Chongqing People’s Police Patrol Duty Regulations (Trial)

Chapter 1 General Provisions Article 1 In order to maintain social order, public safety and clean city environment, and protect citizens’ personal safety and public and private property safety, in accordance with the "People's Police Law of the People's Republic of China and the People's Republic of China" 》 and relevant laws and regulations, and based on the actual situation of this city, these regulations are formulated. Article 2 The Municipal Public Security Bureau shall be in charge of the patrol work of the city’s people’s police.

Municipal and district (city) and county public security organs have established People's Police Patrol (hereinafter referred to as patrol) agencies, which are responsible for the duty of urban roads according to the division of responsibilities. Article 3 The Municipal Public Security Bureau and the district (city) and county people's governments are responsible for organizing the implementation of these regulations. The relevant functional departments of the government shall cooperate with the public security organs in performing patrol duties. Article 4: Patrol police officers shall perform duties on foot and in motor vehicles according to the determined patrol area.

There should be at least two patrol officers on duty. Article 5: Units and citizens shall support and cooperate with patrol police on duty and obey the management of patrol police. Article 6: When performing their duties, patrol officers must strictly abide by laws and disciplines, enforce the law impartially, wear police uniforms and patrol police badges in accordance with regulations, use police equipment in accordance with the law, and consciously accept the supervision of society and citizens. Units or citizens have the right to file accusations and reports when they discover that patrol policemen have violated laws and disciplines. Chapter 2 Powers Article 7 Patrol officers perform the following duties while on duty:

(1) Maintain public security order, traffic order and public safety;

(2) Maintain the city appearance and environment Keep clean and protect municipal public facilities;

(3) Participate in rescue work for outstanding disasters and maintain order;

(4) Dissuade and stop public security incidents in the patrol area Disputes, preventing and stopping illegal and criminal acts;

(5) Giving directions to pedestrians, and rescuing citizens who are suddenly injured, sick, in distress, etc. in urgent need of help;

(6) Accepting cases from citizens Call the police;

(7) Check the appearance and conduct of the People's Police;

(8) Perform other tasks performed by patrol police as stipulated in laws, regulations and rules. Article 8 Patrol police shall exercise the following powers in accordance with these regulations when on duty:

(1) Interrogate persons suspected of committing crimes and inspect suspected vehicles and items;

(2) Check resident identity cards , temporary residence permit and relevant licenses;

(3) Corresponding compulsory measures may be taken against current criminals, major criminal suspects or fugitive criminals in accordance with the law;

(4) Temporary detention and Vehicles, items and documents related to administrative violations or criminal suspects;

(5) Correct traffic violations and stop non-traffic road-occupying behaviors;

(6) Respond to threats to public safety* **Safety and violations of public security management, urban management, city appearance and environmental sanitation management may be punished in accordance with these regulations or transferred to the relevant administrative departments for handling;

(7) In pursuit, rescue, rescue, etc. In emergencies, priority can be given to the use of transportation and communication tools of agencies, groups, enterprises, institutions, and individual citizens, but they must be returned promptly after use. Any damage caused shall be compensated.

(8) Other powers conferred by laws, regulations and rules. Chapter 3 Illegal Acts and Punishments Article 9 Whoever commits any of the following acts that impedes public safety or disrupts social order, which is not sufficient for criminal punishment, shall be detained for not more than 15 days or given a warning, and may be fined 200 yuan alone or concurrently. The following fines are imposed:

(1) Fighting in groups, provoking troubles, insulting women, or engaging in other hooligan activities;

(2) Spreading rumors to confuse the public, inciting trouble or falsely reporting dangers, and creating chaos

(3) Beating others, causing minor injuries;

(4) Coercing or tricking people under the age of 18 to perform horrific or cruel shows, destroying their physical and mental health;

(5) Using feudal superstitious means to disrupt social order;

(6) Illegally selling, carrying daggers, three-edged knives, switch blades and other controlled knives;

(7) Illegal carrying of guns, ammunition or other violations of gun management regulations;

(8) Stealing, defrauding, robbing, or damaging public or private property;

(9) Unreasonably intercepting a vehicle or forcibly boarding a vehicle, affecting the normal operation of the vehicle, and refusing to listen to dissuasion;

(10) Refusing or obstructing state personnel from performing their duties in accordance with the law, without using violence or threats. Article 10 Anyone who illegally transports, stores, sells or sets off fireworks and firecrackers shall be punished in accordance with the "Chongqing Regulations on Prohibiting the Setting off of Fireworks and Firecrackers".

Article 11 Anyone who illegally manufactures, sells, possesses, or uses people's police signs, uniforms, police equipment, or certificates shall be punished in accordance with the provisions of the People's Police Law of the People's Republic of China and the People's Republic of China. Article 12 Anyone who commits any of the following traffic violations shall be punished in accordance with the following provisions:

(1) Anyone who violates the parking regulations of motor vehicles shall be punished in accordance with Article 68 of the Several Provisions on Chongqing Road Traffic Management Warnings, fines, and suspension of driving licenses;

(2) Driving or parking non-motor vehicles in areas (road sections) where non-motor vehicles are prohibited from driving or parking shall be punished in accordance with certain regulations on road traffic management in Chongqing. Warning or fine of less than 5 yuan:

Article 13 Anyone who commits the following violations of city appearance and environmental sanitation management shall be punished in accordance with the following provisions:

(2) Anyone who discharges sewage and leaks other solid and fluid substances on urban roads shall be fined 30 yuan per square meter according to the contaminated area; those who dump garbage and dirt will be fined 1,000 yuan The following fines shall be imposed; if the circumstances are serious, a fine of 1,000 to 3,000 yuan shall be imposed;

(3) Indiscriminate posting, graffiti, hanging advertisements, posters and Those who use paper slogans shall be ordered to remove them within a time limit and be fined 50 yuan to 1,500 yuan in accordance with the relevant provisions of the Municipal People's Government's "Notice on Prohibiting the Indiscriminate Posting and Hanging of Outdoor Publicity Materials with Indiscriminate Graffiti";

(4) Anyone who builds indiscriminately on both sides of the road will be ordered to stop construction immediately, demolish it within a time limit, and be fined 50 yuan to 200 yuan. If it is not demolished within the time limit, it will be transferred to the relevant department for forced demolition in accordance with the law;

(5 ) Anyone who sets up a stall on the road without authorization to engage in business activities shall be ordered to make corrections and fined not more than 200 yuan; if he refuses to make corrections, his business items may be temporarily detained;

(6) Illegal road occupation Those who wash cars will be banned, fined from RMB 100 to RMB 500, and their cleaning equipment may be confiscated.
