at or above the county level where the fishing port is located and announced to the public.

Fishing port operations shall be carried out in accordance with the provisions of relevant state laws and regulations. Twelfth prohibit fishing, aquaculture and other operations that hinder water safety in fishing port waters.

It is forbidden to leave obstacles to navigation or other potential safety hazards after construction in fishing port waters.

It is forbidden to discharge backfill, waste and other toxic and harmful substances that may pollute the environment into the waters of fishing ports. Thirteenth traffic administrative departments shall solicit the opinions of the fishery administrative departments when setting up navigation AIDS in fishery waters with navigation functions. It is forbidden to set fishing gear and plant aquatic plants in the waterway. Chapter III Management of Fishing Vessels Article 14 A licensing system shall be adopted for the design and repair of fishing vessels. Engaged in the design and repair of fishing boats, should have the corresponding facilities and technical conditions, and obtain the qualification certificate issued by the State Department of fishery administration. Fifteenth fishing boats to implement the registration and compulsory inspection system.

When the following registered items of a fishing boat change, the owner of the fishing boat shall apply to the original port of registry for registration of change: (1) the name of the ship or the port of registry; (2) The scale, tonnage or mode of operation of the ship; (3) The type, quantity or power of the ship's main engine; (4) The name or address of the shipowner. (five) other circumstances that should be registered for change. Article 16 A fishing boat sailing in navigable waters shall meet the following conditions: (1) A valid fishing boat inspection certificate; (2) A valid fishing vessel registration certificate; Three, enough qualified crew; (4) Other conditions stipulated by laws and regulations.
