Qingdao City Outdoor Advertising Setup Management Measures (Trial)
Chapter 1 General Provisions Article 1 In order to strengthen urban management, standardize outdoor advertising installation behavior, and rationally utilize urban space resources, these Measures are formulated in accordance with relevant laws and regulations and in conjunction with the actual situation of this city. Article 2 These Measures apply to the setting up of outdoor advertising and related management activities in the administrative areas of Shinan District, Shibei District, Sifang District, Licang District, Laoshan District, Huangdao District and Chengyang District. Article 3 The outdoor advertising settings referred to in these Measures include:
(1) Using outdoor venues, buildings (structures) and municipal facilities such as roads and tunnels to set up display boards, neon lights, luminous fonts, and electronic displays The behavior of advertising facilities such as screens, electronic flap devices, light boxes, advertising columns, publicity boards, and physical models;
(2) Using buildings (structures), vehicles, floating objects on the water, and lift-offs The act of drawing, posting, and hanging advertisements on appliances, inflatables, pavilions, construction site walls (barriers), models, etc.;
(3) Enterprises, institutions, other organizations, and individual industrial and commercial households at their business locations and offices The act of setting up door plaques indicating the name, font size, and logo of the unit; (4) Other acts of setting up outdoor advertisements. Article 4 The municipal and district governments shall establish an Outdoor Advertising Management Committee (hereinafter referred to as the Outdoor Advertising Committee) to be responsible for coordinating major issues concerning the setting up and management of outdoor advertising.
The municipal urban and rural construction administrative department and the outdoor advertising department determined by the district government are responsible for organizing the joint approval and daily management of outdoor advertising settings.
Planning, industry and commerce, urban management and law enforcement, public security, transportation and other departments shall participate in joint approval and management of outdoor advertising in accordance with their respective responsibilities. Article 5 When setting up outdoor advertisements, the principles of unified planning, zoning control, reasonable layout, safety regulations, and civilized and beautiful appearance shall be followed. Chapter 2 Planning and Regulation Article 6 The municipal urban and rural planning department shall, in accordance with the city's overall plan, work with the urban and rural construction, industry and commerce, urban management and law enforcement departments and district governments to prepare an overall plan for outdoor advertising settings, which shall be reviewed by the Municipal Outdoor Advertising Committee and submitted in accordance with procedures. It will be announced and implemented after approval by the municipal government. Article 7 The municipal department in charge of urban and rural planning shall, based on the overall plan for outdoor advertising installation, organize the preparation of outdoor advertising installation control plans and detailed plans on urban main roads and key areas (nodes), and submit them to the Municipal Outdoor Advertising Committee for approval before promulgating and implementing them. Article 8: Each district government shall organize the preparation of a detailed plan for outdoor advertising installation in its jurisdiction based on the overall plan and control plan for outdoor advertising installation, and submit it to the Municipal Outdoor Advertising Committee for approval before promulgating and implementing it. Article 9 The preparation of outdoor advertising installation plans shall be in line with the city's overall plan, adhere to the combination of key control and zoning management, be conducive to protecting the city's style, and coordinate with the regional environment and urban construction and development. Article 10 The outdoor advertising setting plan shall include the following contents:
(1) Prohibited areas, restricted areas, and suitable areas;
(2) Outdoor advertising layout and total amount , density, and type control principles;
(3) Basic setting requirements for outdoor advertising settings such as location, form, scale, specifications, color, materials, and lighting. Article 11 The municipal administrative department of urban and rural development shall organize the preparation of technical specifications for outdoor advertising installations and submit them to the Municipal Outdoor Advertising Committee for approval before promulgating and implementing them. Article 12 When organizing the preparation of outdoor advertising installation plans and outdoor advertising installation technical specifications, hearings, demonstration meetings, symposiums, etc. shall be held to openly listen to the opinions of relevant departments, industry associations, relevant experts and the public. Article 13 It is prohibited to set up outdoor advertisements under any of the following circumstances:
(1) Using traffic signs and traffic safety, fire protection, electricity, communications, postal services, road lighting and other public facilities ;
(2) Affecting traffic signs and traffic safety, the use of municipal, fire-fighting and other public facilities, or affecting the safe and smooth flow of road traffic;
(3) Endangering construction (construction) ) Building safety and public safety;
(4) Occupying green space or affecting the growth of trees;
(5) Other situations that hinder production and life and affect the urban landscape .
Article 14 It is prohibited to set up outdoor commercial advertisements in the following areas and locations:
(1) Construction control areas of cultural relics protection units, historical buildings, urban landscape protection zones and scenic spots;
(2) State agencies, primary and secondary schools, museums, libraries, cultural centers, hospitals, etc.;
(3) Overpasses and pedestrian overpasses, various guardrails, poles, transparent walls, roads on both sides of the road Isolation zone;
(4) Public transportation such as buses and taxis;
(5) Other areas determined by planning where outdoor commercial advertising is prohibited ,Location. Article 15 The municipal urban and rural planning department and the municipal urban and rural construction administrative department shall regularly organize and evaluate the implementation of outdoor advertising installation plans and outdoor advertising installation technical specifications. If it is considered that revision is really needed, revision should be organized in a timely manner. Chapter 3 Installation License Article 16 The installation of outdoor advertisements shall comply with the installation plan and installation technical specifications, and the licensing procedures shall be handled in accordance with the law. Without permission, no unit or individual may set up outdoor advertisements. Article 17: The licensing of outdoor advertisements shall be subject to a system of unified acceptance, joint examination and approval, and hierarchical management.
Applications for outdoor advertising installations within the planning scope of urban main roads and key areas (nodes) shall be uniformly accepted by the municipal administrative department of urban and rural development. Applications for other outdoor advertising installations shall be uniformly accepted by the outdoor advertising department determined by the district government entrusted by the municipal urban and rural construction administrative department.
Temporary outdoor advertising that is valid within fifteen days. Applications for the installation of temporary outdoor advertisements and door plaques shall be uniformly accepted by the outdoor advertising department determined by the district government.
The placement of outdoor advertisements within highway land and building control areas shall be implemented in accordance with relevant regulations.
