The Regulations of Chengdu Municipality on the Administration of City Appearance and Environmental Sanitation consists of general rules, the system of responsibility area for city appearance and environmental sanitation, city appearance management, environmental sanitation management, construction and management of environmental sanitation facilities, operation and service management of city appearance and environmental sanitation, supervision and management, and supplementary rules, with a total of 8 chapters and 53 articles, which will be implemented as of June 65438+ 10/day, 2009.

Chapter I General Provisions

Article 1 In order to strengthen the management of city appearance and environmental sanitation, create a clean and beautiful working and living environment in the city, and promote the construction of socialist material civilization and spiritual civilization in the city, these Regulations are formulated in accordance with the Regulations of the State Council on the Management of City Appearance and Environmental Sanitation and the relevant laws and regulations of the state, combined with the reality of Chengdu.

Article 2 Units and individuals within this Municipality must abide by these Regulations.

Article 3 The management of city appearance and environmental sanitation shall follow the principles of unified leadership, graded responsibility, the combination of professional management and mass management, and the combination of functional department supervision and social supervision.

Chengdu City Appearance and Environmental Sanitation Administration is the administrative department in charge of city appearance and environmental sanitation management, and is responsible for organizing the implementation of these regulations.

The competent department of city appearance and environmental sanitation of the district (city) county people's government is responsible for the management of city appearance and environmental sanitation within its jurisdiction.

Street offices and town people's governments are responsible for the management of city appearance and environmental sanitation in their respective jurisdictions.

All levels of public security, urban construction management, planning, environmental protection, health, industry and commerce administration, public utilities, housing management, gardens, municipal engineering management, construction and other departments should carry out their duties, and closely cooperate with the competent department of city appearance and environmental sanitation to implement these regulations.

Article 4 All units and individuals have the right to enjoy a clean and hygienic city appearance environment, dissuade and report violations of these Regulations, maintain city appearance and environmental sanitation facilities, respect the work of city appearance and environmental sanitation workers, and obey the obligations of supervision and management. Shall not obstruct or hinder the city appearance and environmental sanitation staff from performing their official duties and the normal operation of the workers.

Article 5 Newspapers, radio, television, publishing, culture, education and other departments, as well as management units in public places, should strengthen publicity and education on city appearance and environmental sanitation work, and all kinds of schools should organize and carry out city appearance and environmental sanitation education activities, improve citizens' awareness and moral level of city appearance and environmental sanitation, and consciously abide by laws and regulations on city appearance and environmental sanitation.

Article 6 The people's governments of cities and counties (cities) shall incorporate the cause of city appearance and environmental sanitation into the national economic and social development plan and the overall urban planning of the region, and organize their implementation.

Chapter II City Appearance Management

Article 8 All kinds of buildings and public facilities along the street in a city must be well protected and kept clean, and new buildings and public facilities should meet the standards of city appearance stipulated by the state.

Article 9 Without approval, no unit or individual may open a shop, set up a shed or rebuild a balcony, and may not hang or pile up articles that hinder the appearance of the city on the balcony or outside the window. The flowerpot should be arranged safely and beautifully.

Article 10 Without the approval of the Municipal People's Government or the relevant competent departments authorized by the Municipal People's Government, no unit or individual may occupy urban roads to set up bazaars, set up stalls, pile up materials and build temporary buildings. Units and individuals that have been approved to occupy roads shall operate or operate within the scope of the approved places, and shall be responsible for the city appearance and environmental sanitation management of the use lots, and pay the occupation fees according to the regulations.

Shops along the street are not allowed to cross the street.

Do not spread articles, pile up or dump garbage and waste on urban roads.

It is not allowed to set up mourning halls and sacrificial ceremonies on both sides of urban roads.

Occupation of urban roads for loading and unloading goods shall be carried out within the specified time. If it is really necessary to temporarily load and unload small items, it is not allowed to pollute the road or hinder traffic during loading and unloading.

Eleventh approved outdoor billboards (columns), sculptures, galleries, signboards, placards, windows, etc. , the content must be healthy, the picture is complete, the text is standardized, and the appearance is beautiful. The publishing or setting unit shall ensure safety, regular maintenance and cleanliness, and shall not affect the urban landscape.

The establishment of large-scale outdoor advertisements must obtain the consent of the city appearance and environmental sanitation administration, and go through the examination and approval procedures in accordance with the relevant provisions.

Twelfth city municipal, public security, public utilities, housing management, power supply, communications, fire protection, culture, sports, commerce and other departments are responsible for maintaining and keeping street facilities intact and clean.

Thirteenth city landscaping departments and relevant units should always keep the landscaping facilities clean and beautiful. The leaves and dregs left by the transformation of street trees in green streets should be removed in time to keep the green spaces and streets clean and tidy.

Fourteenth construction units must set up obvious signs and safety protection facilities such as guardrails and baffles on the construction site. Stacked materials and machines must be neat, and construction dregs must be removed in time, so as not to hinder traffic and pedestrian activities.

Fifteenth motor vehicles and non-motor vehicles must be parked in parking lots or places where parking is allowed. No parking is allowed in the driveway, sidewalk and other places that hinder traffic.

Sixteenth vehicles with untidy capacity must be cleaned. All kinds of vehicles driving in urban areas must keep the vehicle clean and tidy, and no littering is allowed outside the vehicle. Vehicles carrying bulk and liquid articles such as building materials, waste soil and waste residue, domestic garbage, etc. shall be firmly bound and tightly sealed, and shall not scatter, fly or leak along the street.

Chapter III Cleaning and Cleaning Management

Seventeenth city street cleaning by the environmental sanitation management department. The cleaning and cleaning of green belts, small parks and green spaces shall be the responsibility of the garden management department and the environmental sanitation responsibility area respectively.

Eighteenth airports, stations, bus (electric) docks, parks, parking lots and other public places are responsible for cleaning.

Nineteenth approved stalls, kiosks and mobile trucks must keep the sales site clean and tidy, and remove the waste by themselves; Approved roads and public * * * venues occupied by the occupying unit shall be responsible for cleaning; The market management department is responsible for the cleaning of the bazaars.

Twentieth organs, organizations, units, enterprises and institutions within the scope of environmental sanitation station shall remove it by themselves or entrust the sanitation department to remove it. On both sides of the city streets, the responsibility system of "three guarantees in front of the door" (including sanitation, greening and order in front of the door) is implemented.

Twenty-first any unit or individual must strictly abide by the following provisions:

(1) No spitting;

(two) it is forbidden to throw the peels, stones, scraps of paper, cigarette butts, glass bottles (slag), packaging and other wastes;

(three) it is forbidden to urinate in the sewer or dump garbage and feces;

(four) it is forbidden to dump sewage, garbage, feces or abandon animal carcasses into the streets;

(five) it is forbidden to scribble, depict, paste and nail on street buildings, structures, public facilities and street trees;

(six) prohibit motor vehicles with untidy vehicles from entering or driving in urban areas;

(seven) it is forbidden to repair and wash cars on urban roads without a license;

(eight) it is forbidden to throw paper flowers and paper on the way to the funeral;

(nine) it is forbidden to throw waste or dump garbage and construction waste into green belts, small parks and green spaces;

(ten) prohibit residents from raising edible livestock and open poultry in urban areas;

(eleven) it is forbidden to raise dogs in urban areas (except guard dogs, military dogs, scientific research dogs, performance dogs and ornamental dogs), and the ornamental dogs should be strictly managed.

Chapter IV Removal and Disposal of Wastes

Twenty-second municipal solid waste must be dumped into garbage platforms, containers, garbage trucks or designated places according to regulations.

Waste, charcoal ash and construction waste generated by the production and operation of units and individual operators shall be removed to the place designated by the environmental sanitation management department or entrusted to the environmental sanitation operation unit for removal, and shall not be dumped into the garbage bin (Taiwan).

Twenty-third medical units, scientific research units, biological products factories, slaughterhouses and other special solid wastes with viruses and germs, animal carcasses, waste radioactive substances, etc. , are not allowed to be mixed with domestic garbage, are not allowed to enter the garbage dump. Special solid wastes and animal carcasses are collected, removed and treated harmlessly by the municipal environmental sanitation management department; Radioactive waste shall be disposed of in accordance with the relevant provisions of the state.

Twenty-fourth city residents living garbage and feces, unified management by the environmental sanitation management department, unified removal. Environmental sanitation management department must do garbage daily, daily, not backlog; Feces should be removed in time, and no overflow is allowed.

Chapter V Management of Public Environmental Sanitation Facilities

Twenty-fifth public health facilities such as public toilets, garbage dumps (stations), manure storage stations (pools) and garbage stations (barrels) must be included in the urban construction planning, unified layout, and designed, constructed and used simultaneously with the construction of new areas and the transformation of old cities.

Article 26 Any unit that builds, expands or rebuilds a building must set up environmental sanitation facilities in accordance with regulations.

No unit or individual may obstruct or hinder the construction, expansion and reconstruction of various environmental sanitation facilities.

Twenty-seventh all units and individuals must take good care of public health facilities, and may not destroy, move or dismantle them. If it is really necessary to be demolished due to construction, the construction unit must report it to the competent department of city appearance and environmental sanitation for approval, and then dismantle it according to the principle of building first and then demolishing it.

Twenty-eighth environmental sanitation management departments at all levels should strengthen the maintenance and management of public environmental sanitation facilities and keep them clean and tidy.

Public toilets, garbage dumps (stations), dung stations and dung transport points must be managed by special personnel and disinfected regularly to prevent mosquitoes and flies from breeding.

Twenty-ninth without approval, no unit or individual may rent or lease cultivated land to pile up garbage without authorization.

Chapter VI Reward and Punishment

Thirtieth units and individuals that have made remarkable achievements or significant contributions in the work of city appearance and environmental sanitation shall be commended or rewarded by the people's governments at all levels or the administrative departments of city appearance and environmental sanitation.

Article 31 In case of any of the following acts in violation of the provisions of these Regulations, the administrative department of city appearance and environmental sanitation or other supervisory and administrative departments may, in addition to criticizing and educating and ordering corrections, order restitution, compensation for losses, renovation within a time limit, demolition within a time limit, fines, suspension of business for rectification and confiscation of tools, articles and illegal income engaged in illegal activities according to different situations; Overdue renovation, demolition, can be forced to transform and dismantle according to law:

(a) spitting, urinating, throwing peels, stones, scraps of paper, paper flowers, scraps of paper, cigarette butts, glass bottles (slag), packaging, throwing animal carcasses, dumping sewage, garbage and feces;

(two) in the street buildings, structures or public facilities graffiti, graffiti, paste, nail hanging;

(III) Unauthorized occupation of roads to build sheds, pile up articles, repair cars, wash cars, pile up drying articles, set up stalls or go out to occupy the road, occupy the road and set up mourning halls to hang sacrifices;

(four) in the process of loading and unloading transportation, waste, garbage, feces and other environmental pollution;

(5) Failing to remove garbage and feces in time as required, resulting in the breeding of mosquitoes and flies and the overflow of feces;

(six) garbage and toxic and hazardous wastes produced by industrial production, construction and commercial operation are not removed, dumped or piled up according to regulations;

(seven) failing to set up or dismantle environmental sanitation facilities in accordance with the provisions, and damaging environmental sanitation facilities;

(eight) failing to set up billboards (columns), sculptures, galleries, signboards, signs, slogans and windows;

(nine) environmental sanitation facilities are not required to take anti-pollution measures such as cleaning and disinfection;

(ten) failing to eliminate the four pests (rats, flies, mosquitoes and cockroaches) according to the unified regulations;

(eleven) the construction site affects traffic safety and hinders the removal of garbage and feces;

(twelve) refusing to implement the system of environmental sanitation responsibility area;

(thirteen) blocking sewers and cesspools, causing environmental pollution;

(fourteen) street shops do not implement the "three guarantees in front of the door", which seriously affects the city appearance and environmental sanitation, and refuses to make corrections within a time limit;

(fifteen) unauthorized lease or lease of cultivated land to pile up garbage to pollute the environment;

(sixteen) without changing the nature of the use of street houses, affecting the city appearance and environmental sanitation or obstructing traffic;

(seventeen) other acts in violation of the provisions of this Ordinance.

Article 32 Whoever, in violation of the provisions of this Ordinance, commits any of the following acts shall be criticized and educated by the administrative department of city appearance and environmental sanitation or the unit entrusted by it, and shall be ordered to make corrections and take remedial measures, and may be fined, detained or confiscated tools and articles engaged in illegal activities, ordered to suspend business for rectification, confiscated illegal income, and revoked the business license for occupying roads according to the circumstances:

(a) lease or transfer of zhandao business stalls;

(2) Lease or transfer the business license;

(three) without a license to set up a stall;

(four) changing the nature of road use without authorization;

(5) Raising dogs without authorization;

(6) Raising livestock and poultry in cities;

(seven) default or refusal to pay operating expenses.

Article 33 Whoever violates these regulations, disobeys education management and beats law enforcement personnel and city appearance and environmental sanitation workers shall be punished by the public security organs in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security, and if the case constitutes a crime, the judicial organs shall investigate the criminal responsibility according to law.

Thirty-fourth units or individuals who refuse to accept the punishment decision may, within 05 days from the date of receiving the punishment decision, apply for reconsideration to the higher authorities of the department that made the punishment decision; If you are not satisfied with the reconsideration decision, you can bring a lawsuit to the people's court within 15 days from the date of receiving the reconsideration decision, or you can bring a lawsuit directly to the people's court. If it fails to apply for reconsideration, bring a lawsuit or perform the punishment decision within the time limit, the department that made the punishment decision shall apply to the people's court for compulsory execution.

Thirty-fifth units and individuals that violate the provisions of these regulations and cause pollution to the city appearance and environmental sanitation have the responsibility to eliminate pollution and eliminate hazards, and compensate the units or individuals that directly suffer from pollution hazards.

Disputes over the liability for compensation and the amount of compensation may be handled by the competent department of city appearance and environmental sanitation at the request of the parties concerned. If a party refuses to accept the handling, it may be handled in accordance with the provisions of relevant laws and regulations.

Article 36 All kinds of street-facing buildings, structures and public facilities that do not meet the city appearance and environmental sanitation standards stipulated by the state shall be ordered by the city appearance and environmental sanitation administrative department of the city people's government in conjunction with the city planning administrative department to transform or dismantle them within a time limit; If it is not rebuilt or demolished within the time limit, it shall be forcibly demolished by the city appearance and environmental sanitation administrative department or the city planning administrative department with the approval of the people's government at or above the county level, and may also be fined.

Article 37 Whoever steals or destroys various municipal and environmental sanitation facilities shall be punished by the public security organ in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law.

Thirty-eighth city appearance and environmental sanitation staff, due to dereliction of duty caused by city appearance and environmental sanitation pollution, by the unit or the competent department at a higher level depending on the circumstances to give criticism or administrative sanctions.

Thirty-ninth city appearance and environmental sanitation administrative departments shall issue certificates to all people in person according to law; The fine shall be turned over to the finance in full, and the receipt of the fine printed by the Municipal Finance Bureau shall be uniformly used.

If the owner of the seized goods fails to handle it at the designated place within the prescribed time limit, it shall be handled in accordance with the relevant provisions of Chengdu Municipality on the management of confiscated property.

Article 40 The staff of the supervision and administration department of city appearance and environmental sanitation shall be loyal to their duties, enforce the law in a civilized manner, and shall not engage in malpractices for personal gain. Those who abuse their powers, neglect their duties and abuse their power for personal gain shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law.

Chapter VII Supplementary Provisions

Article 41 The Chengdu Municipal People's Government shall formulate detailed rules for implementation in accordance with these Regulations.

The Chengdu Municipal People's Government shall be responsible for the interpretation of the problems in the specific application of these Regulations.

Article 42 These Regulations shall come into force on May 6, 1996 after being approved by the Standing Committee of Sichuan Provincial People's Congress.

The Interim Measures for the Administration of Urban Appearance and Environmental Sanitation in Chengdu issued by Chengdu Municipal People's Government on March 2 1 and 1983 shall be abolished at the same time. In the past, the measures and regulations on the management of city appearance and environmental sanitation issued by this Municipality are inconsistent with these regulations, and these regulations shall prevail.
